AREA WHEN SUCH LOTS ARE CONTIGUOUS TO LOTS HELD BY THE SAME

Supplemental Information Letter from Hermosa Beach City School
District Superintendent Marilyn Harris Corey dated July 23, 1984.
The staff report was presented by Building Director Grove.
Councilman Wood declared a conflict of interest on the 4th
Street property - one of the pieces of property in question.
Council discussed the letter from the Hermosa Beach City School
District. It was noted that the school properties are subject
to the emergency moritorium and, depending on the results of
the proposed extension, they may not be able to be merged.
Develo ment could be precluded with 25' x 100' lots.
City Attorney Post read the title of the proposed ordinance
and the staff recommendation.
The Public Hearing was opened. Coming forward to speak were:
Steve Kaplan, 1413 Sepulveda Boulevard, in opposition.
Wilma Burt, 1152 - 7th Street, in opposition to combining lots.
Willis Dobbins, 644 - 24th Place, stressed concern of citizens.

Betty Ryan, 588 - 20th Street, stated that at no time was the
owner of the property that started this matter ever contacted.
Dorothy Herrian, 2021 Hillcrest Drive, desires to build on her
two lots but now unable to do so.

MORATORIUM (continued)
When questioned by Council, Building Director Grove advised
that there were approximately 313 R-1 lots affected, 94
R-2 lots and 45 R-3 lots. A total of 400-500 new buildings
could be constructed but only 20-25 had been constructed on
similar lots during the past year.
City Attorney Post stated that Council could determine an
exemption whereby what preceded the moritorium with regard to
Prospect Heights School would exempt this property.
Carol Reznichek, 2234 Strand, Hermosa Beach City School Board,
stated the Board had negotiated in good faith with the Council
and because of the moratorium they had lost $1.3 million from
a prospective developer.
City Attorney Post stated that State Law says the Emergency
Ordinance can be extended for 10 months and 15 days. He
recommended adoption as written advising that the Ordinance
could be changed after_ the Planning Commission hearing and
recommendation.

City Manager Meyer presented a staff report. Mr. Meyer then
called on Mr. Glenn Watson of the firm of Richards, Watson,

HYDROCARBON RECOVERY (continued)
Mr. Watson stated that their report was based on production
from the uplands only, not the tidelands. Their conclusions
were that the City must be in compliance with CEQA, Local
Coastal Plan, compliance with the General Plan, City Zoning
Code, Fire Protection Ordinance, Building Code, etc. He
stated that the City could rent the uplands site without
monetary restrictions. Any royalties received from drilling
on the uplands could go into the General Fund with restrictions
only those of the usage of the General Fund.
Mr. Watson's recommendation was that the City proceed to obtain
a policy of Title Insurance and the endorsement in view of the
fact that the City has already paid for a preliminary Title
Report
Mr. Watson's recommendation on the Stinnett well on the City's
one -acre site was that since the lease expired 19 years ago
with no royalties paid to the City for some length of time
the operator be removed from the site and a suit filed to
clear the title from any encumbrance of his being there and
collect as much as possible of the back royalties.
After extensive City Council discussion, the following action
was taken:
PROPOSED ACTION - To direct the City Manager to get together
with Glenn Watson of Richards, Watson, Dreyfuss & Gershon to
secure a title policy with endorsement, establish a platform
fee, a method of taxing, what could be done with the 120 of the
monies involved, etc.

Dreyfuss & Gershon return with a revised scope of work on

consultant and that scope of work would contain a time certain
when the materials would be back (sometime in September) so as
to give 30 days of public information awareness of the material
before the election and a cost analysis.

