The approximate dimensions include 80 feet along Gould and 220 feet deep into the Park along Morningside Street for a total of 17,600 square feet. The vast majority of the proposed park area to be paved is owned by the City and not the School. This area is zoned as Open Space and is also within the Coastal Zone. We would appreciate the following questions answered: --If the City is going to approve any of the current proposals to build North School, the City must first hold public hearings on changing the use of this portion of the Park from Open Space to a parking lot. When does the City plan to have such hearings? --Since the area is zoned as Open Space and is within the Coastal Zone, will the Council require an analysis to minimize the impact on the Park before approving use of it as a parking lot? --There are approximately 103 public parking spots surrounding Valley Park on Gould Street, Valley Drive, and Kiwanis/Rotary club lots--can any of those be used for school parking to prevent paving a parking lot in the Park? Original event permit applications are available on the City’s website under the Dept. of Community Resources tab at http://www.hermosabch.org/index.aspx?page=768 Discovery Channel Fin Fest Parking Plan Update When the Fin Fest event was presented to Council, Discovery Channel requested to use all of Parking Lot A on August 9 & 10, instead of just the 40 spaces normally allotted to the summer concert producer on August 10. As this request raised concerns about available parking for a sizeable event during a busy summer weekend, the Council requested a future pre-event update regarding the parking plan. Since then, Discovery Channel has modified their request for parking spaces in Lot A. They now wish to “return” 50 of the spaces Council had approved, and only use about 60 spaces on the west side of the Lot in the same manner as the summer concerts. They also have made a written request to the school district and plan to offer additional parking at Valley School. In addition, they are working with the summer concerts on locating a bike valet at the event in a manner similar to other events. Please see the attached map which outlines their planned usage of Lot A. FISCAL IMPACT Event fees are assessed according to impact and vary depending upon the event. It is astounding that the city council would waste time discussing shortening city council meetings because some of the recent meeting have lasted into the wee hours of the morning. There is a simple solution: have more meetings or start the council meetings at an earlier hour or both. There is nothing in the law that precludes the council meeting more than twice a month. The proposals outlined by the city manager violate Councilmembers's rights of free speech as well as limiting public comment by residents and other interested parties. There is no need to limit the amount of time that a city councilmember may speak. Our City Councilmembers knew full well when they sought election that meetings could be lengthy. If a person didn't want to put in the required time, that person should not be serving on the city council. I would suggest that if any current member finds that the job is too time consuming because of the job requirements including lengthy meetings that that member resign. Former Torrance City Councilmember Cliff Newmark resigned from the Torrance City Council in December 2013 to serve on the El Camino Community College Board; his reason was that the City Council job was taking too much time away from his being with his family. The town is 450% larger in population and land mass. They have 7 council-members that includes a council-member acting as a mayor. Therefore the need for more time management is warranted with 40% more council- members than Hermosa Beach. Temple City is nothing like Hermosa Beach. It is totally different culture and community. Not a place to copy policy from. Recently they sent a councilman to prison for bribery involving land use rules. We have no need to use such poor examples of good governance. I would like to point out that many resident come into council chambers during a discussion, many times out of breath due to running down from their homes during a public comment. It is part of this communities small town charm. Personally, I have come down during a discussion on several occasions over the last three decades. These written speaker cards will stifle public comment. Is the goal to not hear comments. Why? Because some of you are in a hurry! I am reminded not so long ago, my fellow former councilman, JR Reviscky, came to both a council meeting and commission meeting during discussion to make some very good points that assisted discussion and decision. Will this no longer be allowed with the new rules you are proposing? Will certain people get privileges that will waive all these new rules? I will let you know if these rules come to be, I will personally make it my business to help elect persons who want open meetings with few rules including speaker cards. The city has managed to get through 107 years of city council meeting without a need to set time limits on elected officials opinions, questions or discussions. As our councilmembers you are elected representatives of the community and have earned the right to speak and to engage in lively debate. The best decisions usual come from active and sometimes detailed discussions. Watching and actively participating in Hermosa Beach council activities for 28 years gives me some perspective and experience in this area. Good decisions, good discussions don't have a stop watch on them. Your 3 minutes city council member discussion time limit is not needed or wanted by the public. If efficiency is the goal, start with the city hall organization chart and work from the bottom up. Ending meetings at 10pm is not a good idea unless you increase city council regular meetings to once a week. All of you were elected knowing meetings can go until midnight. If your goal was to end meetings at 10pm, you should have announced that intention while you were campaigning for office so the voters could use that as a way to evaluate your work ethic. Management of the agenda needs to come from the city manager, department heads with some council input. We had this area well managed in the past and I am sure that same program can continue once the oil issue goes to the ballot box. Don't change the city because of an oil