REPORT REGARDING IMPLEMENTATION
OF HEARING OFFICER FISHMAN'S
RECOMMENDATIONS
Attached is a memo from Field Supervisor Blackwood outlining
the items, in Hearing Officer Fishman's report, which were
immediately implemented. In addition, the General Services
Officers have been advised to make appropriate notations on
their citations in order to alert the Hearing Officers of any
special circumstances, etc. I am pleased to advise you that
the report was well received by staff and a spirit of cooperation
is prevalent.
Also attached is our draft for the brochure Ellen suggested. We
would welcome your comments. In addition feel free to submit any
corrections, changes in context that would offer more clarity
or brevity, and suggestions that you might feel would insure
a well-received brochure.

SUBJECT. Hearing Officer ReportFROM: R.A. Blackwood, Fld. Super-.
Attached is a report from Ellan Fishman regarding her experience
and perceptions as the Hearing Officer during Hal Halter's conva-
lescence.
I believe that this report will aid each Officer in better under-
standing the process and philosophy of the Hearing Officer posi-
tion.
Of particular importance to me are Ms. Fishman's comments concer-
ning the issuance of citations in situations where either, "the
sign was down" or "red line was obscured" or the placement of the
sign was too distant from the location of the violation. In each
of these cases a citation should not be issued�'but an "Attention
Public Works" should be completed and submitted to correct the
situation.
It is incumbent upon each Officer not to 'assume' the existence
of proper sign posting or clearness of painted curbs but, to con-
tinually observe that signs and curb paint are properly visible.
In addition, Officers should rote Ms. Fishman's comments about
"Alley"cita T' "
tions. _ m aware that it is one of our major Peeves
that as soon as a Cushman approaches a vehicle in a red lined
alley the RO suddenly appears and states "I was just mcvinc,".
Again, it is incumbent upon us to temper our cynicism in this
situation to assure that we alloy,: for actual "loading and un-
loading" in the alleys.
Also, whenever at all possible, an excact address indicating the
location of the violation should be entered on the citaticn.
I hope that all Officers understand that the ITear"ing Officer
process acts as a safety pressure valve in alloy.=in.c the citizens
of this community to experience our bureaucracy as being willing
and available to hear and act upon their_ complaints anc? concerns.

METERED PARKING
Parking meters are enforced twenty four (24) hours a day, seven
days a week. Parking is not permitted at the meters during the
hours posted "no parking" for the purpose of street cleaning and
other public works projects. California Vehicle Code 22508.
Exception: (a) In commercial areas, where appropriate signs are
posted, metered parking is not enforced between the hours of
6 P.M. in the evening and 2 A.M. in the morning.
(b) Residents and employees of the impacted l/ area may
purchase annual permits to park at yellow posted2/meters, without
having to pay the meters, except during the hours posted "no parking"
and not to exceed seventy two (72) hours at one location. The general
public may purchase daily permits, for a fee of $5.00 per day, to
park at the yellow posted meters. This permit allows for one day
the same privilege afforded by the annual resident permit. Hermosa
Beach 'Municipal Code 19-100.

TIME LIMIT PARKING
In both commercial and residential areas, there are parking places
governed by signs indicating either one or two hour parking. This