(c) Sister City Activities - Oral report from Mayor Pro Tem
George Barks.
It was reported that 9 adults and 21 children visited
Hermosa Beach from Loreto, Mexico and a City dinner was
held where an upcoming City visit was discussed for
October. Also discussed was the need for tires for their
older ambulance and that the Sister City Association is
working on acquiring a fire vehicle for the city.
Councilman Wood questioned the form of payment for the
dinner and offered to pay the entire bill to avoid future
litigation. Councilman Barks advised that both the City
Manager and the City Attorney had advised both he and
Councilman Wood that the cost of the dinners for the
official delegation from Loreto was a permissible expenditure.
PROPOSED
ACTION - To reaffirm the City Manager's recommendation
to the City Council.
Motion Barks - withdrawn by the maker of the motion.
PROPOSED ACTION - To ask the Sister City Committee to
reimburse the City for the dinners for those attendees
of the Sister City Dinner that were not members of the
City staff or City officials.
Motion Wood - dies for lack of a second.
(d) Railroad Right -of -Way Subcommittee Report - Councilman. Wood
Councilman Wood reported that a meeting of the Subcommittee
had been held on this date and an attempt had been made to
decide the direction in which to go. A conclusion was
reached that all of those in favor of this activity must
lobby the City Council of Manhattan Beach to join the
group.

Councilman Cioffi - Noted that the South Bay Diversion Subcommittee -
has changed their meeting time to 7:30 AM and would like to be
reappointed. Councilman Barks,who had been appointed when
Councilman Cioffi stated he could not attend because of other
committments,offered to step down.

OTHER MATTERS - CITY COUNCIL (continued
Councilman Wood - Beach Cities Group Meeting - Meets on
demand and there have been no meetings for 8 or 9 months -
it might be a good idea for the Mayor and Mayor Pro Tem to call
one - one item for discussion could be Manhattan Beach's
participation in the BCT. From the audience it was suggested
that airplanes, helicopters and noise be brought up at this
meeting also.
Councilman Wood - Quaisi-Contract Employees - Asked for status
report.
Councilman Wood - Strand Project - Was advised that this project
is out for bid and bids will be opened August 23. This item
will be back to Council on September 11.
Councilman Wood - Parking in South Pacific Coast Highway Business
District - Councilman Wood met with the owner of South Bay
Autohaus and South Bay Datsun and is scheduled to talk with
Vasek Polak with regard to their requirements - some progress
has been made on this Parking District in the South End.
Councilman Wood - Vehicle Parking District #1 - Councilman Wood
questioned where we are going now on this issue. City Manager
Meyer stated that the VPD did meet on July 24, took under
advisement the legal opinion presented by their Special Counsel
and have directed their other Counsel, Mr. Winters, to prepare
a letter to the City Council stating their opinion on the
course of action taken by the City Council and suggesting that
they revise their conduct accordingly. The VPD directed their
attorney be paid even though the VPD does not have an authorized
budget expenditure for this item and over the objection of
City Manager Meyer.
Councilman Wood - Olympic Torch on Friday - Asked for schedule.
City Manager Meyer advised that they have been in contact with
the Highway Patrol and Hermosa Beach Police Department for
traffic and safety precaution measures - the route will be
along Hermosa Avenue to Manhattan Avenue with the timeframe
varying.
Councilman DeBellis - Made the following motions from the
Executive Session.
Management MOU - ACTION - To concur in the"Maintenance of
Provisions" pending enactment of a new MOU for the Management
people and that full employee portion of PERS be paid by the
City to be implemented effective August 1, 1984 to be
consistent with all other employees, including the City Council.

Councilman DeBellis stated that they had talked about a concept
whereby there was a certain amount of money in the budget for
Council attendance but not necessarily so much for him or

to leave that impression with the City Manager. This action
was meant to do that.
Councilman DeBellis - Asked that all items submitted to the
City Council also be given to the City Clerk.
Councilman DeBellis - Roberti-Z'berg Funds - Has this gone to
the Commission for this year's funds - the unallocated grant?
The Community Resources Director advised Council that the
Commission would like to make the suggestions as to how to
allocate this money.
Councilman DeBellis - Independent Cities Association - Asked
whether we were going to join this association and was advised
that we are joining National League of Cities but not Independent
Cities.
Councilman DeBellis - Scoreboard at Clark Stadium Status -
Public Works will install the gift scoreboard, the cost of installation
paid from the General Revenue Sharing allocation for Park
Facilities Update.

