RESOLUTION 96-6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, TO DENY A REQUEST FOR VARIANCES FROM FRONT AND SIDE YARD FENCE HEIGHT REQUIREMENTS FOR CORNER LOTS AT 330 ARDMORE A VENUE (THE SE CORNER OF ARDMORE A VENUE AND FOURTH STREET) AND LEGALLY DESCRIBED AS LOTS 41, 42, AND 43 WALTER RANSOM CO'S VENABLE PLACE TRACT WHEREAS, the Planning Commission held a public hearing on January 16, 1996, to receive oral and written testimony regarding an application for the subject Variances and made the following findings: A. There are no exceptional or extraordinary circumstances relating the physical conditions of the subject property which would justify granting these variances. The subject site is located on a typical comer lot which fronts on local streets and c~ntains no unique topography, size, or other physical characteristics. B . The variances are not necessary for the preservation and enjoyment of a substantial property right possessed by other properties in the same vicinity and zone, as most other properties comply with front and comer fence height requirements where applicable. C. The granting of the Variance would be potentially be materially detrimental to the public welfare or injurious to property or improvements in the vicinity and zone in which the property is located due to the visual and aesthetic impact of 6-foot fences and walls rather than the 3- foot maximum. VOTE : NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby deny requested Variances from the side and front yard fence height requirements.