CURB MARKINGS
RED ZONE: No stopping, standing or parking at any time, except that
a bus may stop in a red zone marked or signed as a bus zone.
Hermosa Beach Municipal Code 19-88.
YELLOW ZONE: This is a loading zone. Vehicles with commercial
license plates may park for twenty (20) minutes for the purpose
of loading or unloading materials. All other vehicles are allowed
three (3) minutes only, for the purpose of loading or unloading
passengers. These zones are enforced between 7:00 A.M. and 6:00 P.M.
excepting Sundays and Holidays. Hermosa Beach Municipal Code 19-88
WHITE ZONE: Also a loading zone for passenger loading and unloading
or for the purpose of depositing mail in an adjacent mail box.
Normal allowable parking time is three (3) minutes when designated
as passenger loac,ing. Zones are enforced between 7:00 A.M. and
6:00 P.M. excepting Sundays and Holidays. If the zone is in front
of a hotel or mail box, restrictions apply at all times. If the zone
is adjacent to a theater, the restrictions apply when the theater is
open.
GREEN ZONE: No standing or parking for a period of time longer than
fifteen (15) minutes at any time between 7:00 A.M. and 6:00 P.M.
on any day. Hermosa Beach Municipal Code 19-76.
BOO`T'ING AND IMPOUNDING PROGRAM
The California Vehicle Code, Section 22651 (i) provides that out-
of-state vehicles and California vahicles, that are not currently
registered, may be impounded if they have five or more outstanding
parking citations. The City of Hermosa Beach vigorously e:zforces
this provision of the law.
In most cases, a wheel -locking device, commonly known as the
"Denver Boot" i:; placed on the vehicle for a period, not to exceed
seventy two (72) hours. This method of impoundment gives the owner
of the vehicle an opportunity to either pay the citations or post
bail and arrange a court date, it also affords the time to register
the vehicle. Since both must be accomplished before the vehicle
can be released, booting the vehicle for seventy two hours saves
the owner the additional expense of towing charges and impound
fees. A vehicle will be immediately impounded if the "boot" will
not fit on the wheels of the vehicle or if the vehicle is parked
hazardously ie. in a red zone. If your vehicle is booted or
towed, you may make arrangements for release o* the vehicle in
the General Services Department, in the basement of City Hall,
1315 Valley Drive.
In the event, you wish to contest the impounding of your vehicle,
you are entitled to a "Post Storage" hearing under California
Vehicle Code, Section 22852. You must request the hearing in
person, writing or telephone within ten days of the date appearing
on your notice of impound. Hearings are conducted by the Hermosa
Beach Police Department and will be held within forty—eight hours
of the request, excluding weekends and holidays. If it is det-
ermined in the hearing that probable cause for the storage cannot
be established, the City shall be responsible for towing and storage
charges.
PARKING PEIRIIIT AND SHUTTLE. BUS PROGRAMS
Due to the diversified makeup of Hermosa's beachfront which combines
commercial, residential and recreational uses, parking is at a
premium. As previously stated, our excellent beaches often attract
up to 100,000 visitors on weekends and holidays. The area most
severely plagued with parking problems and congestion are,
naturally, those streets closest to the beach. The City has
declared this area "impacted" and has provided a comprehensive
program to relieve the situation. The boundaries of the "impacted"
area are, the Strand on the west, Loma/Morningside Drives on the
east, and the City boundaries on the north and south. The purpose
of this program is to reallocate the parking demand from an area
where it cannot be met to an area where it can be met.
Annual permits allow residents and employees of the impacted area,
including the yellow posted meters, to park in the area with
minimal restriction. Residents may purchase a permit for each
vehicle that is registered to their home address and may also
purchase one transferable guest permit per household. The price
of the permits is $10.00, current proof of residence and current
vehicle registration must be shown at the time of purchase. People
who are employed in the impacted area may purchase an annual permit
for $10.00 upon proof of employment at a business located in the
area. The only exception to permit parking is during those hours
posted "no parking" or when a vehicle has been parked in the same
location in excess of seventy-two hours.
Non-residents have the option of buying*a daily permit for $5.00,
paying the meters_,or parking in one of several remote public
parking lots and taking the shuttle bus to the beach.
Enforcement in the impacted area is based on seasonal demand.
The metered section of the "impacted" area, which are the streets
within two blocks of the beach, are enforced year-round. The
streets that are posted "one hour parking" are only enforced
from May 15th through September 15th. The shuttle bus only
operates between May 15th and September 15th since there is free
parking during the rest of the year, two blocks from the beach.

1984-85 HERMOSA BEACH LIGHTING DISTRICT
Recommendation:
It is recommended that the City Council adopt the attached
resolution which enacts the Hermosa Beach Street Lighting
District for 1984-85. This action would result in no increase
in the assessed rates to the Hermosa Beach property owner -and
maintain the 1983-84 assessment levels.
Background:
As required, the necessary steps have been taken in the
preparation of the public hearing set for May 22, 1984
for the adoption of the City's Underground Lighting District.
These steps have been as follows:
1) April 17 - City Council adopts Resolution 84-4702
ordering the report for the renewal of the district.
2) April 18 - City staff meets with Lighting Assessment
Engineer for development of budget.
3) May 1 - Assessment Engineer files report consisting
of estimate of costs, maps, and assessment rolls.
4) May 9
a) City Council adopts Resolution 84-4707 approving
report.
b) City Council adopts Resolution of Intention,
84-4708 which sets the date of the public hear-
ing for May 22, 1984.
Having completed the aforementioned items, the Council is
ready, should it choose, for enactment of the 1984-85 Hermosa
Beach Lighting District following the public hearing. If
the district is approved, the assessment rolls on magnetic
tape will be delivered to the Los Angeles County auditor's
office on or about May 25, 1984.
Analysis:
The adoption of the attached resolution provides the funds
necessary to sustain the City's Street Lighting District.

