Background•
Earlier this year Hermosa Beach entered into a contract with
South Bay Free Clinic (see background materials, copy attached)
for a Challenge Grant.
Analysis•
Attached is the quarterly report from the South Bay Free Clinic.
They have raised $1,600 in new funds in conformance with the
requirements of the City Grant.

THIS AGREEMENT, made and entered into this 14th
day of T,,,,p 1983, in the City of Hermosa Beach, California
by and between the CITY OF HERMOSA BEACH, a municipal corporation
hereinafter referred to as "CITY" and SOUTH BAY FREE CLINIC, a
non-profit organization, hereinafter referred to as "CLINIC":
W I T N E S S E T H:
WHEREAS, CLINIC is a non-profit organization which
provides a wide range of health care and legal services.
NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:
I
That the CITY agrees to fund CLINIC for calendar year
1983 in an amount not to exceed $3,000-

CLINIC agrees, in consideration of the aforesaid
covenants, that CLINIC shall
A) Match the $3,000 on a dollar for dollar basis by
new donors.
B) Give preferential priority assistance to Hermosa
Beach residents in the areas of general medical care, family
planning counseling and treatment, podiatry, dentistry, legal
advisement, community health education and short-term psycholog-
ical counseling.
C) Report quarterly to CITY on monies raised and
services performed.

The office of the City Manager shall be administra-
tively responsible for all CITY obligations. CLINIC is an
independent non-profit organization and shall have no right or
authority to bind or obligate the CITY in any manner whatsoever.

CLINIC shall hold the CITY free and harmless from
any and all liability and claims for damages by reason of any
injury to any person or persons, including but not limited to,
the CLINIC, or to property of any kind whatsoever and to whom-
soever belonging, including, but not limited to the CLINIC,
from any causes whatsoever in connection with the activities
of CLINIC.

which provides shelter and assistance to runaway youths and battered
women.
NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:

That the CITY agrees to fund PROJECTS for calendar year 1983
in an amount not to exceed $2,500.

PROJECTS agrees, in consideration of the aforesaid covenants,
that PROJECTS shall

FROM: Joan Kalvelage, Executive Director of 1736 Projects
RE: Quarterly Report
Since my January 1983 report, the Friends of 1736 House, Inc has
sponsored a booth at the Memorial Day Fiesta del Artes and plans to
sponsor another booth at the Labor Day Fiesta. Also, 1736 Projects
has received a contribution of $3,500 from the Hermosa Beach Rotary
Club -- the proceeds of the club's first annual 10-K run. Since
these are new funds from citizens of Hermosa Beach, we have more
than met the challenge of your $2,500 grant.
Since our last board report, we have served a total of 24 Hermosa
Beach residents: three youth shelter residents, nine residents of
the battered women's shelter, 10 hotline callers, and two clients
in our outpatient counseling program.
With a grant from the Ralph M. Parsons Foundation (matched by com-
munity donations) we continue to expand and refine qur services to
children at Safehouse, our battered women's shelter. We have added
a large play therapy room with puppets, sand tray, anatomically
correct dolls, art supplies, and plenty of toys. Also,:we have
recently hired a new social worker, Patric White, who has special
training in play therapy and six years' experience working with
sexually and physically abused children. As Coordinator of the
youth shelter's aftercare program, Patric and the graduate -level
counseling interns under his supervision may hold counseling
sessions in clients' homes at their discretion. Since our last
quarterly report, we have also hired two half-time Community
Resources Coordinators (one for each shelter) who recruit, screen,
train, supervise, reinforce and evaluate our cadre of 70 volunteers.
New'volunteers include the coordinator of our fledgling speakers
bureau, a retired executive secretary, and a doctor who makes house
calls, -provides routine medical exams at both shelters and offers
information about preventive medicine.

We have recently been awarded several new county and federal
contracts for specific services (e.g., long-range counseling of
abused children, increased community outreach, and aftercare).
When we receive thos:funds (indefinitely delayed due to state
budget negotiations and subsequent red tape), we will finally be
able to plan beyond this week's grocery bill and the next payroll.
Although we will continue to depend upon local support like yours
to meet at least half of our operating costs, we will also be
able to divert some local support toward new programs such as a
"warm homes" network for throwaways ineligible for foster care
or refugee sponsorship for women leaving Safehouse.

A RESOI,,UTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH,
CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL
MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, NOVEMBER 8,
1983, FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY
PROPOSED ORDINANCES RELATING TO THE HERMOSA BILTMORE SITE, AMEND-
MENT TO THE MUNICIPAL CIVIL SERVICE ORDINANCE AND TWO ADVISORY
MEASURES RELATING TO CROSSING GUARD AND LANDSCAPING MAINTENANCE
DISTRICTS.
WHEREAS, the City Council of the City of Hermosa Beach
desires to submit to the qualified electors of said City at a
-Special Municipal Election proposed ordinances relating to the
Hermosa Biltpore Site, Amendment to the Municipal Civil Service
Ordinance, and two Advisory Measures; and
WHEREAS, the City Council of said city is thereupon
authorized and. directed by statute to submit the Ordinances and

