PUBLIC PARTICIPATION: Although the City Council values your comments, the Brown
Act generally prohibits the Council from taking action on any matter not listed on the posted
agenda as a business item.
1. ORAL AND WRITTEN COMMUNICATIONS
This is the time for members of the public to address the City Council on any items within the
Council's jurisdiction not on this agenda, on items on this agenda as to which public comment
will not be taken, or to request the removal of an item from the consent calendar. Comments on

public hearing items are heard only during the public hearing. Members of the audience may
also speak:
I) during discussion of items removed from the Consent Calendar;
2) during Public Hearings; and,

2. CONSENT CALENDAR: The following more routine matters will be acted upon by
one vote to approve with the majority consent of the City Council. There will be no
separate discussion of these items unless a Council member removes an item from the
Consent Calendar. Items removed will be considered under Agenda Item 4, with public
comment permitted at that time.
(a) Recommendation to approve minutes of the regular meeting of the City Council
held on April26, 2011.
(b) Recommendation to ratify check register and to approve cancellation of certain

(e) Recommendation to adopt a resolution which, consistent with past policy,
establishes a 200-word limit and requires candidates to pay all associated costs with
regard to candidate statements for the November 8, 2011 General Municipal

(f) Recommendation to approve a proposal for third party administration of the City's
workers' compensation claims submitted by YORK Insurance Services Group, Inc.
and authorize the City Manager to negotiate and execute a contract for an
approximate three (3) year term commencing July 1, 2011 with an option for

(g) Recommendation to approve the Subrecipient Agreement between the County of
Los Angeles and the City of Hermosa Beach for the 2010 State Homeland Security
Grant and authorize the City Manager to execute the Agreement and associated
exhibits; and, authorize the appropriation of $34,773 and the corresponding
estimated revenue to the Grant Fund for the reimbursable overtime costs of sending
fire personnel to training for Terrorism Liaison Officer ($28,773) and for the
narrow banding upgrade of the department's portable and mobile radios ($6,000)
following receipt by the City of the executed agreement from the County of Los

(h) Recommendation to approve the purchase of a new in-car camera server from L-3
Communications to replace the current aging computer server from the equipment

document scanning software and hardware from American Micro Imaging, Inc. in

general liability claims submitted by the firm of AdminSure and authorize the City
Manager to negotiate and execute a contract for a three year term commencing
July 1, 2011 with an option to negotiate a two year extension based on performance.

(k) Recommendation to award purchase of twentv-four (24) "Nite Brites/Day-Brites
Lighting" or approved equal floodlights to Walter's Wholesale Electric Company of
Torrance, California in the amount of $10,876.42; and, authorize staff to issue a

(I) Recommendation to adopt resolution approving and adopting the Administering
Agency-State Master Agreement No. 00350S, Program Supplement Agreement No.
143 Rev. 000 for Project SR2SL-5155(011) -Hermosa View Elementary School
SR2S Project that includes improvements on 161h Street from PCH to Prospect Ave.,
Prospect Ave. from 161h to 191h Streets, PCH and 161h Street, and PCH and Pier
Ave.; and, appoint and authorize the Director of Public Works as the authorized
representative of the applicant (City of Hermosa Beach) to act in matters associated

a. ZONING TEXT AMENDMENT REGARDING REGULATIONS
GOVERNING TATTOO/BODY PIERCING STUDIOS. Memorandum from

RECOMMENDATION: Direct staff as appropriate from the following
alternatives:
1. Introduce an ordinance to amend the zoning code regarding regulations
governing Tattoo/Body Piercing Studios as recommended by the Planning
Commission.
2. Introduce an ordinance to amend the zoning code regarding regulations
governing Tattoo/Body Piercing Studios as recommended by the Planning
Commission, but retaining allowance for body piercing.

b. 2011-2012 BUDGET AND CAPITAL IMPROVEMENT PROGRAM.

