CONSIDERATION OF POWER STREET AREA DRAINAGE CONCERNS
EXPRESSED BY LOS ANGELES COUNTY
Recommendation:
That the City Council authorize contracting for a study of this
drainage area with Los Angeles County, appropriate $5,000 from
Prospective Expenditures for the study, and consider an urgency
ordinance on construction within the drainage area.
Analysis:
The City has received the attached letter from the County of Los
Angeles Department of Public Works reflecting a concern about the
adequacy of the drainage system in the Power Street area of our
community, and suggesting a study be performed to recommend pos-
sible solutions.
These concerns have been cited as partial reasons for the failure
to approve a subdivision in the immediate vicinity of Power
Street. Since the impact on drainage in the area can be felt
from other development within the drainage area, it is logical to
'*bm� consider delay in other construction until the issue is resolved.
While this point has merit, staff wishes to make the Council
aware of the negatives associated with an urgency moratorium.
First, the study could take several months, and lead to solutions
that may take more than two years to complete. If construction
were stopped in the entire area for that period of time, con-
siderable disruption of property owner and builder/developer
plans could result.
Also, the significance of the impact of allowing construction to
continue is questionable. There are currently 12 developments in
some stage of the building.permit process, in addition to the 8 -
unit subdivision. Staff estimates that perhaps 2,000 dwelling
units exist within the drainage area, so the twenty residential
units in the permit process currently represent approximately 1%
of the area in terms of number of dwelling units. Whether or not
these are allowed to be constructed prior to storm drain improve-
ments may not have a very great impact on the potential for
flooding.

Preliminary investigation into the adequacy of the existing storm
drain system at this location indicates that the peak flow rates from
a 50 -year frequency rainfall is 360 cfs and that the existing system
will handle only about 120 cfs. This information is extracted from a
1973 study and, with new developments and more intensive land use, it
is possible that the above peak flow rates may be understated. As you
know, the area is in a sump and collects runoff from many directions.
We believe a hydrology study is needed to clearly define the problems
and recommend possible solutions. If you wish, we can do the study
by Service Request. we estimate that the study will cost $5,000 and
require about three months.
After the study, a detailed design can be made to determine pipe
sizes, catch basin locations and construction costs.

The Council is aware that Stanley Remelmeyer, our Interim City
Attorney since May 15, 1989, is in the hospital recovering from
open heart surgery, and will not be available to continue these
services in the immediate future. Accordingly, staff contacted
Casey Vose of Oliver, Stoever, Barr & Einboden to see if the
original discussion with him to provide Interim City Attorney
services could be implemented. Council will recall that, prior
to learning of Mr. Remelmeyer's availability, the Council had
authorized the selection of Mr. Vose to serve in this capacity.
Mr. Vose was able to make himself available on short notice to
assist the City as the Interim City Attorney, and the attached
agreement will provide the necessary paper documentation for pro-
vision of these services at the same level and rate as previously
discussed with his firm.