Background
This item was before the City Council on April 24, 1984. At
that time it was also recommended that the surplus lot at
634 lst Street be offered for sale. The Council action was
to table the matter until July due to the possibility that
the First Street lot may be utilized to relieve some parking
problems in that area. A copy of the April 24, 1984 report
is included as background material.
Analysis
The First Street lot may still figure in pending plans to
alleviate parking problems near Pacific Coast Highway, Staff
is therefore not recommending that it be offered for sale
at this time.
Staff is recommending that the 1158 Cypress lot be offered for
sale as previously directed by the City Council. As indicated
in the previous report, State law requires that cities offering_
surplus land for sale must first offer the land to housing
authorities, redevelopment agencies, park and recreation departments
and the State Resources Agency.
Cities are not required to sell the property for less than the
fair market value. The appraised value of the property is
$95,000.00
If the contacted agencies express no interest in the lot, staff
will proceed with a bid process for sale of the proporty.

following receipt of the City's notification, the City may
proceed to offer the land for sale on the open market.

market value as compensation.

Councilman Barks requested a reconsideration of former
Public Works Director Charles Clark's recommendation to
Council, specifically "to authorize the Public Works'
Department to proceed with the installation of traffic
channelization islands in conjunction with the Capital
Improvement Project to upgrade the intersection of Gould,
Valley, Ardmore, and once the design has been completed
and cost determined, to return to the City Council for
final review and acceptance." He noted that at the last
Council meeting, the signage for this area was approved,
however, he feels the necessity to move ahead, do the
engineering work, find out what it is going to cost and
have it ready to go (to include the recirculation of traffic
in that area).
PROPOSED ACTION - To have Public Works do the engineering
phase of this project with public hearings and determination
of cost of channelization of islands along with the curb
and gutter work.

City Manager Meyer noted that CIP 186 was in the proposed
budget and this project did include the asphaltic overlay,
the curbs, gutters and sidewalks and drainage system -
the estimated cost to be $60,000.

channelization of traffic at Valley/Gould the second meeting
in August.

Handman to operate parking lots on a 90 -day trial period with
review at 30 and 60 days, to not alter the validation
amounts, not to change the location where employees
park, stack parking to be instituted on lots C, B
and A, in that order depending on demand, the decision
to be made by the operator.

10. ORAL COMMUNICATIONS FROM THE PUBLIC - MATTERS OF AN URGENCY

Wally Moore, Vice President of the Police Officers' Associa-
tion, 540 Pier Avenue, Hermosa Beach. Mr. Moore made a
point of order and a point of law that it was their under-
standing that a decision regarding a negotiator would be
made at the Executive Session for the upcoming meet and
confer session. No announcement had been made. Mayor
Brutsch stated the announcement would be made at the end
of the meeting.
PROPOSED ACTION - To have the announcement made.
Motion Wood - dies for lack of a second
Mr. Moore then made a point of law that Sections 2-55, 2-56
and 2-57 of the Municipal Code, which deal with services
in excess of $5,000, must go out to bid.
City Manager advised that should the Council, by motion,
retain the professional services of a labor negotiator, this
is allowed for under Section 2-62 which exempts professional
services from that bidding process.
ACTION - To retain the firm of Richards, Watson, Dreyfus
& Gershon as Labor Negotiators with the Hermosa Beach
Police Association at a cost of $14,000, said monies to be
appropriated from Prospective Expenditures, and to
authorize the City Manager to sign a letter of agreement
accordingly.

obtain Council signatures. Councilman Cioffi will secure
three council and two school board signatures for the
Mello -Roos argument.
Mayor Pro -tem Barks requested that th-e City Clerk prepare
the implementing documents to place the Specific Plan
and the Developement Agreement for the Biltmore Site on
the ballot. To be ready for the meeting of August 6, 1984.