5 The People of the City of Hermosa Beach do ordain
6 as follows:
7 SECTION 1. There shall be added to the Zoning Code
8 of the City a new section as follows:
9 "Section 806. Hotel for Downtown Beach Area. There
10 shall be permitted within the downtown beach area, defined as
11 that area bounded by 15th Street on the north, Hermosa Avenue
12 on the east, Tenth Street on the south, and the Strand on the
13 west, one hotel with accessory restaurant uses of at least
14 175 rooms which may have a height not to exceed 75 feet.
15 The development criteria and manner of approval for the
16 hotel shall be as provided in Article 8.5, Commercial Planned
17 Development, except that the use and height standards shall be
18 as provided in this section.
19 Because the Biltmore site offers unique advantages
20 for a hotel, the city shall endeavor for the first two years
21 after the passage of this ordinance to develop an agreement to
22 construct the hotel facility on the Biltmore site and shall not
23 permit any other permanent use on the site during this time."
24 SECTION 2. In enacting this ordinance the people
25 of this city find:
26 a) That one hotel -restaurant facility of the size
27 authorized by this ordinance would provide a unique landmark

and tourist attraction for the downtown beach area;
b) That more than one such facility would destroy
the neighborhood character of the commercial area•
c) That the time-share resort vacation condominiums
being proposed for the Biltmore site would be a less desirable
use of the site than a hotel and, therefore, in voting for
this hotel ordinance, the electorate is voting against the
resort vacation condominiums and finds them inconsistent with
the hotel proposal. The Biltmore site is defined as:
Lots 1,2,3,4,5,6,7,8,9,19,20 and 32 of Block 15 of
Hermosa Beach Tract, plus vacated Beach Drive between
the northerly limits of 14th Street and the southerly
limits of 15th Street, plus the vacated westerly 60 feet
of 15th Court.
SECTION 3. This ordinance may be amended only by
a vote of the people.
SECTION 4. If any portion of this ordinance is
declared invalid, the remaining portion is to be considered valid.
SECTION 5. Upon certification that this ordinance has
been adopted by the voters of the City, the Mayor shall sign
and the City Clerk shall attest to the passage and cause the
ordinance to be published in a newspaper of general circulation
not later than the fifteenth day after its adoption.

AN ORDINANCE OF THE CITY OF HERMOSA BEACH SUBMITTED TO THE VOTERS
BY THE CITY COUNCIL AMENDING SECTION 2-25 OF ARTICLE III, CIVIL
SERVICE, TO PROVIDE FOR PERSONNEL RULES TO REASONABLY REGULATE THE
WORKING OF SPOUSES IN THE SAME DEPARTMENT, DIVISION OR FACILITY.
The People of the City of Hermosa Beach do ordain as
follows:
SECTION 1. The last two paragraphs of Section 2-25,
Effect of citizenship and marital status on eligibility for
system, of the Municipal Code dealing with marital status are
hereby amended to read in full as follows:
"The working of spouses in the same department, division
or facility shall be reasonably regulated so that supervision,
safety, security and morale may be maintained through the
formulation and periodic revision of personnel rules by the City
Council pursuant to this Article."
SECTION 2. This ordinance may be amended only by a
vote of the people.
SECTION 3. If any portion of this ordinance is
declared invalid, the remaining portion is to be considered
valid.
SECTION 4. Upon certification that this ordinance has
been adopted by the voters of the City, the Mayor shall sign
and the City Clerk shall attest to the passage and cause the
ordinance to be published in a newspaper of general circulation
not later than the fifteenth day after its adoption.

SECTION 3. That the ballots to be used at said electi
shall be, both as to form and matter contained therein, such as
may be required by law to be used thereat.
SECTION 4. That the polls for said election shall be
open at seven o'clock a.m. of the day of said election and shall
remain open continuously from said time until eight o'clock p.m.
of the same day when said polls shall be closed, except as pro-
vided in Section 14301 of the Elections Code of the State of
California.
SECTION 5. That in all particulars not recited in this
Resolution, said election shall be held and conducted as provided
by law for holding municipal elections in said City.
SECTION 6. That notice of the time and place of
holding said election is hereby given and the City Clerk is
hereby authorized, instructed and directed to give such further
or additional notice of said election in time, form and manner
as required by law.
SECTION 7. That the City Clerk shall certify to the
passage and adoption of this Resolution; shall enter the same
in the book of original Resolutions of said City; and shall make
a minute of the passage and adoption thereof in the records of
the proceedings of the City Council of said City, in the
minutes of the meeting at which the same is passed and adopted.
SECTION 8. That this Resolution shall take effect
immediately.

