HomeMy WebLinkAboutRES-95-5742 (VACATION/PORTION OF SUNSET DR.)`w/ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 �,�,✓ 28 RESOLUTION NO. 95-5742 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH ORDERING THE VACATION OF A PORTION OF THE RIGHT OF WAY ON SUNSET DRIVE IN THE CITY OF HERMOSA BEACH I THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH DOES HEREBY RESOLVE, FIND, DETERMINE AND ORDER THAT: SECTION 1. The City Council of the City of Hermosa Beach on May 23, 1995, adopted Resolution No. 95-5741 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH DECLARING ITS INTENTION TO VACATE A PORTION OF TBE RIGHT OF WAY ON SUNSET DRIVE IN THE CITY OF HERMOSA BEACH AND SETTING A TIME AND PLACE FOR A PUBLIC HEARING THEREON." SECTION 2. Notices of the proposed street vacation were duly published and posted in the manner and form and at the time required by Streets and Highways Code Sections 8322 and 8323. SECTION 3. The City Council of the City of Hermosa Beach held a public hearing thereon on June 13, 1995, at 7:30 p.m., in the Council Chambers at City Hall, 1315 Valley Drive, Hermosa Beach, California, at which time said Council heard all evidence offered by persons interested in said vacation. SECTION 4. Pursuant to Section 2381 of the Streets and Highways Code of the State of California the City Council finds and determines that the portion of the right of way on Sunset Drive proposed for abandonment is not useful as a motorized or non -motorized transportation facility. SECTION 5. The City Council heretofore submitted the vacation of the portion of the right of way on Sunset Drive in the City of Hermosa Beach described in Section 8 to the Planning Commission of the City of Hermosa Beach, and the Planning Commission reported that such vacation is in conformance with the General Plan of the City. 4- \1q,d 1 2 3 4 5 6 7 8 9 10 11 12 13 14 `ter' 15 16 17 18 19 20 21 22 23 24 25 26 27 ,"OF/ 28 SECTION 6. The City Council of the City of Hermosa Beach hereby finds that the proposed development for South Park eliminates the need for an extension of Sunset Drive beyond Culper Court and has created an excess right of way. The City Council therefore finds that the portion of the right of way of Sunset Drive herein vacated is unnecessary for present or prospective public use. SECTION 7. The City Council hereby determines that the public convenience and necessity require the reservation and exception from the vacation the easement and right-of-way and right at any time, or from time to time, pursuant to any existing franchise or renewals thereof, or otherwise to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires and poles and other convenient structures, equipment and fixtures for the operation of telegraphic and telephone lines and for the transportation or distribution of electric energy, and water, and for incidental purposes including access to protect such works from all hazards in, upon and over the onion of the right of wa of Sunset Drive proposed to be vacated.
