HomeMy WebLinkAboutRES-95-5757 (FEE/IMPOSING/SOURCE REDUCTION)1-fto' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 `*M✓ 28 RESOLUTION NO. 95-5757 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH IMPOSING A FEE ON RESIDENTIAL AND COMMERCIAL PREMISES FOR THE COST OF PREPARING, ADOPTING, AND IMPLEMENTING THE CITY'S SOURCE REDUCTION AND RECYCLING ELEMENT AND HOUSEHOLD HAZARDOUS WASTE ELEMENT The City Council of the City of Hermosa Beach does hereby find, order and resolve as follows: SECTION 1. Pursuant to the California Integrated Waste Management Act of 1989 (Public Resources Code Section 40000, et seq., hereinafter the "Act"), the City is obligated to prepare, adopt, and implement a Source Reduction and Recycling Element and a Household Hazardous Waste Element (collectively, the "Elements"). SECTION 2. Pursuant to Public Resources Code Section 41901, the City Council is authorized to impose a fee (the "Fee") in amounts sufficient to pay the costs of preparing, adopting, and implementing the Elements. SECTION 3. The City Council held public hearings on June 27, 1995 and July 11, 1995, at which time the Council received oral and written presentations on the Fee. For at least ten days prior to the close of the hearing, a report (the "Report") containing data indicating the cost of preparing, adopting, and implementing the Elements and the revenue sources used and anticipated to be used to prepare, adopt, and implement the Elements was made available for public review. The Report was considered by the Council at the hearing. SECTION 4. The Council hereby approves the imposition of the Fee, in the amounts set forth in Exhibit "A", attached hereto and incorporated herein by this reference, on all residential and commercial premises in the City receiving solid waste collection services on or after July 1, 1995. -1- `%No' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 5. The Fee shall be collected by the solid waste collectors in conjunction with the collection of rates for the collection of solid waste from residential and commercial premises. The obligations of the collectors imposed by this Resolution shall be a condition of any franchise agreement issued the collectors. Failure of any collector to comply with the requirements of this Resolution shall constitute grounds for termination of the collector agreement.