Budget; approve contracts for services budgeted in the 2011-2012 Budget;

RECOMMENDATION: Adopt resolution setting the 2011-2012
appropriations limit.
c. TERMINATION OF THE FISCAL YEAR 2010-2011 AND 2011-2012
COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) GENERAL
ADMINISTRATION PROJECT AND TRANSFER OF AN ESTIMATED
$9,800 TO THE CITY'S UNALLOCATED CDBG FUNDS. Memorandum

RECOMMENDATION: That the City Council adopt resolution to approve
termination of the Fiscal Year 2010-11 and 2011-12 Community Development
Block Grant (CDBG) General Administration projects.

CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA,

6. MUNICIPAL MATTERS
a. RESOLUTION ADOPTING FEES AND CHARGES FROM THE COST OF
SERVICES STUDY. Memorandum from Finance Director Viki Copeland dated
June 3, 2011.
RECOMMENDATION: Adopt resolution establishing a schedule of fees and
charges for city services and repealing the previous Master Fee Resolution
90-5422 and all amending resolutions.

b. REPORT ON RESTAURANT AND BAR BUSINESS TAX INITIATIVE.
Memorandum from City Manager Stephen Burrell dated June 9, 2011.
RECOMMENDATION: Direct City Clerk to prepare the required documents to
place the restaurant and bar tax initiative without alteration on the
November 8, 2011 municipal election ballot for a vote of the people. The City
Clerk will prepare all final documents and appropriate resolutions for adoption by
the Council at or before the July 24, 2011 Council meeting, which is the last
regular City Council meeting before the County deadline for placing items on the
November ballot.
c. CALLING, REQUESTING CONSOLIDATION, AND CERTAIN OTHER
RESOLUTIONS NECESSARY FOR THE GENERAL MUNICIPAL

e. CONSIDERATION OF AN ORDINANCE FOR THE CITY OF HERMOSA
BEACH APPROVING AN AMENDMENT TO THE MUNICIPAL CODE
TO ADD PROVISIONS FOR REGULATING PARKING OF OVERSIZED
VEHICLES. Memorandum from Police Chief Greg Savelli.
RECOMMENDATION: Introduce on first reading an ordinance amending the
Hermosa Beach Municipal Code to regulate the parking of oversized vehicles and
direct staff to notice a public hearing on the ordinance for the regular Council
meeting of July 12, 2011. Alternatively, take no action on the ordinance, provide
any additional direction relative to the ordinance and direct staff to notice a public
hearing on the ordinance for the regular Council meeting ofJuly 12, 2011.

a. APPOINTMENT TO SOUTH BAY WORKFORCE INVESTMENT
BOARD -JANICE WEBB, VICE PRESIDENT OF CITIBANK
Memorandum from City Manager Stephen Bnrrell dated May 23, 2011.
RECOMMENDATION: That the City Council accept the nomination of
Janice Webb, Vice President of Citibank, to be appointed to serve on the South
Bay Workforce Investment Board as the representative of the Hermosa Beach
private sector for a 4-year term from July 1, 2011 through June 30,2015.
8. MISCELLANEOUS ITEMS AND REPORTS -CITY COUNCIL
a. VACANCIES -BOARDS AND COMMISSIONS -EXPIRATION OF
TERMS. Memorandum from City Clerk Elaine Doerfling dated June 7, 2011.
RECOMMENDATION: That the City Council take action with regard to the
upcoming term expirations. The options are:
1) Appoint/reappoint this evening for four-year terms;
2) Schedule applicant interviews prior to the June 28, 2011 meeting; and/or
3) Direct the City Clerk to re-advertise for additional applicants, with
interviews to be scheduled at a later date.
b. CLARIFICATION OF FOCUS OF STUDY REGARDING PARKING
STANDARDS FOR RESTAURANTS BASED ON OCCUPANCY LOAD.

RECOMMENDATION: Clarity whether to focus on new parking standards for
restaurants based on occupant load, or the connection between occupant load and
efforts to reduce the capacity and impacts of on-sale alcohol establishments.

