RESOLUTION 97-58 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A VARIANCE FROM THE LOT COVERAGE REQUIREMENT TO ALLOW A 43 SQUARE FOOT EXPANSION TO AN EXISTING NONCONFORMING DUPLEX, AND TO ALLOW SAID EXPANSION TO OCCUR WITH LESS THAN REQUIRED PARKING, AT 314 & 316 33RD STREET AND LEGALLY DESCRIBED AS LOT 26, BLOCK 118, SHAKESPEARE TRACT. WHEREAS, the Planning Commission held a public hearing on July 15, 1997, to receive oral and written testimony regarding an application for the subject Variance and consideration of expansion to a nonconforming duplex with less than required parking and made the following findings: A. The applicant is proposing a 43 square foot expansion and interior remodeling to an existing nonconforming use duplex with less than required parking, and which results in an increase in its nonconformity to lot coverage. B . There are exceptional or extraordinary circumstances as the existing structure includes a side yard alcove, with extra wide roof eaves making the expansion of floor area in this location not effect the appearance of lot coverage; C . The Variance to lot coverage is necessary for the preservation and enjoyment of a substantial property right possessed by other properties in the same vicinity and zone; D . The granting of the Variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located; E. The Variance is consistent with the General Plan. F . The existing nonconformities to be maintained are not significant or unusual in regards to compatibility with neighboring properties; G. The scale of the proposed expansion is reasonable, and is consistent with planning and zoning requirements for the R-2 zone and does not warrant requiring current nonconformities to be brought into conformance; H. Approval of the expansion/remodel is consistent with the intent and goals of Article 13 of the zoning ordinance; 1 ... , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 I. The granting of the Variance is Categorically Exempt from the requirement for an environmental assessment, pursuant to the California Environmental Quality Act Guidelines, Sections 153 05 as it involves a minor Variance, with the finding that the project does not result in any changes in land use or density. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a Variance and expansion to a nonconforming duplex, subject to the following conditions: SECTION I Specific Conditions of Approval 1. 2. 3. VOTE : The project shall be consistent with submitted plans modified pursuant to the condition noted below. Any further minor modifications to the plan shall be reviewed and may be approved by the Community Development Director. The Variance for J.ot coverage does not include the plan for extending the rear balcony. Therefore, to exclude its inclusion in lot coverage the maximum extension allowed is a 5- foot overhang, however, the balcony may be partially enclosed with the proposed "privacy screen" as shown on plans. The lot coverage Variance is specifically applicable to the situation and circumstances that result relative to the proposed limited expansion and remodeling of the existing structure, and is not applicable to the development of new structures or any future significant expansion to the existing structure.