WHEREAS, in proceedings under the "Landscaping and Lighting
Act of 1972" (commencing with Section 22500, Streets and Highways
Code), the City Council adopted Resolution No. 84-4702 ordering
the Director of Public Works to prepare and file the report
required by said Act for the proposed levy of an annual assess-
ment for the fiscal year commencing July 1, 1984, and pursuant.
thereto such report has been prepared and filed with the City
Clerk; and
WHEREAS, the City Council adopted its Resolution No. 84--
084 approving the report as filed pursuant to Resolution No.
702, ordering said report; and
WHEREAS, the City Council adopted its Resolution of
Intention No. 84-4708 declaring its intention to order certain
street lighting fixtures and appurtenances to be installed,
maintained and electric current to be furnished for lighting said
fixtures for the fiscal year beginning July 1, 1984 and
appointing a time and place for hearing protests relative
thereto; and
WHEREAS, the hearing was duly held at the time and place
fixed therefor and all interested persons desiring to hear and be
heard, either orally or in writing, were afforded the opportunity
to hear and be heard on the report of the Director of Public
Works, the Diagram and Assessment contained therein, or in any
way relating to the report and the proceedings;

o The City's first public relations effort re. animal
control, a citywide pet show, was held last Saturday.
It was a very good first time event, was videoed and
will be re -run on Channel 10 on May 30 and June 6.
o The boatyard project, "The Mooring" has drawn its
final permits. Active construction will be visible
later this month.
o Demolition of the "Thompson Property" should commence
about May 21 with the formal ground breaking set for
4 p.m., May 23rd.
o The Hermosa Beach_Community.:Center Theatre'has'been
designated::as.-a 1984 Los Angeles Conservancy Preserva-
tion Awardee. Each year six awards are presented to
recognize and honor outstanding contributions to the
field of historic preservation through restoration,
rehabilitation and renovation.
o Arrangements have been with the California Conserva-
tion Corps to assist in a landscaping project on
Gould Avenue. Work sill start in a few weeks.

Recommendation:
It is recommended that the City Council adopt the two attached
resolutions.
The resolution labeled #1 approves the report of the City
Engineer prepared by the City's Lighting Assessment Engineer.
Said report covers matters relating to the proposed Lighting
District and sets the assessment.
The adoption of the resolution labeled.#2, provides for the
setting of a public hearing for Mav 22, 1984 to accept public
input into the matter of the proposed Lighting District.
Background:
As per City Council Resolution #84-4702, adopted at the
regularly scheduled City Council meeting of April 17, 1984,
the two attached proposed resolutions have been prepared.
This follows in sequence with the schedule that was set
forth in the April 6, 1984 Recommendation to the City Council.
Analysis:
The adoption of these two resolutions primarily serve to:
1) Approve the City Engineer's report regarding the
Lighting District which is prepared in conjunction
with the Lighting Assessment Engineer and,
2) Set the date of the public hearing.
At the conclusion of the public hearing on May 22, 1984,
the City Council will be provided with a resolution which it
may adopt concerning the Assessment District.

It should be noted that with the exception of two changes,
the assessment rates remain the same as the 1983-84 Lighting
District. These two changes are: 1) the condominium con-
versions located at the corner of 16th Street and Ardmore
and 2) the properties adjacent to Ardmore Avenue north of
Gould. The change in rate to the latter is due to the fact
that street lighting did not previously exist at this loca-
tion. With the completion of a project to install light
standards and luminaires along this portion of roadway, the
assessment was revised to reflect the typical residential
assessment where street lights exist.
Should there be any questions regarding these matters, your
staff and also Mr. Patrick Rossetti, the City's Lighting
Assessment Engineer will be present.