AN ORDINANCE OF THE CITY OF HERMOSA BEACH SUBMITTED TO THE RIOTERS
BY THE CITY COUNCIL AMENDING THE PROHIBITION AGAINST OIL WELLS TO
ALLOW FOR THE PROCUREMENT OF OIL AND GAS FROM CERTAIN CITY OWNED
LANDS: SUPERSEDING ORDINANCE NO. .84-758.
The people of the City of Hermosa Beach do ordain as follows:
SECTION 1. There shall be added to Municipal Code Section
21-10, Oil Wells Prohibited, Exceptions, a new paragraph to read
in full as follows: "(a). There shall also be excepted from the
prohibition of this Section 21-10, wells drilled from a site not
to exceed one acre in size at the present City maintenance ,yard,
which yard is located at the corner of Valley Drive and 6th Street,
All Gener_ a_ Fund money that is replaced by Tizlelands--Ail-revenue,

DECLARING ITS INTENTION TO DIRECT THE PLANNING COMMISSION TO

WHEREAS, the City desires to acquire additional Open Space; and
WHEREAS, the City proposes to fund purchase of the South School site through
creation of Community Facilities District No. 1 pursuant to the Mello -Roos Act of
1982; and
WHEREAS, the City Council forsees the Hermosa Beach School District has a need
to capitalize its assets.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hermosa
Beach that:

properties) are not approved by the voters at the November 6, 1984, election.
That this process shall be completed with recommendations submitted to the
City Council September, 1984.

Analysis:
All of the above resolutions must be adopted and"in the hands" of
the L.A. County Board of Supervisors and the Registar-Recorder
by August 10, 1984.
I am not recommending that the Council allow rebuttal arguments
due to the time limitations. Mello -Roos can not be placed on the
ballot prior to the close of the protest hearing on Aug. 6, 1984.
We could then order arguments within a 10 day period.(Aug. 16)
If rebuttals were allowed we would then have to allow another 10
day period (Aug. 26). Rebuttals would then be in on Aug. 26th,
and subject to another 10 day inspection period. (Sept.7). Then
the ballots would have to be printed and sent to the county. There
would not be enough time to accomplish all these requirements, and
rather than cut the allowed time by law, I am not recommending
rebuttals.

"THE PEOPLE OF HERMOSA BEACH DO ORDAIN AS FOLLOWS:

SECTION 2. Approval by the City of Hermosa Beach elector-
ate shall be required to modify, amend, or repeal the Land Use
Element or the Open Space Element of the City of Hermosa Beach
General Plan, when any of the above "Subject Lands" or portions
thereof, are affected.
SECTION 3. If any section or portion of this initiative
ordinance is declared invalid by a court of proper jurisdiction,
the remaining sections or portions are to be considered valid.
SECTION 4. There shall be no modification, amendment
or repeal of any provision herein except by a vote of the people.

SECTION 3. That the ballots to be used at said election
shall be, both as to form and matter contained therein, such as
may be required by law to be used thereat.
Section 4. That the polls for said election shall be
open at seven o'clock a.m. of the day of said election and shall
remain open continuously from said time until eight o'clock p.m.
of the same day when said polls shall be closed, except as
provided in Section 14301 of the Elections Code of the State
of California.
SECTION S. That in all particulars not recited in this
Resolution, said election shall be held and conducted as pro-
vided by law for holding municipal elections in said City.

said election is hereby given and the City Clerk is hereby author-
ized, instructed and directed to give such further or additional