AGREEMENT FOR LEGAL SERVICES
WITH
OLIVER STOEVER. BARR & EINBODEN
THIS AGREEMENT is entered into this day of May, 1989,
by and between the CITY OF HERMOSA BEACH, (hereinafter referred
to as the "City") and OLIVER, STOEVER, BARR & EINBODEN, with
offices in the City of Los Angeles, California (hereinafter
referred to as "Firm"),
WHEREAS, the City desires to engage Firm as interim City
Attorney to render legal advice and assistance in connection with
City's municipal activities.
NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE AS
FOLLOWS:
1. SCOPE OF SERVICE
Firm agrees to render legal services to the City as interim
City Attorney pursuant to the terms herein and when and as
required by the City Council or City Manager.
Services to be performed under this Agreement may include,
but shall not be limited to: attendance at City Council and
Planning Commission meetings, representing the City on pending
and potential litigation; the rendering of legal advise and
consultation; furnishing of written legal opinions; drafting and
preparation of necessary legal documents; and attendance at local
hearings or other meetings as required.
2. COMPENSATION
In connection therewith, City employs Firm to furnish, and
Firm agrees to furnish, interim City Attorney services
consisting of the following:
1. Attendance at each regularly scheduled City
Council meeting (2nd and 4th Tuesdays)
2. Attendance at each regularly scheduled Planning
Commission meeting (1st and 3rd Tuesdays)
3. Meeting and conferring with staff on the 1st, 2nd,
3rd and 4th Tuesday of each month between 2:00
p.m. and 6:00 p.m.
4. Meeting and conferring with staff on the Thursday
before Council meetings (2 hours each day).
5. Firm agrees to provide sixteen (16) additional hours
per month for legal services as requested by the
City Manager or City Council.
For the services specified in paragraphs 1 thru 5 above, the
City shall pay Firm a monthly retainer in the amount of
$3,700.00. It is specifically understood that the principal in
the Firm designated to be the lead attorney in providing these
legal services shall be Charles S. Vose.
For all legal services in excess of the above, Firm shall be
compensated for services rendered under this Agreement at the
hourly rate of One Hundred Twenty Five Dollars ($125.00).
In addition, Firm shall be compensated for legal services
rendered or performed in connection with the time spent in court
at $900.00 per day, billable in half day increments.
2.
Firm shall not be reimbursed for secretarial or typist
services. copying and related costs shall be billed in the
amount of the actual costs.
3. METHOD OF PAYMENT
Within ten (10) days after the first of each calendar month,
Firm shall submit a statement containing a breakdown of services
performed during the preceding month specifying the services
performed by dates and number of hours, itemization of travel,
subsistence and other expenses relate thereto.
4. RIGHT OF TERMINATION
This Agreement may be terminated by either party on thirty
(30) days written notice to the other, the effective date of
cancellation being the 30th day of said written notice without
further action by either party.
IN WITNESS WHEREOF, the Agency and Firm have executed this
Agreement as of the date first hereinabove set forth.

AN EMERGERCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
2 HERMOSA BEACH, CALIFORNIA, ESTABLISHING A MORATORIUM ON THE
ISSUANCE OF BUILDING PERMITS OR CONDITIONAL USE PERMITS FOR
3 DEVELOPMENT OF STRUCTURES, AND/OR ADDITIONS TO STRUCTURES WITHIN
THE DRAINAGE AREA(S) AS DESIGNATED AND SHOWN ON THE ATTACHED MAP.

WHEREAS, the City Council held a hearing on June 1, 1989, and
5
made the following Findings;
6
A. The City Council has determined that a hydrology study is
7
needed to determine the significance of a flood problem
8
existing within the said area(s).
9
B. During the period of studying this matter, flooding could
10
occur causing major structural damage.
11
C. The immediate threat to health, safety, and welfare of the
12
residents within the said area is apparent. The drainage
13
system was designed for maximum capacity of 120 CFS, and a
14
recent study by Los Angeles County indicates that a 50 -year
15
frequency rainfall is 360 CFS. The original drainage system
16
was designed based on 23% ground coverage; the City's Zoning
17
ordinance permits 65% ground coverage.

19 WHEREAS, Section 65858 of the Government Code authorizes the
20 adoption of an interim ordinance as an emergency measure which
21 can act to prevent conflicts with the contemplated proposal that
22 the City Council has given direction to study;
23
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA
24 BEACH, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
25 Section 1. No building permits shall be issued or
28 conditional use permits granted for development of structures,
27 and/or additions to structures within the drainage area(s) as

