RESOLUTION NO. 97-54
A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA DENYING A
VARIANCE FROM MAXIMUM BUILDING
HEIGHT FOR A PROPOSED EXPANSION TO
A SINGLE-FAMILY DWELLING AT 2055

The Planning Commission of the City of Hermosa Beach does hereby resolve and order as
follows:
Section 1. An application was filed by Richard Melograno, owner of real property located at
2055 Circle Drive in the City of Hermosa Beach, seeking a Variance from the maximum building
height requirement of Section 17.08.030(A) of the Zoning Ordinance relative to a proposed expansion
of an existing single-family residence.
Section 2. The Planning Commission conducted a duly noticed de novo public hearing to
consider the application for a Variance on September 16, 1997, at which testimony and evidence, both
written and oral, was presented to and considered by the Planning Commission.
Section 3. Based on the evidence received at the public hearing, the Planning Commission
makes the following factual findings :
1. The applicant desires to expand to the second floor their residence without adhering to the
now applicable height requirement contained in the Zoning Ordinance Section17 .08.030(A), requiring
a maximum building height of 25-feet as measured from grade as determined pursuant to Section
17.04.040.
2. The proposed expansion to the south of the existing second floor would result in a building
height of 0.25 feet higher than the maximum 25 feet, and the proposed expansion on the north side of
would result in a building height 1.44 feet higher than the maximum of25-feet.
3. The subject lot is 6880 square feet and contains an existing two-story dwelling with 4,390
square feet of living area which includes 4-6 bedrooms, a detached recreation room, and a basement.
The existing structure is about 31-feet high and is nonconforming to the current height limit
requirement. The lot slopes substantially from east to west in a similar manner as adjacent properties
on the west side of Circle Drive.
Section 4. Based on the foregoing factual findings, the Planning Commission makes the
following findings pertaining to the application for a Variance from the height requirements of the
Zoning Ordinance:

1. There are no exceptional or extraordinary circumstances relating to the size, shape,
topography or location of the property to justify, or cause a need to vary from the height requirements
of the R-1 zone. The slope and terrain of the subject lot is similar with surrounding lots, and the large
size of the provides ample available room to construct an expansion within the maximum height limit..
2. The Variance is not necessary for the enjoyment of a substantial property right or privileges
possessed by other properties in the vicinity, as the applicant currently enjoys the use of a substantially
sized single-family home, consistent with similar homes in the area, and enjoys several privileges and
property rights associated with that use, including an ocean view and access to a large private yard
area. The additional rights and privileges sought by the Variance request, to expand onto the existing
structure at the second floor, can be accomplished in another manner that would be in compliance with
the height limits of the R-1 zone.
3. Pursuant to State and local law, a Variance may only be granted when, because of special
circumstances applicable to the property, including size, shape, and topography, location or
surroundings, that the strict application of the Zoning Ordinance deprives such property of privileges
enjoyed by other property in the vicinity and under identical zoning classification.. Based on the
foregoing Variance, therefore, cannot be granted.
Section 9 . Based on the foregoing, the Planning Commission hereby denies the subject
Variance.
