RESOLUTION 97-44 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A VARIANCE FROM THE FRONT YARD, OPEN SPACE, LOT COVERAGE REQUIREMENTS AND TO ALLOW THREE STORIES, AND DENYING A VARIANCE REQUEST FOR THE REAR YARD AT 1635 PALM DRIVE AND LEGALLY DESCRIBED AS PORTIONS OF LOTS 3 AND 4, BLOCK 32, FIRST ADDITION TO · HERMOSA BEACH WHEREAS, the Planning Commission held a public hearing on June 17, 1997, to receive oral and written testimony regarding an application for the subject variances and made the following findings for the requested variances for front yard, open space, lot coverage, and third . story addition : A. There are exceptional or extraordinary circumstances because the unusually small lot size makes it difficult to construct an adequately sized single family residence unless the existing front yard remains and a third story addition is allowed. The unusually small lot size also precludes the applicant from conforming to the open space and lot coverage requirements without significant hardship; B. The variances for the front yard, open space, lot coverage, and third story addition are necessary for the preservation and enjoyment of a substantial property right possessed by other properties in the same vicinity and zone; C. The granting of the variances from the front yard, open space, and lot coverage requirements, and allowing a third story addition will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located; D. The variances are consistent with the General Plan. E . The granting of the variances is Categorically Exempt from the requirement for an environmental assessment, pursuant to the California Environmental Quality Act 1 , . .. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 Guidelines, Sections 15305 as it involves minor variances for yard, open space, lot coverage, and third story addition (while conforming to the height limit), with the finding that the project does not result in any changes in land use or density. WHEREAS, the Planning Commission made the following findings for the requested rear yard vanance; A There are no exceptional or extraordinary circumstances because the required rear yard will not preclude the construction of an adequately sized single family residence; B. The variance to extend into the rear yard is not necessary for the preservation and enjoyment of a substantial property right possessed by other properties in the same vicinity and zone; C. The granting of the variance from the rear yard setback may potentially be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a Variance to the front/alley yard requirements, open space, lot coverage, and to allow three stories, and does hereby deny the requested Variance for the rear yard, subject to the following conditions: SECTION I Specific Conditions of Approval I. The project shall pe consistent with submitted plans modified pursuant to the conditions noted below. Any further minor modifications to the plan shall be reviewed and may be approved by the Community Development Director. 2. No separate access to a ground floor bedroom/bonus room shall be allowed. 3. The bathroom on the ground floor shall be revised to be a maximum 3/4 bath (i.e. shall not include any more than a toilet, sink, and shower). VOTE : AYES: NOES: ABSENT: ABSTAIN : Corn.ms.