designated and shown on the attached map.
I Exception: Developments or projects which result in no
2 increase in ground coverage may be permitted.
3 Section 2. This ordinance shall take effect immediately upon
4 adoption by a four-fifths (4/5) vote of the City Council of the
5 City of Hermosa Beach.
6 Section 3. This ordinance be effective for a period of
7 forty-five (45) days from today's date unless extended pursuant
8 to the provisions of California Government Code Section 65858.
9 Section 4. The City Council shall draft a report for
10 presentation to the public at its first regular meeting in July,
11 1989. Such report shall state what steps are being taken by the
12 City to correct the problems referenced in this ordinance and
13 what steps are planned to be taken in the future to remedy this
14 situation.
15 Section 5. Prior to the expiration of fifteen (15) days
16 after the date of its adoption, the City Clerk shall cause this
17 ordinance to be published in the Easy Reader, a weekly newspaper
18 of general circulation published and circulated in the City of
19 Hermosa Beach, in the manner provided by law.
20 Section 6. The City Clerk shall certify to the passage and
21 adoption of this ordinance, shall enter the same in the book of
22 original oridnances of said city, shall make minutes of the
23 passage and adoption thereof in the records of the proceedings of,
24 the City Council at which the same is passed and adopted.

WELCOME! By your presence in the City Council Chambers you are
participating in the process of representative government. Your
government welcomes your interest and hopes you will attend the
City Council meetings often.
It is the policy of the City Council that no discussion of new
items will begin after 11:30 p.m., unless this rule is waived by
the Council. The agendas are developed with the intent to have
all matters covered within the time allowed.
CITY VISION
A less dense, more family oriented pleasant low profile,
financially sound community comprised of a separate and distinct
business district and residential neighborhoods that are afforded
full municipal services in which the maximum costs are borne by
visitor/users; led by a City Council which accepts a stewardship
role for community resources and displays a willingness to
explore innovative alternatives, and moves toward public policy
leadership in attitudes of full ethical awareness. This Council
is dedicated to learning from the past, and preparing Hermosa
Beach for tomorrows challenges today.

THE'HERMOSA BEACH FORM OF GOVERNMENT
Hermosa Beach has the Council -Manager form of government, with a City Manager ap-
pointed by and responsible to the City Council for carrying out Council policy. The
Mayor and Council decide what is to be done.. The City Manager, operating through
the entire City staff, does it. This separation of policy making and administration
Is considsered the most economical and efficient form of City government in the
United States today. ,
GLOSSARY
The following explanations may help you to understand the terms found on most agen-
das for meetings of the Hermosa Beach City Council.
Consent Items
A compilation of all routine matters to be acted upon by one vote; approval re-
quires a majority affirmative vote. Any Councilmember can remove an item from this
listing thereby causing that matter to be considered under the category Consent Cal-
endar items Removed For Separate Discussion.
Public Hearings
Public Hearings are held on certain matters as required by law. The Hearings afford
the public the opportunity to appear and formally express their views regarding the
matter being heard. Additionally, letters may be filed with the City -Clerk, prior
to the Hearing.
Hearings
Hearings are held on other matters of public importance for which there is no legal
requirement to conduct an advertised Public Hearing.
Ordinances
An ordinance is a law that regulates government revenues and/or public conduct. All
ordinances require two "readings". The first reading introduces the ordinance into
the records. At least one week laterCouncilmay adopt, reject or hold over the -
ordinance to a subsequent meeting. Regular ordinances take effect 30 days after the
second reading. Emergency ordinances are governed by different provisions and waive
the time requirements.
Written Communications
The public, members of advisory boards/commissions or organizations may formally
communicate to or make a request of Council by letter; said letters should be filed
with the City Clerk by the Wednesday preceeding the Regular City Council meeting.
Miscellaneous Items and Reports .City Manager
The City Manager coordinates departmental reports and brings items to the attention
of, or for action by the City Council.
Verbal reports may be given by the City Manager regarding items not on the agenda,
usually having arisen since.the agenda was prepared on the preceding Wednesday.

Members of the City Council may place items on -the agenda for consideration by the
full Council.
Other Matters - City Council
These are matters that come to the attention of a Council member after publication

Parking Authority
The Parking Authority is a financially separate entity, but is operated as an inte-
gral part of the City government.
Vehicle Parking District No. 1 i
The City Council also serves as the Vehicle Parking District Commission. It's pur-
pose is to oversee the operation of certain downtown parking lots and otherwise pro-
mote public parking in the central business district.
