HomeMy WebLinkAboutPC Resolution 97-022 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 RESOLUTION P.C 97-2 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING AN AMORTIZED CONDITIONAL USE PERMIT FOR AN EXISTING WOOD, MACHINE, AND PLASTIC MANUFACTURING SHOP, AND A CABINET SHOP, LOCATED AT 436 ARDMORE A VE. LEGALLY DESCRIBED AS LOTS 10 & 11, WALTER RANSON CO'S VENABLE PLACE. WHEREAS, the Planning Commission held a public hearing on January 21, 1997, to receive oral and written testimony regarding the matter and made the following findings: A The applicant is requesting a Conditional Use Permit for an existing wood, plastic, and machine shop, and cabinet shop B. C. The development, as conditioned, mitigates the potential threat to the public safety and welfare to the maximum possible; This project is Categorically Exempt pursuant to Section 15303c of the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California, does hereby approve a Conditional Use Permit to allow a wood, plastic and machine shop, and a cabinet shop subject to the following: SECTION I (CONDITIONS OF APPROVAL) 1. All work activities shall be conducted inside the buildings, and all outdoor work activities shall be prohibited. -1- 1 2 . Storage of vehicles, including trucks, tractors, trailers, recreational vehicles, 2 automobiles, equipment and/or miscellaneous storage in the outdoor parking areas shall be 3 prohibited . 4 5 3 . The exterior of the premises including the parking areas shall be maintained in a neat and 6 clean manner at all times. 7 8 4. Disposal of hazardous waste material shall be in accordance with local, state, and federal 9 laws, and in no event shall such waste material be allowed to drain into the City storm drain 10 system pursuant to Chapter 8.44 of the Hermosa Beach Municipal Code . 11 12 5 . There shall be no bells, buzzers or similar apparatus audible outdoors; outside speakers 13 for any purpose shall be prohibited. 14 15 6 Noise emanating from the property shall be within the limitations prescribed by the City's 16 Noise Ordinance, Article 19 .5 of the Hermosa Beach Municipal Code, and shall not create a 11 nuisance to surrounding properties. 18 19 7 . The operation of the businesses shall be in compliance with all applicable Municipal Codes . 20 21 8. All application of paints and/or finishes shall be in conformance with the Fire Code and 22 subject to approval by both the Fire Department and the South Coast Air Quality Management 23 District (SCAQMD). 24 25 9. Only low volatile organic compound emission resins, :finishes or chemical coating 26 systems, in conformance with SCAQMD requirements, shall be used on the premises . 27 28 10 . A dust collection system shall be provided at all times within the buildings and shall be 29 effective in eliminating the dust generation occurring from sanding and buffing and utilized at all times when the potential for dust generation occurs . No dust shall escape from the premises. -2- 2 11. The hours of operation shall be limited to between 7:00 AM. and 7:00 P.M. Daily. 3 Community Development Director may grant additional hours, if not considered a nuisance to 4 the neighbors . 5 6 SECTIONII 7 8 This grant shall not be effective for any purposes until the permittee and the owners of the 9 property involved have filed a the office of the Planning Division of the Community Development 10 Department their affidavits stating that they are aware of, and agree to accept, all of the 11 conditions of this grant. 12 13 The Conditional Use Permit shall be recorded, and proof of recordation shall be submitted to the 14 Community Development Department. 15 16 Each of the above conditions is separately enforced, and if one of the conditions of approval is 17 found to be invalid by a court oflaw, all the other conditions shall remain valid and enforceable . 18 19 Permittee shall defend, indemnify and hold harmless the City, it agents, officers, and employees 20 from any claim, action, or proceeding against the City or its agents, officers, or employee to 21 attack, set aside, void or annul this permit approval, which action is brought within the applicable 22 time period of Government Code Section 65907. The City shall promptly notify the permittee of 23 any claim, action, or proceeding and the City shall cooperate fully in the defense. If the City fails 24 to promptly notify the permittee of any claim, action or proceeding, or if the City fails to 25 cooperate fully in the defense, the permittee shall no thereafter be responsible to defend, 26 indemnify, or hold harmless the City. 27 28 The permittee shall reimburse the City for any court and attorney's fees which the City may be 29 required to pay as a result of any claim or action brought against the City because of this grant. Although the permittee is the real party in interest in an action, the City may, at its sole -3- discretion, participate at its own expense in the defense of the action, but such participation shall 2 not relieve the permittee of any obligation under this condition. 3 The subject property shall be developed, maintained and operated in full compliance with the 4 conditions of this grant and any law, statute, ordinance or other regulation applicable to any 5 development or activity on the subject property. Failure of the permittee to cease any 6 development or activity not in full compliance shall be a violation of these conditions. 7 The Planning Commission may review this Conditional Use Permit and may amend the subject 8 conditions or impose any new conditions if deemed necessary to mitigate detrimental effects on 9 the neighborhood resulting from the subject use. 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 VOTE : AYES: NOES: ABSENT: ABSTAIN: CO:MMS.
