PUBLIC PARTICIPATION: Although the City Council values your comments, the Brown
Act generally prohibits the Council from taking action on any matter not listed on the posted

and the City Clerk to attest the contract subject to approval by the City Attorney;
authorize the Director of Public Works to negotiate a lesser price for All American
Asphalt's additive bid items, currently priced at $235,627.50, so that price of these
additives will result in the lowest total overall price as compared against the other
bidders; approve the attached Professional Service Agreement No. 11.003 between
the City and Civi!Source Inc, for providing construction inspection services for
$42, 720.00; appropriate $11,500 from the in-lieu fees account for use on this project;
and, authorize the Director of Public Works to approve change orders within the

RECOMMENDATION: Direct the City Clerk to immediately advertise and
request applications from interested parties for two Parks, Recreation and
Community Resources Advisory Commission terms that will expire
June 30, 2011, two Planning Commission terms that will expire June 30, 2011,
and two Civil Service Board terms that will expire July 15, 2011.
9. OTHER MATTERS-CITY COUNCIL
Requests from Council members for possible future agenda items. No discussion or
debate of these requests shall be undertaken; the sole action is whether to schedule the
item for consideration on a future agenda. No public comment will be taken.
a. Request from Mayor Tucker that a bicycle parking area with bike racks be
created adjacent to the paver sidewalk leading to the entrance to the
Community Center Theater.
b. Request from Mayor Pro Tern Fishman that the City sponsor the Shared
Services Summit on May 5, 2011 from 7:00pm-9:00pm being coordinated
by George Barks.
c. Request from Mayor Pro Tern Fishman that the City Council authorize a
letter to the Citizen's Commission on Redistricting suggesting that they keep
the beach cities surrounding the Santa Monica Bay together since we all
share similar environmental concerns.

PUBLIC HEARING, COST OF SERVICES STUDY
RECOMMENDATION
It is recommended that the City Council:
1. Open the public hearing and hear testimony regarding the study
2. Adopt the attached resolution on page 20 setting the fees and repealing the previous
Master Fee Resolution 90-5422 (see pages 81-97).
BACKGROUND
Two workshops were held on 2/17/11 and 3/29/11. Eric Johnson from Revenue & Cost Specialists
provided an overview of the Cost of Services Study on February 17, 2011 and the City Council
reviewed the fees in more detail on 3/29/11.
The summary reports from the 3/29/11 workshop are attached, starting on page 42 for reference.
Dividers (tabs) in the report are explained below. (Councilmembers: You were provided these reports
in a report cover with tabs for the 3/29/11 meeting so you may prefer to bring that booklet with you).

The reference numbers in the left column on each report are the best way to refer to the fee since
they are in chronological order within each section.
Note: The original Cost of Services Fee Book herein is not included due to the size of the document.
It is available at the Finance Department for review.
ANALYSIS
Please review Attachment A, page 5, “Cost of Services Study, Subsidy Decision”, which highlights
some of the most important points in the study. The goal of the study is to evaluate the full costs of
City services so that the appropriate fee may be set for each service. The study divides the services
into two categories; 1.) community supported public services such as police and fire protection that
benefit all members of the community and 2.) personal choice public services such as sign permits
and dance classes that are for the benefit of an individual or group. The study asks the question:
“Who should pay for these services – the general taxpayer or the individual who is benefitting from
the service?” If the individual is benefitting, the individual should be paying the full cost. If the
individual does not pay the full cost, the general taxpayer is picking up the difference.
Staff’s recommended changes to the original report are in bold in the table on the next page. These
changes are also reflected in the attached resolution.

A survey of neighboring cities for Police Alarm Permits and Police False Alarm Response is attached
(Attachment F, page 19) as requested at the last workshop. Fees typically should be based on our
cost rather than a comparison to other cities.
As shown on the last page of the summary report on page 80, if all fees in the study are adopted,
additional revenue of $929,100 will be generated.
Fees other than development fees require at least 30 days to take effect; development fees require
60 days after adoption. Staff recommends that the effective date for all fees be 7/1/11 to be
consistent with the start of the new fiscal year.

COST OF SERVICES STUDY
Subsidy Decision
Community Supported vs. Personal Choice Services
The goal of this study is to allow the city to fully evaluate the costs of its services
and the fees it charges so that it can prudently manage spending and continue to
provide the vital services its residents deserve. The Cost of Services study
identifies the services the City provides and calculates the cost of each. It divides
services into two categories: community supported public services, such as
police and fire protection that benefit all members of the community, and
personal choice public services, such as dance classes and building permits that
are provided for the benefit of an individual or a group, rather than all members of
the community.
The study asks the question: Who should pay for the cost of these personal
choice services—the general taxpayer or the individual receiving the service? In
other words, who is benefitting from this service? In 99% of the cases, the
individual requesting the service is benefitting and should, therefore, be paying
the full cost.
Who Should Pay the Bill for Personal Choice Services?
The city pays the bill for these services. That means that, if fee charged to the
individual is too small to recover the service’s cost, the general taxpayer is
picking up the difference. In other words, the City of Hermosa Beach is using
taxpayers’ funds to pay for a portion of the cost of services that benefit only
certain select individuals or groups in the community when the fees it charges
are less than the cost of the service.
So for each service, the study asks: “Who is benefitting from this service?” If an
individual is the beneficiary, he or she should be paying the full cost of the
service. That can be accomplished by setting the fee so that it recovers 100% of
the cost. If an individual doesn’t pay the full cost, the rest of the taxpayers in the
community are paying by default. This is not good tax policy, especially in times
of fiscal constraints.
Council can Balance Fees and Community Benefits
If there are gray areas where an individual benefits and there is some benefit to
the general public, the City Council could decide to charge less than the full cost
of the services. The Council would be intentionally choosing to use taxes and
fees to pay for some of the costs of the service.
The city must take steps to ensure it remains financially sound and is able to fund
the community-supported public services and projects that are essential to the
safety and well-being of Hermosa Beach. If fees are set to recover the full cost of

the services provided to individuals, tax funds will be freed up and may be used
for those projects that benefit the public as a whole.
Balance is, of course, essential to ensuring the city can continue to provide
community supported and personal choice services—without unfairly burdening
taxpayers or individuals.