WHEREAS, the City Council of the City of Hermosa Beach
called a special Municipal Election in said city to be held on
November 6, 1984, for the purpose of submitting to the qualified
voters of said city measures relating to Oil Drilling at the
City Maintenance Yard - Oil Drilling at the South School Site -
Amendment to the Municipal Civil Service Ordinance re. Political

Beach does hereby resolve, determine, and order as follows:

23302 of the Election Code, the Board of Supervisors of the

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH,

THE PETITION INITIATIVE AND COUNCIL INITIATIVE MEASURES TO BE
SUBMITTED AT THE SPECIAL MUNICIPAL ELECTION OF NOVEMBER 6, 1984.
WHEREAS, Sections 4015.5 and 5014.5 of the Elections Code
of the State of California authorizes the City Council, by
majority vote, to adopt provisions to allow the filing of rebuttal
arguments for petition initiative and council initiative measures
submitted at municipal elections;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF
HERMOSA BEACH, CALIFORNIA, DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. That pursuant to Section 4015.5 of the elections
Code of the State of California, if the legislative body submits
an argument against the ordinance, it shall immediately send
copies of the argument to the persons filing the initiative
petition. The persons filing the initiative petition may prepare
and submit a rebuttal argument not exceeding 250 words. The
legislative body may prepare and submit a rebuttal to the argu-
ment in favor of the ordinance not exceeding 250 words. The
rebuttal arguments shall be filed with the clerk not more than
10 days after the final date for filing direct arguments. Re-
buttal arguments shall be printed in the same manner as the
direct arguments. Each rebuttal argument shall immediately
follow the direct argument which it seeks to rebut.
SECTION 2. That pursuant to Section 5014.5 of the Elections
Code of the State of California, if any person submits an
argument against a city measure, and an argument has been filed
in favor of the city measure, the City Clerk shall immediately
send copies of that argument to the persons filing the argument

The City elected to spend a portion of its CDBG allocation (approximately
$2,000/year) on a public service: a donation to the Retired Senior Volunteer Program
(RSVP) which provides services at the 1736 Runaway Shelter. The attached agreement
is merely the formalization of the City's intention to u the money in this matter.
Analysis
As a public service RSVP has placed volunteers at "173611, a shelter for runaway
children and battered women, located at 1736 Monterey Street in Hermosa Beach.
Volunteers give service in the form of client support, organization, food preparation,
and fund raisers.
Evelyn Rudolph, the Director of RSVP, has provided the following breakdown of how
the $2,000 will be spent.

