CITY OF HERMOSA BEACH
ORDINANCE NO. 23-1466
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY HERMOSA BEACH,
CALIFORNIA, AMENDING CHAPTER 10.40 OF THE HERMOSA BEACH
MUNICIPAL CODE TO ESTABLISH SPEED LIMITS FOR BUSINESS ACTIVITY
DISTRICTS AND SCHOOL ZONES, REDUCE SPEED LIMITS ON HERMOSA
AVENUE AS PERMITTED BY THE CALIFORNIA VEHICLE CODE AND
DETERMINE THE ORDINANCE TO BE EXEMPT FROM THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT
THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1. Findings and Purpose
A. The City of Hermosa Beach uses radar in the enforcement of its speed limits.
B. The State of California Vehicle Code provides that posted speed limits
established under local authority, and conforming to the applicable
sections and subsections of the State of California Vehicle Code may not
be enforced through the use of radar or other electronic devices unless the
posted speed limit has been reevaluated and justified by an engineering
and traffic survey conducted with the last five years, seven years, or
fourteen years under certain conditions;
C. The traffic and engineering survey as defined by the State of California
Vehicle Code must consider the prevailing speeds on the roadway as
determined by traffic engineering measurements, accident history, and
highway, traffic, and roadside conditions pursuant to establishing a posted
speed limit;
D. City staff conducted traffic counts and segment speed surveys citywide.
Staff performed the required fieldwork to collect vehicular traffic volumes
and speed data at thirty-eight locations; and
E. The City Traffic Engineer reviewed the roadway conditions and the studies
conducted and recommended speed limit posting.
SECTION 2. Section 10.40.020 of Chapter 10.40 of Title 10 of the Hermosa
Beach Municipal Code is amended to read as follows:
10.40.020 Prima Facie Speed Limits

The prima facie speed limit that is most appropriate to facilitate the orderly
movement of traffic and is a speed limit that is reasonable and safe is set forth
in the chart below with reference to those streets or portions of street so
identified. No person shall operate any vehicle on the street or streets
segments identified below at a speed in excess of the speed set forth in the
following chart:

The prima facie speed limit that is most appropriate to facilitate the orderly
movement of traffic and is a speed limit that is reasonable and safe on all
streets other than the streets listed above is 25 mph. No person shall operate
a motor vehicle on any street in the City not listed in the chart above in excess
of 25 MPH.
SECTION 3. Section 10.40.025 of Chapter 10.40 of Title 10 of the Hermosa
Beach Municipal Code is added to read as follows:
10.40.025 Prima Facie Speed Limits in School Zones
The prima facie speed limit for a school zone on a residence street pursuant
to the State of California Vehicle Code Section 22358.4(b)(1) that is most
appropriate to facilitate the orderly movement of traffic on a street contiguous
to a school building or school grounds while children are going to or leaving
the school, either during school hours or during the noon recess period, is set

forth in the chart below with reference to those streets or portions of streets so
identified. No person shall operate any vehicle on the streets or street
segments identified in the following chart at a speed in excess of the speed
set forth in the following chart:

SECTION 4. Environmental Review. The City Council finds that this Ordinance
is not subject to the California Environmental Quality Act (“CEQA”) pursuant to
State CEQA Guidelines Section 15378(b)(2), which provides that general policy
and procedure making is not a CEQA project, Section 15378(b)(5), which
provides that organizational and administrative activities of governments that will
not result in physical environmental impacts are not CEQA projects, and here the
Ordinance establishes speed limits. Further, in providing notice of the established
speed limits, the City Council finds the Ordinance would be exempt from CEQA

pursuant to Section 15301, which consists of the maintenance or minor alteration
of existing public structures involving negligible or no expansion of use, Section
15302, which consists of the replacement or reconstruction of existing structures
and facilities, and Section 15303, which consists of the construction and location
of limited numbers of new, small facilities or structures, and the City Council finds
that no exceptions under State CEQA Guidelines section 15300.2 apply that might
otherwise negate the application of this exemption. Finally, the City Council finds
that State CEQA Guidelines Section 15061(b)(3) exempts those activities for
which it can be seen with certainty that there is no potential to result in significant
environmental effects. The Ordinance has no potential to result in physical
change to the environment, directly or indirectly, as the Ordinance establishes
the prima facie speed limits along three roadway segments.
SECTION 5. Effective Date. This Ordinance shall take effect thirty (30) days
after its passage and adoption pursuant to California Government Code section
36937.
SECTION 6. Certification. The City Clerk is directed to certify the passage
and adoption of this Ordinance; cause it to be entered into the City’s book of
original ordinances; make a note of the passage and adoption in the records of
this meeting; and, within fifteen (15) days after the passage and adoption of this
Ordinance, cause it to be published or posted in accordance with California law.
