RESOLUTION 97-48 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A VARIANCE FROM PARKJNG (SECTIONS 17.44.090(E) AND 17.44.140) AND REAR YARD (SECTION 17.16.0S0(B)) REQUIREMENTS TO ALLOW THE EXPANSION AND REMODEL OF A SINGLE FAMILY RESIDENCE TO CONNECT TO AN EXISTING ONE-CAR DETACHED GARAGE, AND TO DENY A VARIANCE REQUEST FOR OPEN PARKING IN THE FRONT YARD AT 439 8TH STREET AND LEGALLY DESCRIBED AS THE EASTERLY 40 FEET OF LOT 10, BLOCK B, TRACT NUMBER 1677 WHEREAS, the Planning Commission held a public hearing on July 15, 1997, to receive oral and written testimony regarding an application for the subject Variances and made the following findings for the requested Variances from parking and rear yard requirements: A There are exceptional or extraordinruy circumstances because the unusually small lot size makes it difficult to construct an adequately sized addition to the existing single family residence unless the addition is allowed to be constructed with only one on-site parking space and a reduced rear yard where the garage will be enlarged to make said parking space conform to required parking space size; B. The Variances from the parking and rear yard requirements are necessruy for the preservation and enjoyment of a substantial property right possessed by other properties in the same vicinity and zone; C. The granting of the Variances from the parking and rear yard requirements will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located; D. The Variances are consistent with the General Plan; E. The granting of the Variances is Categorically Exempt from the requirement for an environmental assessment, pursuant to the California Environmental Quality Act Guidelines, Sections 15305 as it involves minor Variances for yard, open space, lot coverage, and third story addition (while conforming to the height limit), with the finding that the project does not result in any changes in land use or density. 2 6 WHEREAS, the Planning Commission made the following findings for the requested open parking 2 7 Variance: 28 29 A. There are no exceptional or extraordinruy circumstances because the lack of open parking will not preclude the construction of an adequately sized addition to the existing single family residence; 1 ,, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 B. The Variance for open parking is not necessary for the preservation and enjoyment of a substantial property right possessed by other properties in the same vicinity and zone; C. The granting of the Variance for open parking may potentially be materially detrimental to the public welfare by causing a potential traffic problem on 8th Street; D. The lack of required open space caused by the proposed open parking may be injurious to the property or improvements in such vicinity and zone in which the property is located; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a Variance from parking and rear yard requirements to allow the remodel and expansion of an existing two­ story nonconforming single family residence to connect to an existing one-car detached garage, and to deny the requested Variance for open parking, subject to the following conditions: SECTION I Specific Conditions of Approval 1. The project shall be consistent with submitted plans except the open parking space shall be omitted. Any further minor modifications to the plan shall be rev iewed and may be approved by the Community Development Director. 15 VOTE : AYES: Comms. Perrotti, Pizer, Chmn.