AGREEMENT
This agreement is entered into, in duplicate, effective August 1, 1984, between the
City of Hermosa Beach, herein after referred to as "City", and the RETIRED SENIOR
VOLUNTEER PROGRAM, herein after referred to as "RSVP", to provide services at
the 1736 RUNAWAY SHELTER FOR CHILDREN AND BATTERED WOMEN, herein
after referred to as 111736".
WHEREAS, the "City" is desirous of providing assistance to children and battered
women, and
WHEREAS, "RSVP" volunteers placed at 111736" assist the program to alleviate stress
for this group in crisis, thus enabling people to live in a safe, decent, and more
sanitary environment.
NOW, THEREFORE, in consideration of the mutual promises herein set forth, it is
agreed as follows:
1. The term of this agreement shall be from August 1, 1984, to July 31, 1985.
2. The "City" will reimburse "RSVP" an amount not to exceed $2,000 during the
period of this agreement.
3. "RSVP" shall bill "City" on a monthly basis: "RSVP" shall submit documentation
of each volunteer's hours (by timesheet), mileage, insurance provided, and
materials purchased (by invoice and City's share of same) in order to
substantiate claim on "City". Payment by "City" shall be dependent on proper
documentation.
4. It is mutually understood and agreed that "RSVP" is independent and is not and
has no authority to act or represent itself as an officer, employee, or agent of
the "City".
5. The work on this project will be supervised by the 1736 Runaway Shelter and
further monitored by the City's Assistant Manager.
6. "RSVP" in conjunction with the 1736 Runaway Shelter will maintain accurate
files which will facilitate short and long term data reporting.
7. "RSVP" shall function in conformance with the Federal statutes relative to
equal employment and equal opportunities.
8. "RSVP" shall provide and maintain at its own expense during the term of this
agreement a program of insurance satisfactory to the "City" covering its
operations hereunder. The "City" is to be given at least 30 days written notice
in advance of any modification or cancellation of any policy of insurance:
a. General Liability: such policy of insurance shall include but not be
limited to, comprehensive general liability, and comprehensive auto
liability with a combined single limit of not less than $30,000 per
occurence. Such insurance shall be primary to any other similar
insurance and shall name the City of Hermosa Beach as an additional
insured.
b. Workers' Compensation: "RSVP" employees shall be covered by Workers'
Compensation insurance in an amount and form to meet all applicable
requirements of the Labor Code of the State of California.
9. Failure on the part of "RSVP" to procure or maintain required insurance shall
constitute a material breach of this agreement under which the "City" may
immediately terminate this agreement or, at its discretion, procure or renew
such insurance and pay any and all premiums in connection therewith, and all
monies so paid by "City" shall be repaid by "RSVP" to "City" upon demand or
"City" may offset the cost of the premiums against any monies due to "RSVP"
from "City".
10. This AGREEMENT shall expire July 31, 1985, and all payment by "City" shall
cease unless the AGREEMENT is extended or renewed by both parties at least
one (1) month prior to said expiration date.
In witness thereof, the parties have caused the AGREEMENT to be executed by their
respective officers duly authorized, the provisions of which AGREEMENT are effective
as of the day, month, and yuear first herein above written.

Recommendation
1) To authorize the City Manager to extend the contract with Mr. Jim Williams of
MSI and Murray Kane (the development agreement attorney) to assist in the
Feasibility Study and negotiations of adding Cove Theater property to the
Lot B structure.
2) To authorize a transfer from prospective expenditures to professional
services in the City Manager's budget in an amount not to exceed $5,000
for MSI and $5,000 for Weiser, Kane, Ballmer, and Berkman.
3) The City Manager will be directed to return on August 14, 1984, with the
total financial feasibility of a Lot B facility.
Background
The City Council on 6-18-84 directed City Staff to report back to them on the
feasibility of expanding proposed Lot B structure by adding Cove Theater property.
Analysis
In order for City Staff to proceed in a manner to comply with Merrill -Lynch
and Bond Counsel requirements and appropriate legal documentation for City
Council review, the espertise of the above-mentioned firms is required.

You have requested that Management Services Institute provide
analytical and negotiations services relative to the expansion of
Downtown and adjacent commercial, tax -producing, and parking
activities. Such services would involve establishing and analyzing
the economic and financial advantages of situations proferred to
or made available to the City, and then negotiating contracts and
agreements most beneficial to the City. Legal assistance would be
provided by the City.
We would agree to provide such services on an hourly basis through
our usual staff which are active in such property -related
activities at our usual property analysis and negotiations rates,
as follows:

Travel would be billed at 0.375/mile, as would travel time. Any

Recommendation
1) To authorize the City Manager to enter into the attached agreement in order
to complete the Hermosa Beach Parking Improvement Feasibility Study.

Services account an amount not to exceed $5,000 for the payment of
Economic Research Associates. Said amount to be reimbursed to the prospective
expenditures account by the Vehicle Parking District Fund at a later date.
Background
The Vehicle Parking District appointed Economic Research Associates (ERA) to
conduct a preliminary Parking Improvement Feasibility Study. This has been
completed and reviewed by the City Council.
Analysis
In order to meet the requirements of Merrill -Lynch and Bond Counsel a final
feasibility study must be prepared. This study will serve as the basis for
the City's financial commitment. Therefore, the Council must review the final
study before a decision is made. ERA. has committed to completing this report
prior to the Council's 5-14-84 meeting.

