RESOLUTION NO. 92-5536
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HERMOSA BEACH DENYING, WITHOUT PREJUDICE, A
CONDITIONAL USE PERMIT, PRECISE DEVELOPMENT
PLAN AND TENTATIVE PARCEL MAP TO CONSTRUCT A
THREE UNIT CONDOMINIUM UPON PROPERTY LOCATED
AT 1901 PACIFIC COAST HIGHWAY.
WHEREAS, on April 28, 1992 the City Council held public
hearings to consider a Conditional Use Permit, Precise
Development Plan and Tentative Parcel Map to construct a three
unit condominium upon property located at 1901 Pacific Coast
Highway; and
WHEREAS, numerous persons spoke at the hearings in favor of
and against the granting of the Conditional Use Permit, Precise
Development Plan and Tentative Parcel Map; and
WHEREAS, the City Council has considered all of the evidence
presented which includes, but is not limited to:
1. The various staff reports
2. Letters and petitions from residents of the city
3.
Statements in
favor and
in opposition
4.
Oral testimony
presented
at the hearing
5. Relevant provisions of the Municipal Code
Section 1. The City Council finds that:
1. The intensity and the type of the development
including, but not limited to, side yard setback and vehicle
access to Pacific Coast Highway is not in character with the
development standards of the surrounding area.
2. The project exceeds the permissible side yard
setbacks as required by Section 1217 of the Zoning Code.
3. The proposed driveway slope for vehicular ingress
and egress at the point of the public right-of-way
constitutes a potential public safety hazard.
Section 2. In view of all of the evidence and based on
the foregoing findings, the City Council concludes as follows:
1. The site for the proposed use is not adequate in size,
shape and circumstances to accommodate the project as
proposed.

2. The design of the development proposed is not consistent
with the required setbacks and would negatively impact the
neighborhood's integrity and the character of the community.
3. The driveway slope of the proposed project will have an
adverse effect upon pedestrian and vehicle safety and may
constitute a hazard to the public welfare.
4. Any of the above conclusions, independent from the
others, is sufficient grounds to deny the granting of the
subject approvals.
Section 3. In view of all of the evidence, and based on
the foregoing findings and conclusions, the City Council hereby
decides as follows:
1. The application for a Precise Development Plan is hereby
denied without prejudice to complying with the side yard
setback requirements of the zoning code and reducing the
slope of the driveway at the point of the public right-of-
way.
2. The application for issuance of a Conditional Use Permit
is hereby denied without prejudice as set forth above.
3. The application for a Tentative Parcel Map is hereby
denied without prejudice as set forth above.
4. The applicant shall be notified of this action by mail
and shall have six months to submit new plans consistent with
the findings of this resolution.
Section A. The City Clerk shall certify as to the
adoption of this resolution and shall cause the same to be
processed in the manner required by law.
PASSED, APPROVED and ADOPTED on this 12th day of May, 1992.

certify that the foregoing Resolution No. 91-5536 was duly and
regularly passed, approved and adopted by the City Council
of the City of Hermosa Beach at a Regular meeting of said
Council at the regular meeting place thereof on May 12,
1992.
