RESOLUTION 97-34 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING AN ALTERATION AND REMODEL TO AN EXISTING NONCONFORMING DUPLEX INVOLVING GREATER THAN 10% REMOVAL OF THE EXISTING STRUCTURE INCLUDING ELEVATING THE REAR UNIT TO PROVIDE PARKING BELOW AT 45 FOURTEENTH STREET AND LEGALLY DESCRIBED AS LOT 21, BLOCK 15, HERMOSA BEACH TRACT WHEREAS, the Planning Commission held a hearing on April 15, and May 20 1997, to consider request for alteration and remodel resulting in greater than 10% removal of the existing structure to an existing nonconforming duplex, pursuant to Chapter 17. 52 of the Zoning Ordinance and to receive oral and written testimony and made the following findings: 11 A. The applicant is proposing a 340 square foot reduction to an existing duplex, resulting in an 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 aggregate removal of 22% of existing structure while maintaining a nonconforming use; B . The existing nonconformities to be maintained are not significant or unusual in regards to compatibility with neighboring properties; C . The scale of the proposed alteration and remodel is reasonable and allows an increase in available parking for the subject property, and is consistent with planning and zoning requirements for the C-2 zone and does not warrant requiring the current nonconforming use to be brought into conformance; D. Approval of the alteration/remodel is consistent with the intent and goals of Chapter 17.52 of the Zoning Ordinance; E. The project is Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to CEQA guidelines, Section 15301 e(2) with the finding that the project is in an area with available services and not in an environmentally sensitive area. 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a greater than 10% removal of existing structure. SECTION I Specific Conditions of Approval 1. 2. 3. The project shall be consistent with submitted plans revised in. accordance with the condit ion below. Modifications to the plan which do not involve any further expansion shall be reviewed and may be approved by the Community Development Director.. The sides of the carport shall be enclosed extending to the north property line. The 14th Street elevation of the building shall be enhanced with landscaping, such as vine pockets or espaliers subject to the approval of the Community Development Director. 4. Precise height shall be reviewed at the time of plan check for building permits. 5. VOTE: This approval shall be null and void one year from the date of approval unless Building Permits have been obtained . The applicant may apply in writing for an extension of time to the Planning Commission prior to the date of expiration. AYES: NOES: ABSTAIN: ABSENT: Comms.Merl, Perrotti, Pizer, Schwartz, Chmn.