RE: Hermosa Beach Parking Improvement Feasibility Study
Dear Mr. Meyer:
The purpose of this letter is to clarify Economics Research
Associates' (ERA's) role in the continuing analysis of parking
improvements proposed for development on Lot B and at the Community Center
in Hermosa Beach. On May 10, 1984, ERA submitted a preliminary report
which evaluated the financial feasibility of the proposed parking
improvements, given alternative revenue generation and debt amortization
assumptions. Subsequently, ERA prepared a letter memorandum report on
June 8, 1984, which provided an executive summary of findings -to -date and
tested the financial implications on two atlernative projects of a
consolidated parking fund.
ERA understands that the Hermosa Beach City Council considered
these materials at a public meeting on Monday, June 18, 1984. We further
understand that several Council actions were taken, as follows:
1. Approved creation of a consolidated parking fund.
2. Incorporated the Vehicle Parking District No. 1, together with
the City Council.
3. Directed City staff to report back on the feasibility of
doubling proposed Lot B structure by adding Cove Theater
property.
4. Directed City staff to report back on the feasibility of

contribute to and utilize the proposed Community Center
structure.

With respect to the first two actions, ERA believes that
implementation of the Council directives will enhance project feasibility
by providing for additional revenues, cost accountability, and
administration. Without benefit of additional analysis, the consultants
believe that directive number three is worthy of serious consideration
inasmuch as implementation would clearly enhance access and circulation to
the Lot B structure. The larger structure should also generate positive
income flows; however, this may occur at the expense of the Community
Center facility, which is expected to capture some spillover downtown
parking demand. Implementation of the fourth directive may provide only
marginal benefits to the Community Center structure since it would fill
the structure with long-term users paying reduced rates. The frequent
turnover of parking spaces is the key to maximizing revenue generation.
In light of the changes in project scope, we would like to propose
that any future work be recognized as follow-on consultation, and have
enclosed an invoice in the amount of $2,500, which represents the
remaining balance on our original fee of $12,500.
ERA is prepared to continue to provide professional financial
consulting services to the City of Hermosa Beach, which includes the
preparation of a final report detailing our subsequent findings. We would
like to accomplish this by amending our original letter agreement of
February 21, 1984, to provide follow-on consulting. We propose to bill
the City of Hermosa Beach on a time and materials basis, with costs not to
exceed $5,000. If these conditions are acceptable, please indicate your
approval by signing and returning one copy of this letter. If you should
have any questions, please contact the undersigned, who will assume ERA's
responsibilities during Mr. Valenzuela's absence.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH
DECLARING ITS INTENTION TO DIRECT THE PLANNING COMMISSION TO
CONSIDER REZONING THE RAILROAD RIGHT OF WAY ON THE CONDITION THAT
THE MELLO-ROOS ACT DOES NOT PASS.
WHEREAS, THE City desires to preserve open space; and
WHEREAS, the City proposes to fund purchase of this property through creation of
Community Facilities District No. 1 pursuant to the Mello -Roos Act of 1982; and
WHEREAS, the City Council forsees the possibility of allowing portions of this right-
of-way to be developed should the Community Facilities District not r�e an affirm-
ative 2/3 vote on the proposed levy to be placed before the voters on November 6,
1984:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hermosa
Beach that:
1. The Planning Commission is directed to hold public hearings to consider amend-

ments to the General Plan and Local Coastal Plan so that the railroad right-of-
way may be rezoned consistent with the surrounding area and uses, including
but not limited to commercial use between 8th and 16th Streets, clustered
residential use north of 16th Street and the remainder open space use. It is
the City Council's intention that any rezoning would become operative only
if Community Facilities District No. 1 bonds (the Melio-Roos District bonds
to be used to acquire the right-of-way and certain school properties) are not
approved by the voters at the. November 6, 1984, election.

City Council September, 1984.
