RESOLUTION 97-19 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITTONAL USE PERMIT, AND PRECISE DEVELOPMENT PLAN WITH A MINOR AMENDMENT, FOR A TWO-UNIT CONDOMINIUM PROJECT, AND VESTING PARCEL MAP 24632 AT 928 17TH ST., LEGALLY DESCRIBED AS LOT 18 J.M. FLOORES TRACT. WHEREAS, the Planning Commission held a public hearing on March 4, 1997 to consider a miner amendment to the conditions of approval for a proposed two-unit condominium project and to receive oral and written testimony and made the following findings: A The site is zoned R-2B and is physically suitable for the type and density of proposed development; 11 B. The project will conform to all zoning and condominium criteria and will be compatible 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 with neighboring residential properties; C. The proposed location of the balcony will not significantly alter the privacy of the neighboring residents to the south. D . The subject project is Categorically Exempt under Section 15303, Class 3(b) New Construction or Conversion Of Small Structures, of the California Environmental Quality Act Guidelines. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a minor amendment to a Conditional Use Permit, Precise Development Plan, and Vesting Tentative Parcel Map 24632 subject to the following conditions of approval (This resolution supersedes Resolution 96-44): 1. The development and continued use of the property shall be in conformance with submitted plans, and the following conditions : (Any minor modification shall be reviewed and may be approved by the Community Development Director.) . a) b) c) The downstairs bathroom in the rear unit shall be a maximum of 3/4 baths, and the wet-bar shall have a maximum of 6 sq. ft. of counter space and 24 cubic feet of cupboard space. Trash storage area shall be located in the garage for each unit. Maximum height of the rear retaining wall shall be 6 ft. and fencing above said wall shall not exceed 42 inches in height and shall be 60% open. 1 d) e) The rear balcony shall be relocated from the dining room to the southwest comer, and shall have a maximum width of 10 ft. and maximum depth of 7 ft . Revised site plan shall be submitted showing conformance with the Zoning Ordinance Open Space requirements for the rear unit. 1 2 3 4 5 6 7 8 9 2 . The project shall meet all requirements of the Condominium Ordinance. 10 11 3. 12 4. 5 . a) b) c) Covenants, Conditions, and Restrictions in compliance with the Condominium Ordinance shall be submitted to the Community Development Department for review and approval prior to the issuance of building permits. Proof ofrecordation of approved CC & R's shall be submitted to the Community Development Director six (6) months after recordation of the Final Map Requirements of Section 7.2-6(G) shall be shown on structural plans and reviewed at the time of Building Division plan check There shall be compliance with all requirements of the Public Works Department and Fire Department. Landscaping areas shall be in substantial compliance with the submitted plan. a) b) An automatic landscape sprinkler system shall be provided. A landscape plan identifying the size, type, and quantity oflandscape materials including mature landscaping to screen neighboring property to the south and southeast shall be submitted for review and approval by the Community Development Director. Precise building height shall be reviewed at the time of plan check, to the satisfaction of the Community Development Director. a) Any satellite dish antennas and/or similar equipment shall comply with the requirements of Section 1227 of the Zoning Ordinance. 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 6. Conduit shall be installed in each unit for cable television. 7. 8. The address of each condominium unit shall be conspicuously displayed on the front street side of the building with externally or internally lit numbers and the method for illumination shall be shown on plans. Two copies of final construction plans, including site, elevation and floor plans, which are consistent with the conditions of approval of this conditional use permit, shall be reviewed and approved by the Planning Division for consistency with Planning Commission Resolution and approved plans prior to the issuance of building permits. 2 1 2 3 4 5 10 . 11. An acceptance of conditions form shall be executed by the current property owner and submitted to the Planning Division prior to the issuance of building permits . The Conditional Use Permits, Precise Development Plans, shall be null and void eighteen months from the date of approval unless building permits have been obtained, and the Vesting Tentative Parcel Map shall become null and void 2 years from the date of approval unless the map is finaled and the project implemented. The applicant may apply in writing for an extension of time to the Planning Commission prior to the dates of expiration. 6 VOTE : 7 AYES: NOES: ABSTAIN: Comms. Merl, Perrotti, Pizer, Schwartz, Chmn.
