RESOLUTION 97-51 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT, PRECISE DEVELOPMENT PLAN AMENDMENT AND PARKING PLAN AMENDMENT TO ALLOW THE INSTALLATION OF DRIVE-THRU WINDOW AT AN EXISTING COFFEE HOUSE AN EXISTING SHOPPING CENTER WITH LESS THAN REQUIRED PARKING AT 1100 PACIFIC COAST HIGHWAY, LEGALLY DESCRIBED AS SET FORTH IN THE ATTACHMENT. WHEREAS, the Planning Commission held a public hearing on September 16, 1997, to receive oral and written testimony regarding this matter and made the following findings: A. The applicant is requesting the Precise Development Plan and Parking Plan Amendment to allow the installation of a drive-thru window in conjunction with an existing 1200 square foot coffee house in an existing shopping center with less than required parking; B. The site is zoned C-3, General Commercial, and is suitable for the proposed use; C. The proposed use is compatible with surrounding commercial and residential uses; D . The imposition of Conditions as required by this Resolution will mitigate any negative impacts on nearby residential or commercial properties; E. Less than required parking is justified for this business with the drive-thru pursuant to Section 17.44.210, Parking Plans, as adequate parking is already available on­ site in the shopping center for existing and anticipated customers of the uses on­ site for the following reason : 1. The peak hours of parking demand associated with the coffee house use and proposed drive-thru window are in the mornings as compared to the afternoon and evening peaks of the grocery store, daytime peaks of the office uses, and nighttime peaks of the restaurant. 2 . The drive-thru window will be limited to usage from 6 :00 AM to 10 :30 AM daily by usage of traffic cones to temporarily redirect traffic. F. This project is Categorically Exempt: Section 1530le: Addition will not result in an increase of 50% or more of floor area. NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH DOES 1 HEREBY APPROVE A CONDITIONAL USE PERMIT ,PRECISE DEVELOPMENTPLANANDPARKINGPLANASAMENDEDTO ALLOW THE INSTALLATION OF A DRIVE-THRO WINDOW IN CONJUNCTION WITH AN EXISTING COFFEE HOUSE SUBJECT TO THE FOLLOWING CONDITIONS WIDCH SUPERSEDE THE CONDITIONS OF RESOLUTION P.C. 95-26: 1 2 3 4 5 6 7 8 9 SECTION I Specific Conditions of Approval 10 11 12 13 14 15 16 17 1. 2. 3 . 18 4 . 19 20 5. 21 22 6 . 23 24 7. 25 26 27 28 29 The project shall be substantially consistent with submitted plans. Modifications to the plan shall be reviewed and may be approved by the Community Development Director. Employees of the shopping center shall be required to park in either the 13th Street parking lot or the parking lot behind the center. The permitted use shall be limited in relation to peak hour parking demand of the various uses on the subject property. a. b. Any change of the uses which would change peak hour parking demand of the various uses located within the shopping center shall require Planning Commission review and approval Modification to the building to provide the drive-thru window shall be approved by the Building Division of the Community Development Department. Any problems with parking, or ingress and egress into the parking lot shall be cause for review of the Parking Plan by the Planning Commission A "No Right-Tum" sign shall be posted at the 13th Street exit of the northerly parking lot. The Drive-thru window shall have limited hours of operation from 6: 00 AM to 10:30 AM daily. An internally lit sign and convex mirror shall be installed adjacent to the drive­ thru window cautioning motorist of the blind intersection and on-coming traffic. The drive-thru lane shall be clearly marked in a color of paint differing from the parking stalls. A crosswalk shall be provided at the north door of the subject building. A speed bump shall be installed at the exit of the drive-thru window. The handicap stall adjacent to the ATM shall be relocated to a location reviewed and approved by the Community Development Department. If the number of vehicles chronically exceeds the capacity of the stacking lane, this permit will be subject to review by the Planning Commission. The drive-thru order speaker shall be maintained at a volume not to exceed the decibel level prohibited by the Hermosa Beach Municipal Code. SECTION II General operating and standard conditions: 2. All common parking areas shall be maintained in a neat and clean manner, and maintained free of graffiti at all times. The project and operation of the business shall comply with all applicable requirements of the Municipal Code . VOTE: A YES: Comms. Perrotti, Merl, Pizer, Schwartz, Chm.
