HomeMy WebLinkAboutRES-91-5450 (CUP/1605 PCH/ALCOHOL)1.■10� 1 RESOLUTION NO. 91-5450 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, 3 CALIFORNIA, SUSTAINING THE PLANNING COMMISSION'S DECISION TO DENY A CONDITIONAL USE PERMIT AND PARKING PLAN AMENDMENT FOR ON -SALE 4 GENERAL ALCOHOL IN CONJUNCTION WITH BILLIARDS, FOOD SERVICE, AND RETAIL SALES AT 1605 PACIFIC COAST HIGHWAY SUITES 116 THROUGH 5 119, AND LEGALLY DESCRIBED AS PORTIONS OF LOTS 13 AND 14 BLOCK 81, SECOND ADDITION TO HERMOSA BEACH TRACT. 6 WHEREAS, the City Council held a public hearing on May 28, 7 1991, to receive oral and written testimony regarding a request 8 for a Conditional Use Permit and Parking Plan amendment at 1605 9 Pacific Coast Highway Suites 116 through 119 for on -sale general 10 alcohol in conjunction with billiards, food service, and retail 11 sales and made the following findings: 12 13 A. The applicant is proposing to open a new business in the 14 ground floor level of the Hermosa Pavilion which consists of 15 17 billiards tables, food service and bar seating, and a 16 small retail area, and would include on -sale alcohol. As 17 such, the proposed use resembles a bar/cocktail lounge with 18 an adjunct recreation use; 19 B. This location within the Pavilion was initially identified 20 for retail space as part of the approved Parking Plan; their 21 applicant proposes an exchange with restaurant space upstairs'; 22 to address the parking impact; 23 C. The proposed use is a significant departure from the what was 24 depicted in the approved Parking Plan, which was based on 25 shared parking and, therefore, will result in a deficiency in 26 parking for the entire Hermosa Pavilion when it is fully 27 leased; 28 D. The proposed use is not compatible with adjacent residential - 1 - 1_.� `..0PV 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 �..,% 25 26 27 28 uses as the entrance to the business is in close proximity to several residences to the north, and as such, the noise and the gathering of people will cause a nuisance that cannot be mitigated; E. A saturation of alcohol establishments already exists within the City which negatively affects the peace, quiet and well being of the citizens of Hermosa Beach, and which place an increasing burden on Police Department resources; F. Recent past practice has been to approve alcohol establishments only in conjunction with a primary use of a bonafide restaurant and the proposed use is primarily a billiards use based on submitted floor plans. Alcohol establishments not in conjunction with bonafide restaurants have been a continuous source of complaints and police problems regarding noise, trash, loitering, altercations, and nuisances in general. NOW, THEREFORE, the City Council of the City of Hermosa Beach, California does hereby sustain the Planning Commission's decision to deny a Conditional Use Permit and Parking Plan Amendment for on -sale general alcohol in conjunction with billiards, food service and retail sales.
