HomeMy WebLinkAboutRES-92-5539 (CROSSING GUARD/ORDER/92-93)1 114� 2 3 4 '"00' 5 6 7 8 9 10 11 12 13 14 `.►f 15 16 17 18 19 20 21 22 23 24 \ftop� 25 26 27 28 RESOLUTION NO. 92- 5539 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CERTAIN CROSSING GUARD SERVICES PURSUANT TO THE "THE CROSSING GUARDS MAINTENANCE DISTRICT ACT OF 197411, CHAPTER 3.51 ARTICLES 1, 21 3 AND 41 SECTION 55530 THROUGH 55570, OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA, AT CERTAIN LOCATIONS IN THE SAID CITY, FOR THE FISCAL YEAR BEGINNING JULY 1, 1992 THROUGH JUNE 30, 1993; AND APPOINTING A TIME AND PLACE FOR A PUBLIC HEARING IN RELATION THERETO. HERMOSA BEACH CROSSING GUARDS MAINTENANCE DISTRICT 1992-1993 THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The public interest and convenience require, and that it is the intention of the City Council of the City of Hermosa Beach, California, to order certain Crossing Guard Maintenance Services to be provided and maintained at certain street crossings throughout the City for the fiscal year beginning July 1, 1992 through June 30, 1993. All of the services above specified shall be provided and maintained in accordance with requirements of the Director of Public Works. Said costs shall be funded as referred to in the Report of the Director of Public Works dated May 21, 1992, on file in the office of the City Clerk and which is hereby refe to and by this reference incorporated herein and made a part hereof. SECTION 2. To expedite the providing and maintenance of said services, the City Council may at any time transfer into the "Hermosa Beach Crossing Guard Maintenance District 1992-1993 Fund", out of any money in the General Fund, any sums as it shall deem necessary, and the sums so transferred shall be deemed a loan to such fund, and shall be repaid out of the proceeds of the - 1 - U ,%.d assessments provided for in this resolution (within the same 1 fiscal year) and pursuant to the provisions of Section 55561 of 2 the Crossing Guard Maintenance District Act of 1974. 3 SECTION 3. That said contemplated service, in the opinion of 4 the City Council, is of more than local or ordinary benefit, and 5 said City Council hereby makes the expense of said service 6 chargeable upon a district, which district said Council hereby 7 declares to be the district benefited by said Crossing Guard 8 Services, and to be assessed to pay the costs and expenses 9 thereof. Said district is all of the City of Hermosa Beach as 10 shown on MAP OF CROSSING GUARD MAINTENANCE DISTRICT NO. 1992-1993 11 on file in the Office of the City Clerk, on which exterior 12 boundaries thereof are described as the boundary lines of the 13 said City, excepting from said district any portion of any public 14 land, street or alley which may be included therein. Reference 15 � is hereby made to the said map as the description of said 16 district. The said map on file shall govern as to the extent of 17 said assessment district. 18 SECTION 4. The Council of the City of Hermosa Beach, 19 California, shall levy an annual special assessment to pay the 20 costs of maintaining said Crossing Guards. The annual assessment 21 shall be levied and collected at the same time and in the same 22 manner and with the same interest and penalties as general taxes 23 of the City of Hermosa Beach, California. (Said taxes as 24 collected by the Los Angeles County Tax Collector for the City of 25 Hermosa Beach.) 26 SECTION 5. Any lots or parcels of land known as public 27 property, as the same is defined in Section 55560 of said 28 2 - �%W ' 005 Crossing Guard Maintenance Act of 1974, hereinafter referred to 1 which are included in the said assessment district, shall be 2 omitted and exempt from the assessment to be made to cover the 3 costs and expenses of said contemplated improvement. 4 SECTION 6. The improvement contemplated by this Resolution 5 of Intention shall be done under the provisions of the "Crossing 6 Guard Maintenance District Act of 197411, Chapter 3.5, Articles 1, 7 21 3 and 4, Section 55530 through 55570 of the Government Code of 8 the State of California. 9 SECTION 7. That Tuesday, June 23, 1992, at the hour of 8:00 10 p.m. of the said day be and the same is hereby appointed as the 11 time, and the City Council Chamber in the City of Hermosa Beach, 12 California is hereby appointed as the place for hearing protests 13 as to the question of approving and confirming the assessment to 14 ' said improvement. 15 SECTION 8. That the City Clerk is hereby authorized, 16 designated and directed to give notice of said hearing in time, 17 form and manner as required by law. 18 SECTION 9. That the EASY READER, a weekly newspaper of 19 general circulation, circulated within the said City of Hermosa 20 Beach, California, is hereby designated as the newspaper in which 21 said notice shall be published. 22 SECTION 10.