Requests from Council members for possible future agenda items. No discussion or
debate of these requests shall be undertaken; the sole action is whether to schedule the
item for consideration on a future agenda. No public comment will be taken.
a. Councilman DiVirgilio proposes directing staff to return with a plan to put
an end to chronic public urination taking place during weekend evenings
downtown.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HERMOSA BEACH, CALIFORNIA, ESTABLISHING A
SCHEDULE OF FEES AND CHARGES FOR CITY SERVICES
WHEREAS, the City of Hermosa Beach has conducted an extensive and exhaustive
analysis of its services, the costs reasonably borne of providing those services, the beneficiaries
of those services, and the revenues produced by those paying fees and charges for special
services; and,
WHEREAS, the City wishes to comply with both the letter and the spirit of Article XIIIB of
the California Constitution and limit the growth of taxes; and,
WHEREAS, the City desires to establish a policy of recovering the full costs reasonably
borne of providing services of a voluntary and limited nature, such that general taxes are not
diverted from general services of a broad nature and thereby utilized to subsidize unfairly and
inequitably such voluntary services; and,
WHEREAS, pursuant to Government Code Section 54994.1 the specific fees to be
charged for services must be adopted by the City Council by Resolution, after providing notice
and holding a public hearing; and,
WHEREAS, notice of public hearing has been provided per California Government Code
Section 6062a, oral and written presentations made and received, and the required public
hearing held; and,
WHEREAS, a schedule of fees and charges to be paid by those requesting such special
services need be adopted so that the City might carry into effect its policies; and,
WHEREAS, pursuant to California Government Code Section 6062a a general
explanation of the hereinafter contained schedule of fees and charges has been published as
required; and,
WHEREAS, all requirements of California Government Code Section 54994.1 are
hereby found to have been complied with;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH
DOES RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1. Fee Schedule Adoption. The fees and charges set forth in the Master Fee
Schedule attached hereto as Exhibit A and incorporated herein by reference shall be computed
and applied by the various City departments and collected by the City Finance Department for
the listed services set forth therein when provided by the City or its designated contractors.
Section 2. Separate Fee for Each Process. All fees set forth in the Master Fee
Schedule are for each identified process; additional fees shall be required for each additional
process or service that is requested or required. Where fees are indicated on a per unit of
measurement basis the fee is for each identified unit or portion thereof within the indicated
ranges of such units.

Section 3. Listing of Fees. The Master Fee Schedule attached hereto as Exhibit A and
incorporated herein by reference is hereby adopted as the Master Fee Schedule for the City.
Section 4. Interpretations. Should the City Manager determine there is a conflict
between two fees set forth in the Master Fee schedule, the lower in dollar amount of the two
shall be applied.
Section 5. The City Council shall periodically review the fees and charges in the Master
Fee Schedule.
Section 6. All fees and charges set forth in the Master Fee Schedule shall be
administratively adjusted annually on September 1 of each year commencing September 1,
2013 by the percent change in the Consumer Price Index for All Urban Consumers for the year
ending in the preceding May.
Section 7. Severability. If any part or provision of this Resolution or the application of the
Master Fee Schedule to any person or circumstance is held invalid, the remainder of this
Resolution and the Master Fee Schedule adopted hereby, including the application of such part
of provision to other persons or circumstances, shall not be affected and shall continue in full
force and effect. To this end, the provisions of this Resolution are severable.
Section 8. Repealer. Resolutions 90-5422, 91-5429, 91-5433, 92-5542, 92-5544, 92-
5558, 92-5579, 92-5581, 93-5604, 94-5659, 98-5928, 01-6170, 02-6236, 05-6415, 05-6425, 05-
6431, 07-6525, 07-6534, 07-6537, 07-6562, 08-6583, 08-6598, 08-6625, 09-6631, 09-6651, 09-
6652, 10-6718 and10-6722 are hereby superseded and repealed.
Section 9. Fees Do Not Exceed Cost. As provided in the Cost of Services Study
prepared in connection with the adoption of the Master Fee Schedule, made available for public
review and reviewed by the City Council, the fees set forth in the Master Fee Schedule
approved by this resolution do not exceed the City’s cost of providing the respective services.
Section 10. Effective Date. The fees established in the Master Fee Schedule (Exhibit A)
listed under column entitled “Fees Effective 9/1/11”shall take effect September 1, 2011, which
shall satisfy the requirements of Government Code Section 66017 regarding the fees imposed
on development projects. Fees listed under the column entitled “Fee Effective 9/1/12” shall take
effect September 1, 2012.