REPORT OF THE DIRECTOR OF PUBLIC WORKS OF SAID
CITY MADE PURSUANT TO THE REQUIREMENTS OF

WHEREAS, the City Council of the City of Hermosa Beach,
California, did in Resolution No. _84-4702 , adopted
April 17, 1984 , pursuant to the provisions of the
"Landscaping and Lighting Act of 1972", of the State of
California (Part 2 of Division 15, Section 22500, et seq. of the
Streets and Highways Code of said State), require the Director of
Public Works to make and file with the Clerk of the City Council
a report in writing, presenting certain matters relating to the
proposed installation of certain street lighting fixtures and
appurtenances and the proposed maintenance thereof, including the
maintenace of all fixtures and appurtenances throughout the City,
as contemplated under the provisions of said "Landscaping and
Lighting Act of 1972"; and
WHEREAS, said Director of Public Works, pursuant to the
requireemnts of said City Council as expressed in Resolution No.
84-4702 and of said law, did make and on the _s_ day of

is ex -officio Clerk of the City Council) of said City, his report
in writing responsive to the requirements of said Resolution No.

THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DOES

SECTION 1. That the public interest and convenience require, and
that it is the intention of the City Council of the City of
Hermosa Beach, California, to order certain street lighting
fixtures and appurtenances, all as shown on DIAGRAM and PLAN NO.
1984-85 and SPECIFICATIONS NO. 1984-85 , on file in the office
of the City Clerk, to be installed and maintained; and that
electric current be furnished for street lighting fixtures and
appurtenances throughout the City for the fiscal year beginning
July 1, 1984 through June 30, 1985.
All of the work and improvement above specified shall be done in
accordance with the specifications and plans therefor referred to
in the report of the City Manager dated May 1, 1984 , on file
in the office of the City Clerk and which is hereby referred to
and by this reference incorporated herein and made a part hereof.
SECTION 2. To expedite the making of said improvement, the City
Council may at any time transfer into the Hermosa Beach Street
Lighting District No. 1984-85 Fund, out of any money in the
General Fund, such sums as it shall deem necessary, and the sums
so transferred shall be deemed a loan to such Fund, and shall be
repaid out of the proceeds of the assessments provided for in
this resolution, anO pursuant to the provisions of Section 22657,
California Streets and Highways Code, "Landscaping and Lighting
Act of 1972", referred to herein.
SECTION 3. That said contemplated work and improvement, in the
opinion of the City Council, is of more than local or ordinary
benefit, and said Council hereby makes the expense of said work
and improvement chargeable upon a district, which district said
Council hereby declares to be the district benefited by said work
and improvement, and to be assessed to pay the cost of expenses
thereof. Said district is all of that portion of the City of
Hermosa Beach as shown on DIAGRAM and PLAN NO. 1984-85 , on file
in the office of the City Clerk, on which exterior boundaries
thereof are described as the boundary lines of the said City,
excepting from said district any portion of any public street or
alley which may be included therein. Reference is hereby made to
said DIAGRAM and PLAN for a complete and detailed description of
said district. The said DIAGRAM and PLAN so on file shall govern
for all details as to the extent of said assessment district.

SECTION 4. Any lots or parcels of land known as public property,
as the same is defined in Section 22663, Part 2, Division 15,
Streets and Highways Code, ("Landscaping and Lighting Act of
1972"), hereinafter refgerred to, which are included in the said
assessment district, shall be omitted and exempt from the
assessment to be made to cover the costs and expenses of said
contemplated improvement.
SECTION 5. The improvement contemplated by this Resolution of
Intention shall be done under the provisions of the "Landscaping
and Lighting Act of 1972", (now Part 2 of Division 15, Section
22500 et seq. of the Streets and Highways Code of the State of
California).
' SECTION 6. That Tuesday, the 22nd day of May
at the
hour of 7:30 o'clock P.M. of said day be and the same is hereby
appointed as the time, and the Council Chamber in the City of
Hermosa Beach, California, is hereby appointed as the place for

The total revenue received during the sixteen day amnesty
program was $41,542.00. This figure represents an average
of $2;596.00 per day. The daily average for the months of
February and March 1984 was $1:867.00. Tine daily average
difference was $729.00 for a total revenue increase over
the sixteen day period of $11,664.00. There was an absolute
flurry during the last two days of the program, $5,954.00 was
taken in on Friday, April 27th and $6,756.00 on Monday the
30th.
I believe the program proved moderately successful however,
I don't believe it met our expectations. We still have
outstanding citations estimated at approximately $500,000.00.
We shall continue to pursue legislative changes that will
enable us to tighten up the loopholes and prevent continued
loss of revenue. (See attached from Assemblyman Felando)

