During the meeting, a packet is also available in the Council Chambers foyer. Written materials distributed to the City Council within 72 hours of the City Council meeting are available for public inspection immediately upon distribution in the City Clerk's office at 1315 Valley Drive, Hermosa Beach, California, during normal business hours. All written communications from the public included in the agenda will be posted with the agenda on the City’s website To comply with the Americans with Disabilities Act of 1990, Assistive Listening Devices (ALD) will be available for check out at the meeting. Minutes of this meeting will reflect your participation in this meeting and are posted on the city’s website 2 CALL TO ORDER PLEDGE OF ALLEGIANCE ROLL CALL CANVASS OF VOTES AND INSTALLATION OF OFFICERS CLOSED SESSION REPORT ANNOUNCEMENTS PUBLIC PARTICIPATION: Although the City Council values your comments, the Brown Act generally prohibits the Council from taking action on any matter not listed on the posted agenda as a business item. 1. ORAL AND WRITTEN COMMUNICATIONS This is the time for members of the public to address the City Council on any items within the Council's jurisdiction not on this agenda, on items on this agenda as to which public comment will not be taken, or to request the removal of an item from the consent calendar. Comments on public hearing items are heard only during the public hearing. Members of the audience may also speak: 1) during discussion of items removed from the Consent Calendar; 2) during Public Hearings; and, 3) during discussion of items appearing under Municipal Matters. Comments from the public are limited to three minutes per speaker. The City Council acknowledges receipt of the written communications listed below. (i) Recommendation to award construction contract for CIP Project No. 10-137 Valley Drive Traffic Signal Improvement Project to CT & F, Inc. of Bell Garden, California in the amount of $117,568.11; authorize appropriation of $108,360 HSIP Grant Funds for the project and corresponding revenue; authorize the Mayor to execute and the City Clerk to attest the contract subject to approval by the City Attorney; adopt a resolution approving the design and plans for the construction of CIP Project No. 10-137 Valley Drive Traffic Signal Improvement Project pursuant to Government Code Section 830.6 and establishing a project payment account; and, authorize the Director of Public Works to approve changes within the approved budget amount. (j) Recommendation to receive and file the action minutes of the Planning Commission meeting of November 15, 2011. 4 (k) Recommendation to receive and file report regarding a Brown Act complaint filed by Hany Fangary and the Law Firm of Wolf, Rifkin, Shapiro, Schulman & Rabkin; direct City Attorney to send letter pursuant to Government Code §54960.1(c)(2) communicating the City Council’s determination that the complaint was filed untimely and further that no Brown Act violation occurred and therefore that the City Council will not take further action. Because of an impending curtailment of, or change in the manner of performing service, the best interests of the agency will be served by granting such additional service credit. 2. The added cost to the retirement fund for all eligible employees who retire during the designated window period will be included in the contracting agency’s employer contribution rate for the fiscal year that begins two years after the end of the designated period. 3. It has elected to become subject to Section 20903 because of impending mandatory transfers, demotions, and layoffs that constitute at least 1 percent of the job classification, department or organizational unit, as designated by the governing body, resulting from the curtailment of, or change in the manner of performing, its services. 4. Its intention at the time Section 20903 becomes operative is to keep all vacancies created by retirements under this section or at least one vacancy in any position in any department or other organizational unit permanently unfilled thereby resulting in an overall reduction in the work force of such department or organizational unit. THEREFORE, the City Council of the City of Hermosa Beach hereby elects to provide the benefits of Government Code Section 20903 to all eligible members who retire within the designated period, __January 1, 2012__ through _March 31, 2012.