drilling application. Hermosa Beach residents don't want to sign up to speak or have the clerk announce their names. For the 28 years witnessed and actively participated it has not been needed. If you want to stifle community input put up these roadblocks, but know you are not being a true Hermosa steward. That kinda stuff is for Redondo Beach and we have seen how that electorate responds with their low voter turnout. If your goal is less public input, implement the suggestions of your staff report. I would suggest you table these changes until after the oil issue is vetted. There will be no need for this type of discussion after the issue is settled. The intent is to provide options for Council to consider and does not represent a recommendation from staff. The staff report does provide a few examples of strategies from other city councils’ operational rules for the business of governing. It also provides a list of options for the City Council to consider that would reduce the need for late night meetings. Please note a correction from the original staff report. There is a reference to “Temple City” which should read “Tempe City.” Attached is a copy of the “Tempe City Rules of Procedure.” Please see page 5, Rule 12 regarding “Limitation of Debate.” The City of Santa Monica has another example of how a city council can choose to put limits on debate when the docket is full. According to their “Rules of Conduct for City Council Meetings,” “RULE 12. RULES OF DEBATE. (i) Limitation of Debate. Councilmembers shall limit their remarks to the subject under debate. No Councilmember shall be allowed to speak more than once upon any particular subject until every other Councilmember desiring to do so has spoken. Responses to questions asked by Members of Council shall not be included in the three-minute time limit. E&B Natural Resources Attorney Nicki Carlsen also emailed a letter to City Attorney Mike Jenkins on June 17, 2014 at 5:19 p.m. The letter from Nicki Carlsen is shown as a Supplemental to the Final EIR Study Session Agenda under Item 4. Some of the items listed in this letter are in reference to the Final EIR. Included below please find updates from the City of Hermosa Beach regarding our communication addressing points listed in both letters. City of Hermosa Beach Communication Points Regarding the Final EIR  E&B Natural Resources Management Corporation (“E&B”) filed an application with the City for its proposed oil drilling and production project on November 14, 2012, more than 8 months after execution of the settlement agreement that ended the litigation between the City and Macpherson Oil Company. Since that application was deemed complete by the City, the City has proceeded with E&B’s knowledge and acquiescence to process the application with the expectation that the project would be placed before the voters at the earliest feasible time allowed upon satisfaction of legal requirements.  The City’s consultant was provided sufficient time to prepare a thorough Environmental Impact Report (EIR). The City has gone above and beyond minimum requirements of State law for review of the draft EIR, extending public review from 45 days (required by law) to 60 days. The City also offered numerous study sessions and meetings to review the content in the draft EIR with the public and the Applicant.  During preparation of the Draft EIR the City’s consultants interacted frequently with E&B to discuss substantive matters related to their proposed project. These communications covered the proposed project’s methods for addressing a range of environmental issues, including: parking, visual impacts, noise, risk, air quality and odors, truck traffic, equipment separation and flare placement, etc. Following release of the Draft EIR, E&B provided 330 comments along with voluminous technical information, all of which was reviewed and evaluated by the EIR consultant’s technical team. The EIR consultant then met with E&B and its team of consultants to discuss findings and changes integrated into the Final EIR in response to E&B’s submitted information.  With the final EIR having been made available for review starting on June 10, the City has allocated more than the time period required by law for review of the final EIR prior to certification of the EIR, and sufficient time for E&B and the public to review the document. A joint Planning Commission/City Council study session has been scheduled for June 18 to allow for further explanation of the FEIR and an opportunity for questions and comment from all interested parties. The schedule set by the City will allow the City to comfortably certify the Final Environmental Impact Report (FEIR) on July 8, 2014, a date that has been widely announced.  A proposed Development Agreement has been prepared for inclusion in the ballot measure scheduled to go to the voters. While all of the details have not yet been worked out, the City is confident that there is ample time to tie up loose ends by the July 22 Council meeting, when the Council is scheduled to adopt a resolution placing the measure on the November 2014 ballot.  Two supplemental studies commissioned by the City to evaluate impacts of the proposed oil project not directly addressed in the FEIR includes a Health Impact Assessment (HIA) prepared by McDaniel Lambert, Inc. (an Intrinsik Company) and a Cost Benefit Analysis (CBA) prepared by Kosmont Companies. o These two reports, also prepared by independent consultants selected by the City, evaluate potential effects of the project on community health and the financial costs and benefits posed by the proposed project. o These reports are not required by law for the City Council to proceed with the Public Hearing to consider adoption of a resolution to place the measure on the ballot; nor are they required for certification of the Final EIR. o The reports are informational in nature and the public will have plenty of opportunity to review, evaluate and debate the contents of both the final HIA and CBA prior to the November election.  The City agrees that the public should be accorded sufficient time to consider and weigh all of the information available about this project. The City has expended considerable resources to assure that all of the necessary information will be generated and disseminated in a manner as to accomplish that goal and allow the people to make this important decision at the November 2014 special election.