Note:
Robbery/Panic alarms cause the Police Department to be dispatched to a business (robbery) or a home (panic) due
to a signal triggered by a duress device, ie; the bait money removed from a bank drawer, or the activation of a
robbery button for businesses. In a home, it could be from a panic button or the entry of a duress code. Any of these
can be the result of a faulty device or user errors. Due to the serious nature of this type of alarm, the Police
Department sends at minimum two officers and often the supervisor.
Burglary Alarms are usually residential alarms, or after hours alarms at businesses. The system will notify dispatch of
a breach at a door or a window, or a motion sensor or glass break sensor. Approximately 95% of all alarms are the
result of system failures or user error (meaning the resident or employee made an error). For this reason the Police
Department normally dispatches one officer, thus the lower cost.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HERMOSA BEACH, CALIFORNIA, ESTABLISHING A
SCHEDULE OF FEES AND CHARGES FOR CITY SERVICES
WHEREAS, the City of Hermosa Beach has conducted an extensive and exhaustive
analysis of its services, the costs reasonably borne of providing those services, the beneficiaries
of those services, and the revenues produced by those paying fees and charges for special
services; and,
WHEREAS, the City wishes to comply with both the letter and the spirit of Article XIIIB of
the California Constitution and limit the growth of taxes; and,
WHEREAS, the City desires to establish a policy of recovering the full costs reasonably
borne of providing services of a voluntary and limited nature, such that general taxes are not
diverted from general services of a broad nature and thereby utilized to subsidize unfairly and
inequitably such voluntary services; and,
WHEREAS, pursuant to Government Code Section 54994.1 the specific fees to be
charged for services must be adopted by the City Council by Resolution, after providing notice
and holding a public hearing; and,
WHEREAS, notice of public hearing has been provided per California Government Code
Section 6062a, oral and written presentations made and received, and the required public
hearing held; and,
WHEREAS, a schedule of fees and charges to be paid by those requesting such special
services need be adopted so that the City might carry into effect its policies; and,
WHEREAS, pursuant to California Government Code Section 6062a a general
explanation of the hereinafter contained schedule of fees and charges has been published as
required; and,
WHEREAS, all requirements of California Government Code Section 54994.1 are
hereby found to have been complied with;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH
DOES RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1. Fee Schedule Adoption. The fees and charges set forth in the Master Fee
Schedule attached hereto as Exhibit A and incorporated herein by reference shall be computed
and applied by the various City departments and collected by the City Finance Department for
the listed services set forth therein when provided by the City or its designated contractors.
Section 2. Separate Fee for Each Process. All fees set forth in the Master Fee
Schedule are for each identified process; additional fees shall be required for each additional
process or service that is requested or required. Where fees are indicated on a per unit of
measurement basis the fee is for each identified unit or portion thereof within the indicated
ranges of such units.

Section 3. Listing of Fees. The Master Fee Schedule attached hereto as Exhibit A and
incorporated herein by reference is hereby adopted as the Master Fee Schedule for the City.
Section 4. Interpretations. Should the City Manager determine there is a conflict
between two fees set forth in the Master Fee schedule, the lower in dollar amount of the two
shall be applied.
Section 5. The City Council shall periodically review the fees and charges in the Master
Fee Schedule.
Section 6. All fees and charges set forth in the Master Fee Schedule shall be
administratively adjusted annually on September 1 of each year commencing September
1,2012 by the percent change in the Consumer Price Index for All Urban Consumers for the
year ending in the preceding May.
Section 7. Severability. If any part or provision of this Resolution or the application of the
Master Fee Schedule to any person or circumstance is held invalid, the remainder of this
Resolution and the Master Fee Schedule adopted hereby, including the application of such part
of provision to other persons or circumstances, shall not be affected and shall continue in full
force and effect. To this end, the provisions of this Resolution are severable.
Section 8. Repealer. Resolution 90-5422 is hereby superseded and repealed.
Section 9. Fees Do Not Exceed Cost. As provided in the Cost of Services Study
prepared in connection with the adoption of the Master Fee Schedule, made available for public
review and reviewed by the City Council, the fees set forth in the Master Fee Schedule
approved by this resolution do not exceed the City’s cost of providing the respective services.
Section 10. Effective Date. The fees established in the Master Fee Schedule (Exhibit A)
shall take effect July 1, 2011, which shall satisfy the requirements of Government Code Section
66017 regarding the fees imposed on development projects.

I. Introduction
The Hermosa Beach City Council appointed a PCH/AVIATION Blvd. Improvement Committee
on June, 3, 2010.
II. PCH/AVIATION Improvement Committee Mission:
The mission of the Hermosa Beach PCH and Aviation Improvement Committee shall be to
develop collaboration with the City, business, and property owners, Caltrans and public utilities
seeking viable, safe, environmentally friendly and cost effective solutions to improve the
aesthetics and economic well being of these vital transportation and business corridors.
Based on these guiding principles, the committee formed 3 sub committees:
1) Aesthetics
2) Economic Development
3) Infrastructure
III. Organization of the Aesthetics sub committee:

IV. The Aesthetics Sub Committee makes the following recommendations to the
PCH/AVIATION full committee:
