RESOLUTION P.C. 96-4
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, TO RECOMMEND AMENDING THE R-1 DEVELOPMENT
STANDARDS, SECTION 4-3(12), TO MAKE THE AMOUNT OF OPEN SPACE A
PROPORTION OF LOT SIZE (10%) AND ADOPTION OF AN ENVIRONMENTAL
NEGATIVE DECLARATION.
WHEREAS, the Planning Commission held a public hearing on November 21, and
January 16, 1996 to consider amending the R-1 open space requirements, to consider the negative
declaration, and to receive oral and written testimony and made the following Findings:

The current requirements for open space are necessary to protect the public welfare as they
serve to preserve the character of residential neighborhoods and the compatibility of new
development with existing development, in addition to providing for light, air, yard space,
and avoiding the construction of box-like structures.
The current method of requiring open space, however, does not adequately recognize the
unique situations and difficulties in constructing homes that meet current market standards
for size and convenience;
Currently required open space is a minimum amount ( 400 square feet), without
consideration of lot size, while a requirement based on a proportion of lot size would
recognize the variety of lot sizes throughout the City, and allow for more flexibility of
design on smaller lots;
The Planning Commission concurs with the Staff Environmental Review Committee's
recommendation, based on their environmental assessment/initial study, that this

subject text amendments will result in a less than significant impact on the
environment, and therefore qualifies for a Negative Declaration.
NOW, THEREFORE, the Planning Commission of the City of Hermosa Beach,
California, hereby recommends that the zoning ordinance text be amended as follows:
SECTION 1. Amend Section 4-3(12) to read as follows:
"Open Space. Usable open space shall be provided on site, in a minimum amount equivalent
to ten percent (10%) of the lot size, provided that lots greater than 2500 square feet shall have
a minimum of 400 square feet. Twenty-five (25%) of the usable open space may be
provided in balconies or decks. Usable open space shall have minimum dimensions of ten
(10) feet in length and width.
Required front, and/or side yards, driveways, turning areas, and parking areas shall be
excluded from the open space computation.