Thank you for giving me the opportunity to participate in your
"parking citation support group." The meeting I attended was
informative and confirmed my understanding that the cities'
inability to collect bail on parking tickets is an extremely
complex problem.
A major factor you should be aware of is that the cities'
collection problem involves several different entities, including
the Department of Motor Vehicles (DMV), local law enforcement
agencies and the court system. The DMV is the state agency
charged with the tasks of, among other things, protecting the
public interest in vehicle and vessel ownership, providing
various revenue collection services for state and local agencies
and providing other registration -related services (including the
collection of revenue from unpaid parking violation fees) through
the vehicle and vessel registration and titling process.
In pursuance of these objectives our office has been advised that
the DMV is currently in the process of implementing a number of
internal procedures to address the cities' collection problem,
with particular emphasis on the transfer of ownership issue. I
have asked Mr. George Meese, Director of the Department of Motor
Vehicles, to describe the nature of these internal procedures to
me (see attached letter). Hopefully, the DMV's efforts will be
successful, and in the event that more complex legislative
restructuring of the entire statutory scheme is required, I would
be more than willing to sponsor the necessary legislation.

Our State Capitol office reviewed the feasibility of the
support group's recommendations with staff members of the
Assembly Committee on Transportation and the Department of Motor
Vehicles. I have also asked Mr. Meese to review and comment on
the recommendation that the license plate be issued to the owner
of the vehicle rather than to the vehicle itself as under
existing law.
You can be assured that our office will carefully evaluate the
situation on the basis of the forthcoming information from the
DMV. In the meantime, if I can be of assistance to you in the

Dear Mr. Meese:
As you are no doubt aware, the problem of the cities' inability
to collect bail on parking tickets is costing the cities
substantial amounts of additional revenue. On a statewide basis,
the financial implications are enormous. The purpose.of this
letter is to seek assistance of the Department of Motor Vehicles
(DMV) in formulating a solution to the problem.
Our office was contacted by the City of Hermosa Beach in regard
to its inability to collect unpaid bail for parking violations.
But the problem is certainly not unique to the City of Hermosa
Beach. In fact, an informal "parking citation support group" has
been formed in my district to address this issue. The support
group includes the cities of Rancho Palos Verdes, Torrance,
Lomita, Inglewood, Redondo Beach, Long Beach, Manhattan Beach,
Compton, Hawthorne, Paramount, Gardena, Lakewood and Huntington
Park; the Automobile Club of Southern California; the South Bay
Municipal Court; and Public Agencies Data Systems. The support
group has requested legislative assistance in solving this
problem.
One means of approaching the problem appears to involve the
impoundment of vehicles with a specified number of outstanding
parking violations and the sale of such impounded vehicles to
satisfy the lien for parking offense bail. This idea is embodied
in Assembly Bill 2960. 1

The more critical aspect of the cities' collection problem,
however, seems to be the transfer in ownership of a vehicle on
which bail for parking violations is due. In the typical
situation, the owner will sell his currently registered vehicle
without paying the parking citations he has incurred on the
vehicle. Under existing law, when a vehicle is transferred or
not renewed for two renewal periods and the former registered
owner still owes bail for a parking violation, the DMV notifies
the court of this and is no longer required to attempt collection
of the unpaid bail. The courts, which are often burdened with
paperwork, may or may not pursue collection of the unpaid bail.
In response to this transfer of ownership problem, the parking
citation support group has suggested, among other things, that
the license plate be issued to the owner of the vehicle rather
than to the vehicle itself as under existing law. Thirty-four of
the states use this procedure (see attachment). I would
appreciate receiving your review and comment of this recommen-
dation.
I am well aware that the above described problem is a complex one
which involves several different entities, including the DMV,
local law enforcement agencies, and the court system. Our office
has been advised that your department zs currently in the process
of implementing a number of internal procedures to address the
transfer of ownership issue. To this end, I would appreciate

changes within the existing system or more complex legislative
restructuring of the entire statutory scheme, it is imperative