4 WHEREAS, pursuant to authority provided by statute a

8 ordinance relating to permitting the development of the former
9 Hermosa Biltmore Site with forty-nine timeshare resort vacation
10 condominium residential units by David T. Schumacher; and
11 WHEREAS, the City Clerk of said city has duly examined and
12 from the records of registration ascertained that the petition is
13 signed by the requisite number of voters, and has so certified;
14 and

ORDINANCE NO. 83-725
"THE PEOPLE OF THE CITY OF HERMOSA BEACH DO ADOPT THE FOLLOWING
ORDINANCE: AN ORDINANCE TO PERMIT THE DEVELOPMENT OF THE FORMER
HERMOSA BILTMORE SITE WITH FORTY-NINE RESORT VACATION CONDOMINIUM
RESIDENTIAL UNITS, MAXIMUM CONSTRUCTION HEIGHT TO BE 45 FEET
ABOVE GRADE.
WHEREAS, the City of Hermosa Beach has acquired and
is now the owner of certain property in the City of Hermosa Beach
upon which the Hermosa Biltmore Hotel was f9rmerly located; and
WHEREAS, the City Council has been unable to resolve
a proper use for the site. The property has been vacant for
approximately 15 years, and is not generating any income for the
City, nor is it being utilized for the benefit of the Citizens
of Hermosa Beach; and
WHEREAS, David T. Schumacher, in response to an invi-
tation by the City, in 1980 submitted a proposal to the City
for lease of the site for development of resort/vacation con-
dominium residential units. His proposal has not been acted

upon by the City Council;
NOW, THEREFORE, BE IT RESOLVED, that the City of Hermosa
Beach enter into an agreement with David T. Schumacher granting
shim an option to lease the said site for a term of fifty-five
years for development of forty-nine Timeshare Condominium
presidential units upon the terms and conditions as set forth in
this resolution. The rental to the City shall be $200,000 per
year, commencing upon the date a certificate of occupancy is
issued. The rental shall be adjusted at five year intervals
1consistent with the Consumer Price Index published by the United
States Department of Labor, however, any increase shall not exceed
2% per year. The finished improvements shall not be more than
forty-five feet in height above grade.
The property referred to in this resolution consists
of twelve lots in the City of Hermosa Beach, County of Los
Angeles, State of California, plus 270.5 lineal feet of vacated
streets legally described as Lots 1,2,3,4,5,6,7,8,9,19,20 and
32 of Block 15 of Hermosa Beach Tract, plus vacated Beach Drive
between the northerly limits of 14th Street and the southerly
limits of 15th Street, plus the vacated westerly 60 feet of
15th Court.
The option shall be granted for the sum of $5,000
payable to the City of Hermosa Beach and shall be exercised by
the Lessee by deposit with the City of Hermosa Beach the sum
of $95,000 which sum shall constitute a lease deposit to insure
the Lessee's performance under the terms of the lease, subject
to return in the event that the development cannot be

constructed for any reason beyond the control of the Lessee. The
option shall be exercised by Lessee within a period of two
years after adoption of this ordinance."
SECTION 3. That the ballots to be used at said election
shall be, both as to form and matter contained therein, such as
may be required by law to be used thereat.
SECTION 4. That the polls for said election shall be
open at seven o'clock a.m. of the day of said election and shall
remain open continuously from said time until eight o'clock p.m.
of the same day when said polls shall be closed, except as
provided in Section 14301 of the Elections Code of the State
of California.
SECTION 5. That in all particulars not recited in this
Resolution, said election shall be held and conducted as provided
by law for holding municipal elections in said City.
SECTION 6. That notice of the time and place of holding
said election is hereby given and.the City Clerk is hereby author-
ized, instructed and directed to give such further or additional
notice of said election in time, form and manner as required by
law.
SECTION 7. That the City Clerk shall certify to the
passage and adoption of this Resolution; shall enter the same
in the book of original Resolutions of said City; and shall make
a minute of the passage and adoption thereof in the records of
the proceedings of the City Council of said City, in the
minutes of the meeting at which the same is passed and adopted.

WHEREAS, the City Council of the City of Hermosa Beach

THE PETITION INITIATIVE AND COUNCIL INITIATIVE MEASURES TO
BE SUBMITTED AT THE SPECIAL MUNICIPAL ELECTION OF NOVEMBER 8, 1983
WHEREAS, Sections 4015.5 and 5014.5 of the Elections Code
of the State of California authorizes the City Council, by
majority vote, to adopt provisions to allow the filing of rebuttal
arguments for petition initiative and council initiative measures
submitted at municipal elections;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
HERMOSA BEACH, CALIFORNIA, DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. That pursuant to Section 4015.5 of the i.
Elections Code of the State of California if the legislative body
submits an argument against the ordinance, it shall immediately
send copies of the argument to the persons filing the initiative
petition. The persons filing the initiative petition may prepare
and submit a rebuttal argument not exceeding 250 words. The
legislative body may prepare and submit a rebuttal to the argument
in favor of the ordinance not exceeding 250 words. The rebuttal
arguments shall be filed with the clerk not more than 10 days
after the final date for filing direct arguments. Rebuttal
arguments shall be printed in the same manner as the direct
arguments. Each rebuttal argument shall immediately follow the

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
HERMOSA BEACH, CALIFORNIA, DOES HEREBY RESOLVE,
DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That this City Council, being the legisla-
tive body of the City of Hermosa Beach,thereby authorizes
members of said body to file written arguments in favor of
and against the City measures set forth in the recitals hereof
in accordance with Article 4, Chapter 3, Division 5 of the
Elections Code of the State of California as follows:
