P.C. RESOLUTION 97-49
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT, PRECISE
DEVELOPMENT PLAN, AND VESTING TENTATIVE PARCEL MAP #24838 FOR A
FOUR (4) UNIT CONDOMINIUM PROJECT, AT 937 FIRST STREET AND LEGALLY
DESCRIBED AS LOT 37, TRAFTON HEIGHTS TRACT
WHEREAS, the Planning Commission held a public hearing on July 15, 1997, to consider
a proposed four-unit condominium project and to receive oral and written testimony and made the
following findings:
A. The map is consistent with applicable general and specific plans;
B. The site is zoned R-P and is physically suitable for the type and density of proposed
development;
C. The subdivision or type of improvements are not likely to cause serious public health problems;
D. The subdivision or type of improvements will not conflict with easements, acquired by the
public at large, for access through or use of property within the proposed subdivision;
E. Design of the proposed subdivision is compatible and consistent with applicable elements of
the City's General Plan, and is compatible with the immediate environment;
F . The project will conform to all zoning and condominium criteria and will be compatible with
neighboring residential properties
G. The proposed use of an average side yard calculation for complying with the increased side yard
requirement for multiple or row dwellings that front on a side yard (Section 17.46.150) is
acceptable since the indirect orientation and access to the units from the side yard allow a
flexible interpretation of that section;
H. The project is Categorically Exempt from the requirement for an environmental
assessment, pursuant to the California Environmental Quality Act Guidelines, Sections
l 5303(b) and 15315 with the finding that the project is in an area with available services .

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Hermosa Beach, California does hereby approve a Conditional Use Permit, Precise
Development Plan, and Vesting Tentative Parcel Map #24838, subject to the following
conditions of approval:

The development and continued use of the property shall be in conformance with the plan
submitted for review by the Planning Commission at the July 15, 1997 meeting revised in
accordance with the conditions below. Any minor modification shall be reviewed and may
be approved by the Community Development Director.

The proposed common open space deck area, located above the guest parking
space below, shall be revised to completely cover said parking.
Dimensions and turning area the guest parking space located between the building
shall be verified as satisfactory by a traffic engineer, or corrected as needed, and is
subject to the final approval of the Community Development Director based on
standards of the industry.
The permittee shall verify that adequate trash storage capacity is provided for all
four units in a common enclosed location based on standards of the local trash
hauler, with final capacity and location to be approved by the Community
Development Director.
The project shall meet all requirements of the Condominium Ordinance.
a) Adequate private storage areas, and enclosed areas for trash shall be provided for both
units in compliance with the condominium requirement and shown on plans prior to the
issuance of building permits.
b) Covenants, Conditions, and Restrictions in compliance with the Condominium
Ordinance shall be submitted to the Community Development Department for review
and approval prior to the issuance of building permits.
c) Proof of recordation of approved CC & R's shall be submitted to the Community
Development Director six (6) months after recordation of the Final Map
d) Requirements of Section 17.22 .060(G) shall be shown on structural plans and review at
the time of Building Division plan check
There shall be compliance with all requirements of the Public Works Department and Fire
Department.
Two copies of a final landscaping plan indicating size, type, and quantity of plant materials
(including trunk diameter at planting time) to be planted and/or showing existing landscaping to
be maintained shall be submitted to the Community Development Department, Planning
Division for review and approval prior to the issuance of Building Permits.
a) An automatic landscape sprinkler system shall be provided, and shall be shown on
plans . (building permits are required)
b) Landscape plans shall include details for landscaping the parkway to match landscaping
for the parkway west of the site, subject to the approval of the Community
Development Director.

1 5. Architectural treatment shall be as shown on building elevations and site and floor plans
subject to review and approval by the Community Development Director and shall include
additional building articulation such as projections or texture added to the east elevation . 2

a) Precise building height shall be reviewed at the time of plan check, to the satisfaction
of the Community Development Director.
Any satellite dish antennas and/or similar equipment shall comply with the requirements of
Section 17.46.240 of the Zoning Ordinance .
7. Conduit shall be installed in each unit for cable television.
8. Roll-up Automatic garage doors shall be installed and shown on plans.

This grant shall not be effective for any purposes until the permittee has filed with the
office of the Planning Division of the Community Development Department an affidavit
stating that they are aware of, and agree to accept, all of the conditions of this grant.
The address of each condominium unit shall be conspicuously displayed on the front street
side of the building with externally or internally lit numbers and the method for illumination
shall be shown on plans.
Two copies of final construction plans, including site, elevation and floor plans, which are
consistent with the conditions of approval of this conditional use permit, shall be reviewed
and approved by the Planning Division for consistency with Planning Commission
approved plans prior to the issuance of building permits.
The Conditional Use Permit, and Precise Development Plan, shall be null and void eighteen
months from the date of approval unless building permits have been obtained, and approval
of the Vesting Tentative Parcel Map shall become null and void twenty-four months from
the date of approval unless the map is finaled and the project implemented. The applicant
may apply in writing for an extension of time to the Planning Commission prior to the dates
of expiration.
