RESOLUTION NO. N. S. 3283
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH,
CALIFORNIA, DELEGATING AUTHORITY TO MAKE DETERMINATIONS UNDER
SECTION 21023.6, GOVERNMENT CODE, ON BEHALF OF THE CITY OF
HERMOSA BEACH, REGARDING WHETHER A LOCAL SAFETY MEMBER OF THE
PUBLIC EMPLOYEES' RETIREMENT SYSTEM IS DISABLED AND WHETHER SUCH
DISABILITY IS INDUSTRIAL.
5 WHEREAS, the City of Hermosa Beach, (hereinafter
6 referred to as Agency) is a contracting agency of the Public
7 Employees' Retirement System; and
8 WHEREAS, the Public Employees' Retirement Law requires
9 that a contracting agency determine whether an employee of such
10 agency in employment in which he is classified as a local safety
11 member is disabled for purposes of the Public Employees' Retire -
12 ment Law and whether such disability is "industrial" within the
13 meaning of such law; and
14 WHEREAS, the City of Hermosa Beach has determined upon
15 legal advice that it may delegate authority to make such deter -
16 minations to the incumbent of the position of City Manager,
17 NOW, THEREFORE, THE CITY COUNCIL OF THE
CITY OF HERMOSA BEACH, CALIFORNIA, DOES
18 HEREBY RESOLVE AS FOLLOWS:
19 SECTION 1_ That the City Council of the City of
20 Hermosa Beach delegate and it does hereby delegate to the
21 incumbent of the position of City. Manager of the City of Hermosa
22 Beach authority to make determinations under Section 21023.6,
23 Government Code, on behalf of the Agency, g y, of disability and
24 whether such disability is industrial and to certify such deter -
25 urinations and all other necessary information to the Public
26 Employees' Retirement System.
27 SECTION 2. That such incumbent be and he is authorized
28 to make applications on behalf of the Agency for disability
29 retirement of employees in employments in which they are local
30 safety members and to initiate requests for reinstatement of such
31

employees who are retired for disability.
PASSED, APPROVED and ADOPTED this 5th day of February,
1974.

I, BARBARA FLEMING, City Clerk of the City of
Hermosa Beach, California, do hereby certify that the foregoing
Resolution No. N. S. 3283 was duly and regularly passed, approved
and adopted by the City Council of the City of Hermosa Beach at a
regular meeting of said Council held at the regular meeting place
thereof on the 5th day of February, 1974, by the following vote:
