The public is invited to attend and provide public comment. Public comments are limited to two minutes per speaker and shall only be taken from those present in the Council Chambers. No remote public comment will be taken during this time unless required by the Brown Act. A total of thirty minutes will be allocated to this initial public participation item. This time allotment may be modified due to time constraints at the discretion of the Chair. Planning Commission members may orally register a negative vote on any consent calendar item without pulling the item for separate consideration prior to the vote on the consent calendar. There will be no separate discussion of these items unless a Commission member removes an item from the Consent Calendar prior to the vote on the consent calendar item. Items removed will be considered under a latter agenda item, with only in-person public comment permitted at that time in the Chambers. The title is deemed to be read and further reading waived of any resolution or ordinance listed on the consent calendar for introduction or adoption. Recommendation: To approve the consent calendar. 6.a ACTION MINUTES OF THE PLANNING COMMISSION REGULAR MEETING OF APRIL 15, 2025 - 25-CDD-075 6 (Administrative Assistant Melanie Hurtado) Recommendation: Staff recommends Planning Commission receive and file the action minutes of the Planning Commission regular meeting of April 15, 2025. 7.PUBLIC HEARING Page 3 of 115 7.a CONTINUANCE REQUEST FOR 3415 PALM DRIVE - 25-CDD-085 12 (Associate Planner Jake Whitney) On May 2, 2025, the project applicant requested a one-month continuation of the hearing. Recommendation: Staff recommend that the Public Hearing for 3415 Palm Drive be postponed until the Planning Commission regular meeting of June 17, 2025, per the applicant’s request. 7.b CONDITIONAL USE PERMIT TO ALLOW ON-SALE CONSUMPTION OF BEER ONLY AT 1601 PACIFIC COAST HIGHWAY SUITE 180 IN THE SPA-8 ZONE. - 25-CDD-066, 25-CDD-084 18 CEQA: Determine that the project is categorically exempt from the California Environmental Quality Act. Adopt a Resolution (Attachment 1) approving the Conditional Use Permit (CUP25-02) to allow on-sale consumption of alcoholic beverage (beer only) at 1601 Pacific Coast Highway Suite 180 , subject to conditions. 2. 7.c REQUEST FOR CUP AMENDMENT (APE24-003) TO EXPAND ON- SALE ALCOHOLIC BEVERAGES ALLOWED TO BEER, WINE, AND DISTILLED SPIRITS; AND AMEND PRIOR CONDITION OF APPROVAL FOR AN EXISTING RESTAURANT AT 844 HERMOSA AVENUE IN THE (C-2) ZONE - 25-CDD-084 47 CEQA: Determine the project is exempt from the California Environmental Quality Act. (Assistant Planner Johnny Case) Recommendation: Staff recommends that the Planning Commission: Determine that the project is categorically exempt per Section 15301 of California Environmental Quality Guidelines; and 1. STAFF ITEMS 8.a COMMUNITY DEVELOPMENT DIRECTOR REPORT Planning Manager Alexis Oropeza reported that the parking plan for 1601 PCH was called up for review by the City Council and would be scheduled for a hearing in May. ZTA for temporary uses and events, City Council took action to approve the item with modifications to expand maximum number of dates for temporary events to 72 days annually; modified seasonal sales lots to allow one per year for each property; amendment to modify lighting restrictions to allow for moving lights while maintaining the restriction on flashing lights; temporary minor special event permits in the M1 Zone, an additional requirement that any events in the M1 Zone would have to have an indoor and outdoor component, with the indoor component being not less than 50% of the area of the outdoor. This will go back to City Council for second reading in May. The upcoming Planning Commission meeting on May 20th should include 901 Hermosa Avenue, although there are a few items they are trying to work through in order to get on the May agenda. The Builders’ Remedy project located at 3415 Palm Drive will also be on the May agenda, and the Capital Improvement Projects will come before the Planning Commission to determine conformance with the City’s General Plan. There will be a Study Session on Limited Entertainment for Zoning Text Amendments. 9. PLANNING COMMISSION COMMENTS 10. Public Notification: For the March 18, 2025 Planning Commission hearing, a total of 199 public hearing notices were mailed to the applicant, occupants, and property owners of properties within a 300-foot radius on March 4, 2025. A hearing notice was posted on site, and a legal ad was published on March 6, 2025 in the Easy Reader, a newspaper of general circulation. The matter was continued by the Planning Commission to May 20, 2025. As an agenda item continued to a date certain, no further public notification was required. However, due to the high level of community interest, public hearing notices were again mailed to the applicant, occupants, and property owners of properties within a 300-foot radius on May 5, 2025. Hermosa Pavilion is governed by various entitlements, some governing the site at large and other governing individual uses within the shopping complex. The pedestrian entrance to Hermosa Pavilion, is located on the front side facing Pacific Coast Highway, while the entrance to the parking structure is located on 16th Street. To allow for the sale of alcoholic beverages (beer only), the applicant intends to seek a Type 40 license from the California Department of Alcoholic Beverage Control (ABC). The applicant proposes to enhance the virtual golfing experience to members and guests by making alcoholic beverages available to patrons. The proposed hours of operation are Monday-Saturday from 9 a.m. to 9 p.m., and Sunday from 9 a.m. to 3 p.m. Discussion: Site Plan and Floor Plan: The existing site is developed as a tenant space in a multi-tenant shopping center. The overall site configuration would remain unchanged by this CUP. There are no floor plan changes proposed as part of this application (Attachment 2 and 3). The project proposes expanding the services offered to include on-sale consumption of alcoholic beverages (beer only) to members and guests. The hours of operation are as follows: Monday-Saturday from 9 a.m. to 9 p.m., and Sunday from 9 a.m. to 3 p.m. The proposed hours are not considered late-night as the business would not operate past 11 p.m. In addition to serving beer during business hours the applicant (South Bay Golf Club) Page 21 of 115 City of Hermosa Beach | Page 5 of 10 would be limiting the consumption of beer of guests through the built in time limit of the bay rental system. Beer would only be sold in cans, draft or bottled beer would not be offered. There would be no self-service or bar seating, beer would only be provided upon request at the reception desk. The floor plan (Attachment # 3) calls out the service location located behind the reception desk as well as the beer storage area. The designated storage room would remained locked at all times and would only be accessible to authorized staff members. Interdepartmental Review: As part of the Community Development Department’s standard review process, this application was reviewed by various city departments, including: Police, Building and Safety, Public Works, and the Environmental Programs Manager in the City Manager’s office. The Police Department does not object to the proposed CUP subject to the conditions of approval set forth in the draft Resolution (Attachment 1). Conditional Use Permit (CUP) Review Criteria and Findings In accordance with Hermosa Beach Municipal Code (HBMC) Section 17.26.030, on-sale alcoholic beverage serving establishments are subject to a Conditional Use Permit. In considering the granting of a Conditional Use Permit, general criteria for all uses shall be made pursuant to HBMC 17.56.040. General Criteria for all CUP uses 1. Distance from existing residential uses. The subject site is located on Pacific Coast Highway in an SPA-8 zone. Multi-family residences are located to the north and west of the site. The residences located directly adjacent to the property are buffered from the site, as the entrance to the Hermosa Pavilion is located on the east side of the building, and service of alcohol would be limited to within the tenant space within the Hermosa Pavilion. 2. The amount of existing or proposed off-street parking facilities, and its distance from proposed use. The provided parking is located within the Hermosa Pavilion which provides an enclosed parking garage to serve the multi-tenant commercial complex. The proposed use does not require additional parking. 3. Location of and distance to churches, schools, hospitals, and public playgrounds: The subject site is located approximately 0.5 miles to the nearest school (Hermosa Valley School), approximately 6.2 miles to the nearest hospital Kindred Hospital, approximately 0.7 miles from the nearest church (Christian Science Church), and Page 22 of 115 City of Hermosa Beach | Page 6 of 10 0.8 miles from the nearest playground (Noble Park). The service of alcohol at the subject site would not have a significant effect on these uses. 4. The combination of uses proposed: The proposed use modification is consistent with the desired development pattern and uses within the Pacific Coast Highway Corridor. The proposed allowance for on-sale alcohol would provide more amenities and serve local residents as well as visitors, with minimal impact on adjacent properties. 5. Precautions taken by the owner or operator of the proposed establishment to assure the compatibility of the surrounding uses: Due to the sale and service of alcohol, there is a potential for boisterous and rowdy behavior by patrons of the business. However, the establishment intends to close at 9:00 pm Mondays through Saturdays and 3:00pm on Sundays and is not proposing to sell liquor or distilled spirits. These considerations/precautions would help ensure that the establishment is compatible with the surrounding commercial and residential uses and would not contribute to an increase in late-night alcohol- serving establishments. 6. The relationship of the proposed business-generated traffic volume and the size of streets serving the area: There would not be a greatly increased volume of traffic as a result of the approval of this project. This proposal is consistent with other similar commercial establishment in the surrounding area and does not feature any characteristics that would result in an unusual or disproportionate traffic impact. 7. The number of similar establishment or uses within close proximity to the proposed establishment: While there are no similar establishments within proximity to the proposed establishment, there are however several commercial establishments are located within the shopping center the subject site is located within. 8. Noise, odor, dust and/or vibration that may be generated by the proposed establishment: The virtual golf facility is located entirely within a severed, sound insulated building with entry only from a common lobby. Any potential noise generated from the establishment would not negatively impact the adjacent residential uses. 9. Impact of the proposed use to the city’s infrastructure, and/or services: The sale of alcoholic beverages has the potential to impact public safety services. However, the establishments’ sale of alcoholic beverages would be limited to beer only. The low ABV context of the beverages sold on site is expected to not require Page 23 of 115 City of Hermosa Beach | Page 7 of 10 high demand of public safety services due to the lessened potential for patrons to reach heightened levels of intoxication. 10. Will the establishment contribute to a concentration of similar outlets in the area: The subject site is surrounded by a variety of fitness, retail and service type uses. None offer a golf simulation experience as what is being offered at this site. Furthermore, the sale of alcoholic beverages is considered secondary to the primary use of the golf simulator experience. 11. Other consideration that, in judgment of the planning commission, are necessary to assure compatibility with the surrounding uses, and the city as a whole. No other issues are identified. Findings: The General Criteria are used to help inform the five required CUP findings all of which must be made pursuant to HBMC 17.56.050. 1. The proposed use is allowed within the applicable zone and complies with all other applicable provisions of this Title and all other titles of the Hermosa Beach Municipal Code; The proposed use to allow for on-sale alcoholic beverages (beer only) is allowed withing the Specific Plan Area 8 (SPA-8) zone with approval of a Conditional Use Permit. The use is compliant with the zoning ordinance and all other titles in the municipal code. 2. The proposed use is consistent with the General Plan and any applicable specific plan; The project site is located within the Pacific Coast Highway corridor, and as a primary entry point into Hermosa Beach aims to provide a variety of uses. The proposed allowance for on-sale service and alcohol consumption would provide an additional amenity and serve residents and visitors, with minimal impact on adjacent properties. 3. The proposed use will not be averse to the public health, safety, or general welfare of the community, nor detrimental to surrounding properties or improvements; The proposed allowance for alcoholic beverage sales would serve as accessory to the primary virtual golf facility use. The proposed use would not be averse to the public health, safety, or general welfare of the community or detrimental to surrounding properties or improvements as conditioned. The hours of operation Page 24 of 115 City of Hermosa Beach | Page 8 of 10 would be limited to Monday-Saturday from 9 a.m. to 9 p.m., and Sunday from 9 a.m. to 3 p.m. 4. The design, location, size and operating characteristics of the proposed activity are compatible with the existing and reasonably foreseeable future land uses and circulation on the vicinity; and The design, location, size and operating characteristics of the virtual golf facility are compatible with the existing and reasonably foreseeable future land uses and circulation in the vicinity. The proposed use would not result in any physical changes to the existing establishment. 5. The site is physically suitable for the type of use being proposed, including access, utilities and the absence of physical constraints. There would be no change in the physical structure, nor are there any constraints on the site that would render the site unsuitable. The proposed use of alcoholic beverages sales would complement the existing virtual golf facility. CUP Specific Criteria Should the Planning Commission find that the aforementioned findings can affirmatively be made to approve the CUP amendment to allow the sale of beer only, then it should consider the conditions of approval and any other it deems necessary to ensure the use operates in a manner compatible with existing and future uses in the area. HBMC Section 17.40.080 establishes the following minimum conditions and standards for all on-sale alcoholic beverage establishments. 1. The establishment shall not adversely affect the welfare of the residents. And/or commercial establishments nearby. 2. The business shall prevent loitering, unruliness and boisterous activities of the patrons outside the business or in the immediate area. 3. The Police chief may determine that a continuing police problem exists and may, subject to appeal to the Planning Commission, direct the presence of a police approved doorman and/or security personnel to eliminate the problem. An appeal to the Planning Commission shall be heard within sixty (60) days of filing the appeal. The Police Chief’s determination will not be stayed during the pendency of the appeal. If the problem persists, the police Chief then shall submit a report to the Planning Commission, which will automatically initiate a review of the conditional use. 4. The exterior of the premises shall be maintained in a neat and clean manner and free of graffiti at all times. 5. Any changes to the interior or exterior layout that alter the primary function of the business shall be subject to review and approval by the Planning Commission. General Plan Consistency: Page 25 of 115 City of Hermosa Beach | Page 9 of 10 This report and associated recommendations have been evaluated for their consistency with the City’s General Plan. Relevant Policies are listed below: General Plan Consistency Land Use Element Findings Goal 1. Create a sustainable urban form and land use patterns that support a robust economy and high quality of life for residents. The proposal put forth is consistent with policy 1.5 as the project promotes quality coastal uses, with minimal impact to adjacent residential properties. Specifically, the project proposes serving alcohol to patrons in order to provide a premium gold experience to members and guests only. Policy 1.5 Balance resident and visitor needs. Ensure land uses and business provide for needs of residents as well as visitors. Goal 3. A series of unique, destination- oriented districts throughout Hermosa Beach. The proposal put forth is consistent with policy 3.3 as the project contributes to a diverse retail landscape by offering residents and visitors a brand-new high- tech recreation/retail center. Policy 3.3 Provide incentives to transform existing single-use commercial properties that are accessible into retail destination by adding a diversity of uses, providing new pedestrian connections to adjacent residential areas, reducing the visual prominence of parking lots, making the center more pedestrian-friendly and enhancing the definition and character of the street frontage and associated streetscapes. Environmental Determination: Pursuant to the California Environmental Quality Act (CEQA), the proposed project qualifies for a Class 1 categorical exemption, Existing Facilities, as defined in section 15301 of the CEQA Guidelines, as the scope of the CUP would not affect the physical condition of the site. Moreover, none of the exceptions to the categorical exemption(s) apply, nor would the project result in a significant cumulative impact of successive projects of the same type in the same place over time or have a significant effect on the environment due to unusual circumstances or damage a scenic highway or scenic resources within a state scenic highway. Public Notification: Public notice was given for the May 20, 2025, Planning Commission hearing; a total of 953 public hearing notices were mailed to the applicant, and occupants and property owners of properties within a 500-foot radius on May 6, 2025. A legal ad was published on May 8, 2025 in the Easy Reader, a newspaper of general circulation. The relationship of the proposed business-generated traffic volume and the size of streets serving the area: Volume of traffic will not significantly increase as a result of the approval of this project. This proposal is consistent with other similar commercial establishment in the surrounding area and does not feature any characteristics that would result in an unusual or disproportionate traffic impact. 7. The proposed exterior signs and decor, and the compatibility thereof with existing establishments in the area: There is no new exterior signage proposed as part of this project. 8. The number of similar establishment or uses within close proximity to the proposed establishment: While there are no similar establishments within proximity to the proposed establishment, there are however several commercial establishments are located within the shopping center the subject site is located within. Page 30 of 115 Page 4 of 12 RES NO. 25- 9. Noise, odor, dust and/or vibration that may be generated by the proposed use: The virtual golf facility is located entirely within a severed, sound insulated building with entry only from a common lobby. Any potential noise generated from the establishment would not negatively impact the adjacent residential or commercial uses. 10. Impact of the proposed use to the city’s infrastructure, and/or services: The sale of alcoholic beverages has the potential to impact public safety services. However, the establishments’ sale of alcoholic beverages would be limited to beer only. The low ABV context of the beverages sold on site is expected to not require high demand of public safety services due to the lessened potential for patrons to reach heightened levels of intoxication. 11. Will the establishment contribute to a concentration of similar outlets in the area: The subject site is surrounded by a variety of fitness, retail and service type uses. None offer a golf simulation experience as what is being offered at this site. Furthermore, the sale of alcoholic beverages is considered secondary to the primary use of the golf simulator experience. 12. Other consideration that, in judgment of the planning commission, are necessary to assure compatibility with the surrounding uses, and the city as a whole. No other issues are identified. SECTION 2. Based on the testimony and evidence received at its May 20, 2026 Planning Commission meeting, the Planning Commission finds, determines and declares the following pertaining to the application for a Conditional Use Permit under Hermosa Beach Municipal Code Section 17.56.050: Findings: The General Criteria are used to help inform the five required CUP findings all of which must be made pursuant to HBMC 17.56.050. Page 31 of 115 Page 5 of 12 RES NO. 25- 1. The proposed use is allowed within the applicable zone and complies with all other applicable provisions of this Title and all other titles of the Hermosa Beach Municipal Code; The proposed use to allow for on-sale alcoholic beverages (beer only) is allowed within the Specific Plan Area 8 (SPA-8) zone with approval of a Conditional Use Permit. The use is compliant with the zoning ordinance and all other titles in the municipal code. 2. The proposed use is consistent with the General Plan and any applicable specific plan; The project site is located within the Pacific Coast Highway corridor, and as a primary entry point into Hermosa Beach aims to provide a variety of uses. The proposed allowance for on-sale service and alcohol consumption would provide an additional amenity and serve residents and visitors, with minimal impact on adjacent properties consistent with Specific Plan Area 9. The proposed use is consistent with the following Goals and Policies of the General Plan: General Plan Consistency Land Use Element Findings Goal 1. Create a sustainable urban form and land use patterns that support a robust economy and high quality of life for residents. The proposal put forth is consistent with policy 1.5 as the project promotes quality coastal uses, with minimal impact to adjacent residential properties. Specifically, the project proposes serving alcohol to patrons in order to provide a premium gold experience to members and guests only. Policy 1.5 Balance resident and visitor needs. Ensure land uses and business provide for needs of residents as well as visitors. Goal 3. A series of unique, destination- oriented districts throughout Hermosa Beach. The proposal put forth is consistent with policy 3.3 as the project contributes to a diverse retail landscape by offering residents and visitors a brand-new high- tech recreation/retail center. Policy 3.3 Provide incentives to transform existing single-use commercial properties that are accessible into retail destination by adding a diversity of uses, providing new pedestrian connections to adjacent Page 32 of 115 Page 6 of 12 RES NO. 25- residential areas, reducing the visual prominence of parking lots, making the center more pedestrian-friendly and enhancing the definition and character of the street frontage and associated streetscapes. 3. The proposed use will not be averse to the public health, safety, or general welfare of the community, nor detrimental to surrounding properties or improvements; The proposed allowance for alcoholic beverage sales would serve as accessory to the primary virtual golf facility use. The business will be required to abide by conditions of approval incorporated into the Resolution (Attachment 1) which are intended to mitigate and prevent potential adverse impacts to the community. As conditioned, the proposed use would not be averse to the public health, safety, or general welfare of the community or detrimental to surrounding properties or improvements as conditioned. The hours of operation would be limited to Monday-Saturday from 9 a.m. to 9 p.m., and Sunday from 9 a.m. to 3 p.m. 4. The design, location, size and operating characteristics of the proposed activity are compatible with the existing and reasonably foreseeable future land uses and circulation on the vicinity; and The design, location, size and operating characteristics of the virtual golf facility are compatible with the existing and reasonably foreseeable future land uses and circulation in the vicinity. The proposed use would not result in any physical changes to the existing establishment. 5. The site is physically suitable for the type of use being proposed, including access, utilities and the absence of physical constraints. There would be no change in the physical structure, nor are there any constraints on the site that would render the site unsuitable. The proposed use of alcoholic beverages sales would complement the existing virtual golf facility. Page 33 of 115 Page 7 of 12 RES NO. 25- SECTION 3. Based on the foregoing findings, the Planning Commission hereby approves Conditional Use Permit 25-02 for the sale of beer for on-site consumption as set forth in Planning Commission Resolution 25-07 subject to the following Conditions of Approval: 1. The project shall be substantially consistent with the application submitted and approved by the Planning Commission on May 20, 2025. The applicant shall retain records of the approved floor plan until any subsequent modifications or approvals are granted. a. The storage of alcoholic beverages shall be restricted to the two (2) areas shown on the floor plan and shall be no more than 3.2 cubic feet each. 2. A manager who is aware of the conditions of this Conditional Use Permit shall be on the premises during business hours. The Conditional Use Permit shall be maintained on the premises in a location where employees can easily read the conditions. 3. Should the property be sold or otherwise come under different ownership, any future owners or assignees shall be notified of the conditions of this approval by either the current business owner, property owner, or the leasing agent. 4. The permitted hours of operation shall be 9 a.m. to 9 p.m. Monday through Saturday and 9a.m. to 3 p.m. on Sundays. 5. The following signs shall be posted in a conspicuous location in a readily visible manner, warning patrons of the illegality of selling alcoholic beverages to persons under twenty-one years of age, loitering and drinking within the public realm, and removing alcoholic beverages from the premises, and carrying: a. “California State Law prohibits the sale of alcoholic beverages to persons under twenty-one years of age” b. “No Loitering or Public Drinking” c. “It is illegal to possess an open container of alcohol in the vicinity of this establishment” Page 34 of 115 Page 8 of 12 RES NO. 25- 6. Management shall successfully complete ABC Licensee Education on Alcohol and Drugs (LEAD) training and Responsible Beverage Servers Training, or equivalent as determined by Chief of Police. Training shall be completed within 30 days of final approval of the CUP and within 30 days of the employee's start of employment. The business shall maintain records that management has participated in the required training. Records shall be maintained for two years after training and be available upon request for review by the Community Development Director, Chief of Police, or designee. 7. All employees engaged in the sale or service of alcoholic beverages shall complete Responsible Beverage Service Training, or equivalent as determined by the Chief of Police, within 30 days of final approval of the CUP and 30 days of start of employment. The business shall maintain records that management and employees have participated in the required trainings. Records shall be maintained for two years after training and be available upon request by the Community Development Director, Chief of Police, or designee. 8. The business shall not adversely affect the welfare of the residents, and/or commercial establishments nearby. 9. Live entertainment shall be prohibited unless otherwise permitted by the City. 10. The business shall install and maintain a video surveillance system that monitors within the interior of the business and the Immediate Area. The video system must be capable of delineating on playback the activity and physical features of persons and areas within the premises and Immediate Area. Recordings shall be retained for a minimum of sixty (60) days and video will be available to Police Department upon request. All video security cameras shall be installed to the satisfaction of the Chief of Police. At the discretion of the Chief of Police, Licensee may be required to add additional video cameras. 11. Under no circumstances shall furniture or other interior/exterior improvements be rearranged from the floor plan attached to the CUP Amendment to accommodate dancing, more entertainment, or greater occupant load absent approval by the Chief of Police, or the Planning Commission. Page 35 of 115 Page 9 of 12 RES NO. 25- 12. Trash receptacles for patrons shall be conveniently located both inside and outside of the establishment, however, not located on or within any public property or right-of-way. 13. The business with on-sale alcoholic beverage service may be subject to a periodic review process established by the City to verify conformance with the conditions of approval. 14. The business shall maintain in conformance with all other applicable City of Hermosa Beach and regulatory agency requirements and standards, including but not limited to: California Department of Alcoholic Beverage Control, Los Angeles County Health Department, California Disabled Access Standards (Government Code Title 24), and Los Angeles County National Pollutant Discharge Elimination System Permit (NPDES). 15. The business shall be maintained and operated in full compliance with the conditions of this CUP and any law, statute, ordinance, or other regulation hereafter adopted that is applicable to any development or activity on the subject property. Failure of the permittee to cease any development or activity not in full compliance shall be a violation of these conditions. 16. The permittee is required to acquire a Type-40 license issued by the California Department of Alcoholic Beverage Control. 17. The project site shall be the point-of-sale for the purpose of collecting any sales tax on goods that are sold, delivered or rented on the site. 18. Any changes to the interior or exterior layout which alter the primary function of the business shall be subject to review and approval by the Planning Commission. Minor modifications that do not alter the primary function of the business may be approved by the Community Development Director. 19. In addition to any other remedy provided by law, if the business operating pursuant to this CUP violates any condition of this CUP, the Police Chief or designee may Page 36 of 115 Page 10 of 12 RES NO. 25- meet and confer with the business to clarify the reason for the violation and to formulate a course of action to mitigate the risk for any future violation. If the business operating pursuant to this CUP continues to violate this CUP (i.e., either a repeat violation or another violation) within any six (6) month period following a meet and confer with the Police Chief, then, at the sole discretion of the Police Chief, modified or additional operational requirements may be imposed by the Police Chief to curtail the violations until the time that the matter is brought before the Planning Commission. These modified or additional operational requirements include, but are not limited to, a reduction in operating hours, required number of staff members during operating hours, additional training for existing staff, and/or any other measures deemed appropriate by the Police Chief. The Planning Commission shall consider any modification or additional requirement(s) imposed by the Police Chief during its discussion of the matter. The Police Chief’s determination will remain in effect until considered by the Planning Commission. 20. The Planning Commission may review this Conditional Use Permit and may revoke the permit, amend the subject conditions, or impose any new conditions if deemed necessary to mitigate detrimental effects on the neighborhood resulting from the subject use. 21. Approval of this permit shall expire twenty-four (24) months from the date of approval by the Planning Commission, or final decision by the City Council, unless significant construction or improvements or the use authorized hereby has commenced. One or more extensions of time may be requested. No extension shall be considered unless requested in writing to the Community Development Director, including the reason therefore, at least 60 days prior to the expiration date. No additional notice of expiration will be provided. 22. To the extent permitted by law, Permittee shall defend, indemnify and hold harmless the City of Hermosa Beach, its City Council, its officers, employees and agents (the “indemnified parties”) from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void any permit or approval for this project authorized by the City, including (without limitation) reimbursing the City its actual Page 37 of 115 Page 11 of 12 RES NO. 25- attorney’s fees and costs in defense of the litigation. The City may, in its sole discretion, elect to defend any such action with attorneys of its choice. The permittee shall reimburse the City for any court and attorney's fees which the City may be required to pay as a result of any claim or action brought against the City because of this permit. Although the permittee is the real party in interest in an action, the City may, at its sole discretion, participate at its own expense in the defense of the action, but such participation shall not relieve the permittee of any obligation under this condition. 23. Each of the above conditions is separately enforced, and if one of the conditions of approval is found to be invalid by a court of law, all the other conditions shall remain valid and enforceable. SECTION 4. The Planning Commission finds that the project is categorically exempt from the California Environmental Quality Act (CEQA), as defined in Section 15301 of the State CEQA Guidelines, Class 1 Categorical Exemption, Existing Facilities, as the project consists of the operation and permitting of existing private structures which involve negligible or no expansion of existing use. More specifically, the approval of the Conditional Use Permit results in no physical change to the existing structure. Moreover, none of the exceptions to the categorical exemption(s) apply to the project, as defined in section 15300.2 of the State CEQA Guidelines. The project would not result in a significant cumulative impact of successive projects of the same type in the same place over time; the project would not have a significant effect on the environment due to unusual circumstances; the project would not damage a scenic highway or scenic resources within a state scenic highway; the project is not located on a hazardous waste site; and the project would not cause a substantial adverse change in the significance of a historical resource. SECTION 5. Pursuant to the Code of Civil Procedure Section 1094.6, any legal challenge to the decision of the Planning Commission, after a formal appeal to the City Council, must be made within 90 days after the final decision by the City Council. (Assistant Planner Johnny Case) Recommended Action: Staff recommends that the Planning Commission: 1. Determine that the project is categorically exempt per Section 15301 of California Environmental Quality Guidelines; and 2. Adopt a Resolution (Attachment 1) approving Conditional Use Permit Amendment (APE24-003) to allow the applicant to expand the on-sale alcoholic beverages allowed from beer and wine only to beer, wine, and distilled spirits at 844 Hermosa Avenue, subject to conditions of approval. Executive Summary: The following is a request for a Conditional Use Permit (CUP) amendment to modify the existing approval for on-sale alcoholic beverages from beer and wine only to beer, wine, and distilled spirits. The applicant has also requested removal of an existing condition of approval (COA). The COA requires the restaurant to provide a bicycle rack for a minimum of six (6) bikes. Staff recommends that the Planning Commission approve a CUP amendment with conditions of approval. Background: The project is located at 844 Hermosa Avenue between 10th Street and 8th Street within the south end of the Downtown district in Hermosa Beach (the project site). The project involves a 4,220-square-foot existing restaurant located on Hermosa Avenue. The project site is designated as Community Commercial (CC) in the General Plan and is zoned as General Commercial (C-2). The project site is located within the Coastal Zone boundary. To the east, across the alley, are multi-family residential uses. Office uses are located to Page 47 of 115 the north and south of the project site. The public entrance of the building is oriented towards Hermosa Avenue. There is no public entrance or windows for residential use. The Planning Commission first approved a CUP and Precise Development Plan (PDP) allowing on-sale beer and wine in 1996 through PC Resolution 96-13. This original CUP was then revoked in 2007 through PC Resolution 07-15. In 2008 the Planning Commission approved a new CUP allowing on-sale beer and wine and outdoor dining though PC Resolution 08-26. The CUP has been amended multiple times since 2008. The most recent CUP modification occurred in 2020 with the Planning Commission’s approval of modifications to the floor plan, conditions of approval (COA), and reduction of hours. A summary table of the prior meetings and actions regarding the project are included below for reference. The applicant proposes expanding the on-sale alcohol at the existing restaurant from beer and wine only (Department of Alcoholic Beverage Control Type 41) to beer, wine, and distilled spirits (Department of Alcoholic Beverage Control, Type 47). In conjunction with the modification of on-sale alcohol, the applicant proposes the removal of Condition 30 of Resolution 20-23, which requires a bicycle rack for a minimum of six bikes be provided. Page 49 of 115 Discussion: Site Plan and Floor Plan: The project site is developed with an existing two-story building. The overall site configuration would remain unchanged by this CUP amendment and no floor plan changes have been proposed as part of this amendment. However, the applicant has requested to eliminate Condition 30 of Resolution No. 20-23, requiring the applicant to provide a bicycle rack for a minimum of six bikes. The restaurant is built to the property line on three (3) sides of the building (south, west and north), with parking located on the east side of the building off the alley. These conditions limit the viable location of a bicycle rack without reducing floor area within the building and the business is not in compliance with this condition of approval. Staff does not recommend the elimination of the condition of approval, as it is contrary to the goals and policies of the General Plan. However, staff does recommend incorporating the bicycle parking within the public right-of-way in an inactive area just south of the dining deck along Hermosa Avenue as indicated in the project plans (Attachment 2). Operations: The applicant requested to amend the CUP to allow an expansion of on-sale alcoholic beverages from beer and wine only to beer, wine, and distilled spirits. The current operating hours of the restaurant are 7 am to 11 pm daily for all restaurant operations. The applicant is not seeking a modification to the operating hours and would not contribute to the intensification of late-night establishments in the area. Late-night establishments are defined in HBMC 17.40.080 (B) as an establishment operating past 11pm. The total of four (4) late-night establishments in close proximity to the project site will remain. The modification of the alcohol license type from beer and wine (ABC Type 41) to beer, wine, and distilled spirits (ABC Type 47) would result in an increase the total amount of ABC Type 47 license operators from three (3) to four (4). Interdepartmental Review As part of the Community Development Department’s standard review process, this application was reviewed by various city departments, including the Police Department, Building and Safety, Public Works, and the Environmental Programs Manager in the City Manager’s office. The Police Department does not object to the proposed CUP, subject to conditions of approval that have been incorporated into the draft Resolution (Attachment 1). The Public Works Department reviewed the project and is supportive of the proposed location for the required bicycle rack, with the conditions of approval Page 50 of 115 requiring the applicant to obtain an encroachment permit and approval of the type of bike rack before installation. Conditional Use Permit (CUP) Review Criteria and Findings In accordance with Hermosa Beach Municipal Code (HBMC) Section 17.26.030, on-sale alcoholic beverage serving establishments are subject to a Conditional Use Permit. In considering the granting of a Conditional Use Permit, general criteria for all uses shall be made pursuant to HBMC 17.56.040. The General Criteria are used to help inform the five required CUP findings which must be made pursuant to HBMC 17.56.050. General Criteria for all CUP Uses 1. Distance from existing residential uses: The project site is located on Hermosa Avenue in the Community Commercial Zone (C-2). The primary entrance is oriented towards Hermosa Avenue. Multi- family residences are located to the east of the site, on the opposite side of Palm Drive. The multi-family residences are approximately 100 feet from the east tenant space wall. 2. The amount of existing or proposed off-street parking facilities, and its distance from proposed use: The project site currently provides six (6) shared parking spaces at the rear of the building. The parking spaces are shared and fully available to employees and patrons and unassigned to any particular tenant. 3. Location of and distance to churches, schools, hospitals, and public playgrounds: The project site is located approximately 0.7 miles from the nearest school (Hermosa Valley School), approximately 6.8 miles to the nearest hospital (Kindred Hospital), approximately 0.4 miles from the nearest church (First Church of Christ Scientist), and 0.4 miles from the nearest playground (South Park). The distance between the establishment and the various uses provides sufficient buffer to minimize any potential negative impacts. 4. The combination of uses proposed: The project site is located within the C-2 Zone, which aims to provide opportunities for a pedestrian-oriented range of office, retail, and service commercial uses in order to form resident and visitor serving downtown districts. The project site is located within the Downtown District which is composed of a variety of retail, restaurant, and personal service type uses. The proposed modification to use Page 51 of 115 aligns with the development pattern and uses within the Downtown District. The change from Type 41 license (on-sale beer and wine) to a Type-47 license (on- sale general) would provide residents and visitors with additional beverage options to pair with their meal. 5. Precautions taken by the owner or operator of the proposed establishment to assure compatibility of the surrounding uses: The applicant is proposing to maintain the existing hours of operation from 7 am to 11 pm. Additionally, the applicant will be required to abide by the conditions of approval incorporated into the Resolution (Attachment 1). The expansion of on- sale alcohol is not anticipated to have a negative impact on existing surrounding uses. 6. The relationship of the proposed business-generated traffic volume and the size of streets serving the area: The modification of on-sale alcoholic beverages would not affect existing streets or significantly impact traffic volume, as the proposal does not invoice a change in the existing restaurant use or the square footage of the building and outdoor dining areas. 7. The proposed exterior signs and decor, and the compatibility thereof with existing establishments in the area: There are no signs or décor proposed as part of the 8. The existing COA includes conditions to mitigate potential noise, odor and/or vibration generated from the establishment. COA number four (4), nine (9), ten (10) and fourteen (14) mitigate potential noise and vibration, while COA number seventeen (17) and eighteen (18) mitigate potential odor. Language for these COA are provided below:  # 4 Live entertainment (including amplified music, disc jockeys, live music whether acoustic or amplified, and live performances of all kinds) and customer dancing is prohibited. Televisions and amplified music, including speakers shall be prohibited withing the first ten (10) feet of the front building. A maximum of five (5) televisions or similar displays shall be permitted in the remainder of the restaurant.  # 9 Noise emanating from the property shall be within the limitations prescribed by the City’s Noise Ordinance (Hermosa Beach Municipal Code Chapter 8.24) and shall not create a nuisance to surrounding residential neighborhoods and/or commercial establishments.  # 10 Management shall be responsible for maintaining noise volumes at reasonable levels. Page 53 of 115  # 14 The building shall be equipped with acoustic features to maximize sound proofing to the satisfaction of the Community Development Director.  # 17 The rear rollup door shall be maintained closed at all time except during deliveries and trash pickup.  # 18 Storage of trash bins or can must be screened and remain in the utility room as described on the approved floor plans. Odor elimination equipment shall be installed for the trash bin area; venting untreated air from this area shall be prohibited. 10. Impact of the proposed use to the city’s infrastructure, and/or services: The existing restaurant use will continue, and the current infrastructure is not anticipated to be impacted. The modification of the alcohol license has the potential to impact public safety services. The high alcohol by volume (ABV) content of the added beverages sold on site may increase the demand for public safety services due to increased potential for patrons to reach heightened levels of intoxication. 11. Will the establishment contribute to a concentration of similar outlets in the area: The existing restaurant is approved as an on-sale alcoholic beverage serving establishment. The proposed amendment would not add to the concentration of similar outlets in this area because a restaurant providing the sale of alcoholic beverages is currently operating in this location. 12. Other consideration that, in judgment of the planning commission, ae necessary to assure compatibility with the surrounding uses, and the city as a whole. No other issues are identified. Findings The General Criteria are used to help inform the five required CUP findings, all of which must be made pursuant to HBMC 17.56.050 to approve a CUP application. The inability to make one or more of the findings is grounds for denial of an application. 1. The proposed use is allowed within the applicable zone and complies with all other applicable provisions of this Title and all other titles of the Hermosa Beach Municipal Code; The proposed use to expand the on-sale alcoholic beverages is allowed within the General Commercial (C-2) zone with approval of a Conditional Use Permit. The use is compliant with the zoning ordinance and all other titles in the municipal code. Page 54 of 115 2. The proposed use is consistent with the General Plan and any applicable specific plan; The project is located within the Community Commercial Zone (C-2), which aims to provide opportunities for a pedestrian-oriented range of office, retail, and service commercial uses to form resident and visitor-serving downtown districts. The project is located within the Downtown District which is composed of a variety of retail, restaurant, and personal service type uses. The proposed modification to the conditional use permit is consistent with the development pattern and uses within the Downtown District. The proposed project also aligns with General Plan Goal 4 and Policy 4.5 pertaining to corridor connectivity and providing opportunities to balance local- serving retail needs and balance the needs of multiple transport modes. The recommended revision to the condition of approval provides infrastructure supporting the use of alternative modes of transportation. 3. The proposed use will not be averse to the public health, safety, or general welfare of the community, nor detrimental to surrounding properties or improvements; The proposed project and the modification of on-sale alcohol served would be similar to other commercial uses in the vicinity and would not be averse to the public health, safety, or general welfare of the community or detrimental to surrounding properties or improvements. Additionally, the applicant will be required to abide by the conditions of approval incorporated into the Resolution (Attachment 1), which are intended to mitigate or prevent any potential adverse impacts to the community. 4. The design, location, size and operating characteristics of the proposed activity are compatible with the existing and reasonably foreseeable future land uses and circulation on the vicinity; and The design, location, size and operating characteristics of the restaurant are compatible with the existing and reasonably foreseeable future land uses and circulation in the vicinity. The proposed amendment would not result in any physical changes to the existing restaurant nor the hours of operation. The modification of on-sale alcohol would be consistent with the sounding establishment’s operating characteristics. 5. The site is physically suitable for the type of use being proposed, including access, utilities and the absence of physical constraints. Page 55 of 115 There is no change of use being proposed as part of this amendment. The existing restaurant use would remain. There would be no change in the physical structure of the restaurant nor are there any pre-existing constraints of the use. CUP Specific Criteria Should the Planning Commission find that the aforementioned findings can affirmatively be made to approve the CUP amendment to allow the sale of alcoholic beverages to include distilled spirits, then it should consider the conditions of approval and any other it deems necessary to ensure the use operates in a manner compatible with existing and future uses in the area. HBMC Section 17.40.080 establishes the following minimum conditions and standards for all on-sale alcoholic beverage establishments. 1. The establishment shall not adversely affect the welfare of the residents. And/or commercial establishments nearby. 2. The business shall prevent loitering, unruliness and boisterous activities of the patrons outside the business or in the immediate area. 3. The Police Chief may determine that a continuing police problem exists and may, subject to appeal to the Planning Commission, direct the presence of a police approved doorman and/or security personnel to eliminate the problem. An appeal to the Planning Commission shall be heard within sixty (60) days of filing the appeal. The Police Chief’s determination will not be stayed during the pendency of the appeal. If the problem persists, the Police Chief then shall submit a report to the Planning Commission, which will automatically initiate a review of the conditional use. 4. The exterior of the premises shall be maintained in a neat and clean manner and free of graffiti at all times. 5. Any changes to the interior or exterior layout that alter the primary function of the business shall be subject to review and approval by the Planning Commission. In addition to the aforementioned conditions, staff recommends the Planning Commission adopt Planning Commission Resolution to supersede and replace Planning Commission Resolution 20-13, subject to conditions. The following highlights the notable condition of approval: 1. Live entertainment (including amplified music, disc jockeys, live music whether acoustic or amplified, and live performances of all kinds) (excluding acoustic, unamplified, nonpercussive background music provided accessory to an established on-sate use during normal business hours by a maximum of two (2) persons without advertisement and without charge) and customer dancing is prohibited. Limited live entertainment may be permitted through an Administrative Page 56 of 115 permit per Hermosa Beach Municipal Code. Televisions and amplified music, including speakers, shall be prohibited within the first ten (10) feet of the front building. A maximum of five (5) televisions or similar displays shall be permitted in the remainder of the restaurant. The applicant shall schedule an inspection with Planning within 21 days of the issuance of the CUP amendment for the purpose of demonstrating compliance with the limitation on the total number of televisions. (Condition of Approval Number 14) 2. A bicycle rack for a minimum of six (6) bikes shall be installed as reflected in the submitted floor plan. The proposed bicycle racks must be considered and evaluated by Public Works Department prior to approval. Once installed, the bicycle rack must be inspected by Public Works staff. The applicant will submit to Public Works within 21 days of the final approval of the CUP amendment. (Condition of Approval Number 40) General Plan Consistency: This report and associated recommendation have been evaluated for their consistency with the City’s General Plan. Relevant Policies are listed below: General Plan Consistency Land Use Element Findings Goal 1. Create a sustainable urban form and land use patterns that support a robust economy and high quality of life for residents. The proposal put forth is consistent with policy 1.3, and 1.5 as the project promotes uses, with minimal impact to adjacent residential properties and continuance of compatibility to surrounding uses. Specifically, the project proposes expanding the alcohol service at an existing restaurant. There are no proposed changes to hours of operation and conditions of approval limiting the hours of operation will be maintained to minimize potential nuisance for the adjacent residential properties and ensure a high quality of life for residents. Policy 1.3 Access to daily activities, strive to create sustainable development patterns such that the majority of residents are within walking distance to a variety of neighborhood goods and services, such as supermarkets, restaurants, churches cafes, dry cleaners, laundromats, farmers Page 57 of 115 General Plan Consistency Land Use Element Findings market banks, personal services, pharmacies and similar uses. Policy 1.5 Balance resident and visitor needs. Ensure land uses and business provide for needs of residents as well as visitors. Policy 1.7 Compatibility of uses. Ensure the placement of new uses does not create or exacerbate nuisances between different types of uses. The proposal put forth is consistent with policy 1.7, as the project aligns with the goal of the Community Commercial zone (C-2), which aims to provide opportunities for a pedestrian-oriented range of office, retail, and service commercial uses in order to form resident and visitor-serving downtown districts. Additionally, the project is located within the Downtown District which is composed of a variety of retail, restaurant, and personal service type uses. The proposed modification to use aligns with the development pattern and uses within the Downtown District. The change from on-sale beer and wine (ABC Type 41) license to an on-sale general (ABC Type-47 license) would be consistent with similar establishment in the vicinity as well as provide residents and visitors with additional beverage options to pair with their meal. Goal 4. A variety of corridors throughout the city provide opportunities for shopping, recreation, commerce employment and circulation. The proposal put forth is consistent with policy 4.5 as the project is satisfying with an existing COA of providing a bicycle rack for a minimum of six (6) bikes. Previously this COA was not fulfilled, however the proposed location of a bicycle rack is located within the public right of way along Hermosa Avenue. The incorporation of bicycle racks, provides opportunity for multi-modal transportation. Policy 4.5 Corridor connectivity. Recognize corridors as important cross- town thoroughfares that connect Hermosa Beach, serve as transitions between neighborhoods, provide opportunities for Page 58 of 115 General Plan Consistency Land Use Element Findings local-serving retail and balance the needs of multiple transport modes. Environmental Determination: Pursuant to the California Environmental Quality Act (CEQA), the proposed project qualifies for a Class 1 categorical exemption, Existing Facilities, as defined in section 15301 of the State CEQA Guidelines, as the project consists of the operation and permitting of existing private structures or facilities involving negligible or no expansion of existing or former use. The scope of the CUP would not affect the physical condition of the site. Moreover, none of the exceptions to the categorical exemption(s) apply, as defined in section 15300.2 of the State CEQA Guidelines. The project will not result in a significant cumulative impact of successive projects of the same type in the same place; the project does not involve unusual circumstances with the possibility to have a significant effect on the environment; the project will not result in damage to a state scenic highway; the project is not located on a hazardous waste site; and the project does not involve a historical resource. Public Notification: Public notice was given for the May 20, 2025, Planning Commission hearing; a total of 870 public hearing notices were mailed to the applicant, and occupants and property owners of properties within a 500-foot radius on May 6, 2025. A legal ad was published on May 8, 2025 in the Easy Reader, a newspaper of general circulation. Additionally, the applicant received a notice poster to post on-site and provided proof of posting a minimum of ten days in advance of the public hearing, in accordance with HBMC 17.68.050. The General Criteria are used to help inform the five required findings which must be made pursuant to HBMC Section 17.56.050; and WHEREAS, the Planning Commission, at its public meeting of May 20, 2025, considered all testimony and evidence regarding the application, both oral and written, that was presented to the Planning Commission. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Page 60 of 115 Page 2 of 18 RES NO. 25-XX SECTION 1. Based on the testimony and evidence received, the Planning Commission hereby further finds, determines and declares the following pertaining to the application for a Conditional Use Permit, pursuant to HBMC Section 17.56.040: General Criteria for all CUP uses 1. Distance from existing residential uses. The project site is located on Hermosa Avenue in the Community Commercial Zone (C-2). The primary entrance is oriented towards Hermosa Avenue. Multi-family residences are located to the east of the site, on the opposite side of Palm Drive. The multi-family residences are approximately 100 feet from the east tenant space wall. 2. The amount of existing or proposed off-street parking facilities, and its distance from proposed use. The project site currently provides six (6) shared parking spaces at the rear of the building. The parking spaces are shared and fully available to employees and patrons and unassigned to any particular tenant. 3. Location of and distance to churches, schools, hospitals, and public playgrounds: The project site is located approximately 0.7 miles from the nearest school (Hermosa Valley School), approximately 6.8 miles to the nearest hospital (Kindred Hospital), approximately 0.4 miles from the nearest church (First Church of Christ Scientist), and 0.4 miles from the nearest playground (South Park). The distance between the establishment and the various uses provides sufficient buffer to minimize any potential negative impacts. 4. The combination of uses proposed: The project site is located within the C-2 Zone, which aims to provide opportunities for a pedestrian-oriented range of office, retail, and service commercial uses in order to form resident and visitor serving downtown districts. The project site is located within the Downtown District which is composed of a variety of retail, restaurant, and personal service type uses. The proposed modification to use aligns with the development pattern and uses within the Downtown District. The change Page 61 of 115 Page 3 of 18 RES NO. 25-XX from Type 41 license (on-sale beer and wine) to a Type-47 license (on-sale general) would provide residents and visitors with additional beverage options to pair with their meal. 5. Precautions taken by the owner or operator of the proposed establishment to assure compatibility of the surrounding uses: The applicant is proposing to maintain the existing hours of operation from 7 am to 11 pm. Additionally, the applicant will be required to abide by the conditions of approval incorporated into the Resolution (Attachment 1). The expansion of on- sale alcohol is not anticipated to have a negative impact on existing surrounding uses. 6. The relationship of the proposed business-generated traffic volume and the size of streets serving the area: The modification from of on-sale alcoholic beverages would not affect existing streets or significantly impact traffic volume, as the proposal does not invoice a change in the existing restaurant use or the square footage of the building and outdoor dining areas. 7. The proposed exterior signs and decor, and the compatibility thereof with existing establishments in the area: There are not exterior signs or décor proposed as part of this project. 8. The number of similar establishments or uses within close proximity to the proposed establishment: There are a total of seven (7) similar establishments which serve alcohol. Of these establishments three (3) have a Type 47 license, three (3) have a Type 41 license and four (4) are Late-Night establishments. Noise, odor, and/or vibration that may be generated by the proposed establishment: The modification from a Type 41 license (on-sale beer and wine) to a Type 47 license (on-sale general) would not significantly generate additional noise, odor, dust and or vibration, as the proposal does not involve a change in the existing restaurant use. The existing COA include conditions mitigate potential noise, odor and/or vibration generated from the establishment. COA number four (4), nine (9), ten (10) and fourteen (14) mitigate potential noise and vibration, while COA number seventeen (17) and eighteen (18) mitigate potential odor. Language for these COA are provided below:  # 4 Live entertainment (including amplified music, disc jockeys, live music whether acoustic or amplified, and live performances of all kinds) and customer dancing is prohibited. Televisions and amplified music, including speakers shall be prohibited withing the first ten (10) feet of the front building. A maximum of five (5) televisions or similar displays shall be permitted in the remainder of the restaurant.  # 9 Noise emanating from the property shall be within the limitations prescribed by the City’s Noise Ordinance (Hermosa Beach Municipal Code Page 63 of 115 Page 5 of 18 RES NO. 25-XX Chapter 8.24) and shall not create a nuisance to surrounding residential neighborhoods and/or commercial establishments.  # 10 Management shall be responsible for maintaining noise volumes at reasonable levels.  # 14 The building shall be equipped with acoustic features to maximize sound proofing to the satisfaction of the Community Development Director.  # 17 The rear rollup door shall be maintained closed at all time except during deliveries and trash pickup.  # 18 Storage of trash bins or cans must be screened and remain in the utility room as described on the approved floor plans. Odor elimination equipment shall be installed for the trash bin area; venting untreated air from this area shall be prohibited. 10. Impact of the proposed use to the city’s infrastructure, and/or services: The existing restaurant use will continue, and the current infrastructure is not anticipated to be impacted. The modification of the alcohol license has the potential to impact public safety services. The high alcohol by volume (ABV) content of the added beverages sold on site may increase the demand for public safety services due to increased potential for patrons to reach heightened levels of intoxication. 11. Will the establishment contribute to a concentration of similar outlets in the area: The existing restaurant is approved as an on-sale alcoholic beverage serving establishment. The proposed amendment would not add to the concentration of similar outlets in this area because a restaurant providing the sale of alcoholic beverages is currently operating in this location. 12. Other consideration that, in judgment of the planning commission, ae necessary to assure compatibility with the surrounding uses, and the city as a whole. No other issues are identified. Page 64 of 115 Page 6 of 18 RES NO. 25-XX SECTION 2. Based on the testimony and evidence received, the Planning Commission hereby further finds, determines and declares the following pertaining to the application for a Conditional Use Permit, pursuant to HBMC Section 17.56.050: 1. The proposed use is allowed withing the applicable zone and complies with all other applicable provisions of this Tittle and all other titles of the Hermosa Beach Municipal Code; The proposed use to expand the on-sale alcoholic beverages is allowed within the General Commercial (C-2) zone with approval of a Conditional Use Permit. The use is compliant with the zoning ordinance and all other titles in the municipal code. 2. The proposed use is consistent with the General Plan and any applicable specific plan; The project is located within the Community Commercial zone (C-2) which aims to provide opportunities for a pedestrian-oriented range of office, retail, and service commercial uses in order to form resident and visitor serving downtown districts. The project is located within the Downtown District which is composed of a variety of retail, restaurant, and personal service type uses. The proposed modification to use aligns with the development pattern and uses within the Downtown District. The proposed project also aligns with General Plan Goal 4 and Policy 4.5 pertaining to corridor connectivity and providing opportunities to balance local-serving retail needs and balance the needs of multiple transport modes. The recommended revision to the condition of approval provides infrastructure supporting the use of alternative modes of transportation. Relevant General Plan Policies are listed below: Page 65 of 115 Page 7 of 18 RES NO. 25-XX General Plan Consistency Land Use Element Findings Goal 1. Create a sustainable urban form and land use patterns that support a robust economy and high quality of life for residents. The proposal put forth is consistent with policy 1.3, and 1.5 as the project promotes uses, with minimal impact to adjacent residential properties and continuance of compatibility to surrounding uses. Specifically, the project proposes expanding the alcohol service at an existing restaurant. There are no proposed changes to hours of operation and conditions of approval limiting the hours of operation will be maintained to minimize potential nuisance for the adjacent residential properties and ensure a high quality of life for residents. Policy 1.3 Access to daily activities, strive to create sustainable development patterns such that the majority of residents are within walking distance to a variety of neighborhood goods and services, such as supermarkets, restaurants, churches cafes, dry cleaners, laundromats, farmers market banks, personal services, pharmacies and similar uses. Policy 1.5 Balance resident and visitor needs. Ensure land uses and business provide for needs of residents as well as visitors. Policy 1.7 Compatibility of uses. Ensure the placement of new uses does not create or exacerbate nuisances between different types of uses. The proposal put forth is consistent with policy 1.7, as the project aligns with the goal of the Community Commercial zone (C-2), which aims to provide opportunities for a pedestrian-oriented range of office, retail, and service commercial uses in order to form resident and visitor-serving downtown districts. Additionally, the Page 66 of 115 Page 8 of 18 RES NO. 25-XX General Plan Consistency Land Use Element Findings project is located within the Downtown District which is composed of a variety of retail, restaurant, and personal service type uses. The proposed modification to use aligns with the development pattern and uses within the Downtown District. The change from on-sale beer and wine (ABC Type 41) license to an on-sale general (ABC Type-47 license) would be consistent with similar establishment in the vicinity as well as provide residents and visitors with additional beverage options to pair with their meal. Goal 4. A variety of corridors throughout the city provide opportunities for shopping, recreation, commerce employment and circulation. The proposal put forth is consistent with policy 4.5 as the project is satisfying with an existing COA of providing a bicycle rack for a minimum of six (6) bikes. Previously this COA was not fulfilled, however the proposed location of a bicycle rack is located within the public right of way along Hermosa Avenue. The incorporation of bicycle racks, provides opportunity for multi-modal transportation. Policy 4.5 Corridor connectivity. Recognize corridors as important cross- town thoroughfares that connect Hermosa Beach, serve as transitions between neighborhoods, provide opportunities for local-serving retail and balance the needs of multiple transport modes. 3. The proposed use will not averse to the public health, safety, or general welfare of the community, nor detrimental to surrounding properties or improvements; The proposed project and the modification of on-sale alcohol served would be similar to other commercial uses in the vicinity and would not be averse to the Page 67 of 115 Page 9 of 18 RES NO. 25-XX public health, safety, or general welfare of the community or detrimental to surrounding properties or improvements. Additionally, the applicant will be required to abide by the conditions of approval incorporated into the Resolution (Attachment 1), which are intended to mitigate or prevent any potential adverse impacts to the community. 4. The design, location, size and operating characteristics of the proposed activity are compatible with the existing and reasonably foreseeable future land uses and circulation on the vicinity; and The design, location, size and operating characteristics of the restaurant are compatible with the existing and reasonably foreseeable future land uses and circulation in the vicinity. The proposed amendment will not be physically altering the existing restaurant nor the hours of operation. The modification of on-sale alcohol would be consistent with the sounding establishment’s operating characteristics. 5. The site is physically suitable for the type of use being proposed, including access, utilities and the absence of physical constraints. There is no change of use being proposed. The existing restaurant use would remain. There would be no change in the physical structure of the restaurant nor are there any pre-existing constraints of the use. SECTION 3. Based on the foregoing, the Planning Commission hereby approves the Conditional Use Permit Amendment Case No. APE25-003 to expand the sale of alcoholic beverages to allow the sale of beer, wine and distilled spirits as set forth in Planning Commission Resolution 25-08 subject to the following Conditions of Approval: 1. The continued operation of the business shall be as a bona fide restaurant: the kitchen shall be equipped to prepare food from its component ingredient whenever the restaurant is open and it shall offer a full-service lunch and/or dinner menu; food service from the menu shall be available during all hours that the establishment is open for business, provided that said food service may cease one hour prior to close daily. Page 68 of 115 Page 10 of 18 RES NO. 25-XX 2. The restaurant with on-sale alcoholic beverage service may be subject to periodic review process established by the City to verify conformance with the conditions of approval. The Planning Commission may amend the subject conditions or impose any new conditions if deemed necessary to mitigate detrimental effects on the neighborhood resulting from the subject use. 3. Alcohol may be served for on-premise consumption only and in a manner consistent with its license issued by State Department of Alcoholic Beverage Control (ABC). 4. The business shall be maintained and operated in full compliance with the conditions of this CUP and any law, statue, ordinance, or other regulation hereafter adopted that is applicable to any development or activity on the property. Failure of the permittee to cease any development or activity not in full compliance shall be a violation of these conditions. 5. Approval of this permit shall expire twenty-four (24) months from the date of approval by the Coastal Commission, unless significant construction or improvement of the use authorized hereby has commenced. One or more extensions of time may be requested. No extensions shall be considered unless requested, in writing to the Community Development Director including the reason, therefore, at least 60 days prior to the expiration date. No additional notice of expiration will be provided. 6. The applicant shall apply for approval, waiver, or exception of a Coastal Development permit for this Conditional Use Permit from the California Coastal Commission before commencing the use. 7. This use shall be considered expired if the use for which this Conditional Use Permit was granted ceased or was suspended for at least 180 successive days. 8. Prior to submittal to Alcoholic Beverage Control (ABC) of any ABC Zoning Affidavit, the applicant shall submit to the City a signed letter address to the ABC stipulating to include the required City of Hermosa Beach conditions in the ABC license. Page 69 of 115 Page 11 of 18 RES NO. 25-XX 9. The business shall not adversely affect the welfare of the residents, and/or commercial establishments nearby. 10. The project shall maintain in conformance with all other applicable City of Hermosa Beach and regulatory agency requirements and standards, including but not limited to: California Department of Alcoholic Beverage Control, Los Angeles County Health Department, California Disabled Access Standards (Government Code Title 24), and Los Angeles County National Pollutant Discharge Elimination System Permit (NPDES). 11. The restaurant shall maintain sales reports showing the actual items sold and price charged and invoices for all food, nonalcoholic beverages and alcohol beverages sold for the prior twelve (12) Months. Should the Planning Commission or City Council initiate a CUP modification or revocation proceeding, the Commission or Council, may at its discretion require the subject business to provide (a) a statement of percentage of gross sales, computed monthly, that resulted from the sale of prepared food for not longer than the prior twelve (12) months; and (b) the supporting data upon which the percentage is based. 12. The Planning Commission, or City Council, may also require an audit of the records of the business by a certified public accountant to determine the gross sale of food and alcohol or a forensic audit by a qualified auditor selected by the city of the information and data systems by which the information is produced. The result of these audits may be used to determine whether the grounds for modification or revocation exist. When considering revocation or modification, a restaurant that sells or provides on-sale alcoholic beverages will be presumed to be operating as a restaurant if the monthly food to alcohol sale ratios are consistent with the ratios in HBMC Subsection 17.70.010 (H). 13. If the queuing of patrons exceeds the restaurant’s waiting area, the business shall utilize an electronic method of reservation management to text or otherwise electronically notify patrons when the business is able to accommodate them without the patrons gathering in the immediate area. Page 70 of 115 Page 12 of 18 RES NO. 25-XX 14. Live entertainment (including amplified music, disc jockeys, live music whether acoustic or amplified, and live performances of all kinds) (excluding acoustic, unamplified, nonpercussive background music provided accessory to an established on-sate use during normal business hours by a maximum of two (2) persons without advertisement and without charge) and customer dancing is prohibited. Limited live entertainment may be permitted through an Administrative permit per Hermosa Beach Municipal Code. Televisions and amplified music, including speakers, shall be prohibited within the first ten (10) feet of the front building. A maximum of five (5) televisions or similar displays shall be permitted in the remainder of the restaurant. The applicant shall schedule an inspection with Planning within 21 days of the issuance of the CUP amendment for the purpose of demonstrating compliance with the limitation on the total number of televisions. 15. The permittee shall not solicit, advertise, or otherwise encourage the use of its premises for “pub crawl” activities whereby persons travel in an organized or predetermined fashion between premises with the goal of consuming alcoholic beverages at each stop along the way. 16. The hours of operation for all operations of the restaurant, including the bar areas, shall be limited to between 7:00 A.M. and 11:00 P.M. daily. All customers shall vacate the premises by 11:00 P.M. and the doors shall be locked. 17. Noise emanating from the property shall be within the limitations prescribed by the City’s Noise Ordinance (Hermosa Beach Municipal Code Chapter 8.24) and shall not create a nuisance to surrounding residential neighborhoods and/or commercial establishments. 18. Management shall be responsible for maintaining noise volumes at reasonable levels. 19. The establishment shall not adversely affect the welfare of the residents, and/or commercial establishment nearby. Page 71 of 115 Page 13 of 18 RES NO. 25-XX 20. The business shall employ adequate staffing and management/supervision to prevent serving underage persons, over-serving alcohol, and loitering , unruliness, and boisterous behavior by patrons both inside and outside on the business premises during business hours. The Conditional Use Permit shall be maintained on the premise in a location where employees can easily read the conditions. 21. The exterior of the premises shall be maintained in a neat and clean manner and free of graffiti at all times. 22. The following signs shall be posted in a conspicuous location in a readily visible manner, warning patrons of the illegality of selling alcoholic beverages to persons under twenty-one years of age, loitering and drinking within the public realm, and removing alcoholic beverages from the premises and carrying: a. “California State Law prohibits the sale of alcoholic beverages to persons under twenty-one years of age” b. “No Loitering or Public Drinking” c. “It is illegal to possess an open container of alcohol in the vicinity of this establishment” 23. In addition to any other remedy provided by law, if the business operating pursuant to this CUP violates any condition of this CUP, the Police Chief or designee may meet and confer with the business to clarify the reason for the violation and to formulate a course of action to mitigate the risk for any future violation. If the business operating pursuant to this CUP continues to violate this CUP (i.e., either a repeat violation or another violation) within any six (6) month period following a meet and confer with the Police Chief, then, at the sole discretion of the Police Chief, modified or additional operational requirements may be imposed by the Police Chief to curtail the violations until the time that the matter is brought before the Planning Commission. These modified or additional operational requirements include, but are not limited to, a reduction in operating hours, required number of staff members during operating hours, additional training for existing staff, and/or any other measures deemed appropriate by the Police Chief. The Planning Commission shall consider any modification or additional requirement(s) imposed by the Page 72 of 115 Page 14 of 18 RES NO. 25-XX Police Chief during its discussion on the matter. The Police Chief’s determination will remain in effect until considered by the Planning Commission. 24. The building shall be equipped with acoustic features to maximize soundproofing to the satisfaction of the Community Development Director. 25. The rear door, emergency exit, facing the alley shall remain closed at all times during business hours, and shall be equipped with panic hardware including an alarm and self-closing door mechanisms, equipment shall be maintained in operational order at all times. 26. Storage of trash bins or cans must be screened and remain in the utility room as described on the approved floor plans except during scheduled pick-up times. Odor elimination equipment shall be installed for the trash bin area; venting untreated air from this area shall be prohibited. 27. Deliveries to the rear doors on Plam Drive are prohibited between the hours of 10:00 P.M. and 8:00 A.M. daily. 28. Management shall successfully complete ABC Licensee Education on Alcohol and Drugs (LEAD) training and Responsible Beverage Servers Training, or equivalent as determined by Chief of Police. Training shall be completed within 30 days of final approval of the CUP and within 30 days of the employee's start of employment. The business shall maintain records that management has participated in the required training. Records shall be maintained for two years after training and be available upon request for review by the Community Development Director, Chief of Police, or designee. 29. All employees engaged in the sale or service of alcoholic beverages shall complete Responsible Beverage Service Training, or equivalent as determined by the Chief of Police, within 30 days of final approval of the CUP and 30 days of start of employment. The business shall maintain records that management and employees have participated in the required trainings. Records shall be Page 73 of 115 Page 15 of 18 RES NO. 25-XX maintained for two years after training and be available upon request by the Community Development Director, Chief of Police, or designee. 30. Any changes to the interior and/or exterior floorplan shall be subject to review and approval of the Planning Commission. 31. All alcoholic beverages shall be served in non-disposable drinkware. 32. No alcoholic beverages shall be sold from any temporary location on the premises such as ice tubs, barrels, or any other containers. 33. The project site shall be the point-of-sale for the purposes of collecting any sales tax on goods that are sold, delivered or rented on the site. 34. The business shall install and maintain a video surveillance system that monitors within the interior of the business and the immediate area. The video system must be capable of delineating on playback the activity and physical features of persons and areas within the premises and immediate area. Recording shall be retained for a minimum of sixty (60) days and video will be available to Police Department upon request. At the discretion of the Chief of Police, Licensee may be required to add additional video cameras. 35. The provisions of this Conditional Use Permit shall take effect immediately upon adoption by the Planning Commission and upon completion of the applicable appeal period, should no appeal be filed. 36. This Conditional Use Permit Resolution shall supersede and replace Planning Commission Resolution 20-23 which is hereby rescinded and of no further force and effect, except that the applicable requirements of the floor plan alterations, as part of Planning Commission 20-23, and the applicable requirements of the Precise Development Plan as part of Planning Commission Resolution 96-13 remain effective. 37. The operation of the business shall comply with all Ordinances, regulations and laws applicable to a business of this kind in effect at of the date hereof or Page 74 of 115 Page 16 of 18 RES NO. 25-XX hereafter adopted. In addition to any other remedy available at law, in equity or as provided in the Municipal Code, 9i) any significant material violation, or (ii) any repeated, continuous or sustained violation of any condition of approval of this Conditional Use Permit shall be required to reimburse the City fully for its coast and expenses including by not limited to attorney’s fees, in undertaking any such corrective action, Reimbursement of enforcement cost shall constitute a civil debt and may be collected by any means permitted by law. In the event that violations of this Permit occur, the City shall refrain from issuing further permits, licenses, or other approvals until such violation has been fully remedied. 38. To reduce marine debris associated with take-out containers, the establishment shall not use take-out containers with a “No. 6” recycle code or use certain polystyrene products, single-use plastic products, and single-use products in compliance with HBMC Chapter 8.64. 39. The practice of washing and rinsing restaurant floor mats, equipment, tables, etc. or discharge of any liquids, other than stormwater, onto the public right- of-way, into the parking lot drain or storm drains, is strictly prohibited. Discharge of liquids or ash water shall be limited to the sanitary sewer. 40. A bicycle rack for a minimum of six (6) bikes shall be installed as reflected in the submitted floor plan. The proposed bicycle racks must be considered and evaluated by Public Works Department prior to approval. Once installed, the bicycle rack must be inspected by Public Works staff. The applicant will submit to Public Works within 21 days of the final approval of the CUP amendment. 41. To the extent permitted by law, Permittee shall defend, indemnify and hold harmless the City of Hermosa Beach, its City Council, its officers, employees and agents (the “indemnified parties”) from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void any permit or approval for this project authorized by the City, including (without limitation) reimbursing the City its actual attorney’s fees and costs in defense of the litigation. The City may, in its sole discretion, elect to defend any such action with attorneys of its choice. The permittee shall reimburse the City for any court and attorney's fees which the Page 75 of 115 Page 17 of 18 RES NO. 25-XX City may be required to pay as a result of any claim or action brought against the City because of this permit. Although the permittee is the real party in interest in an action, the City may, at its sole discretion, participate at its own expense in the defense of the action, but such participation shall not relieve the permittee of any obligation under this condition. 42. Each of the above conditions is separately enforced, and if one of the conditions of approval is found to be invalid by a court of law, all the other conditions shall remain valid and enforceable. SECTION 4. The Planning Commission finds that the project is categorically exempt from the California Environmental Quality Act (CEQA), as defined in Section 15301 of the State CEQA Guidelines, Class 1 Categorical Exemption, Existing Facilities. More specifically, the approval of the Conditional Use Permit results in no physical change to the existing structure. Moreover, none of the exceptions to the categorical exemption(s) apply, as defined in section 15300.2 of the State CEQA Guidelines. The project will not result in a significant cumulative impact of successive projects of the same type in the same place; the project does not involve unusual circumstances with the possibility to have a significant effect on the environment; the project will not result in damage to a state scenic highway; the project is not located on a hazardous waste site; and the project does not involve a historical resource. SECTION 5. Pursuant to the Code of Civil Procedure Section 1094.6, any legal challenge to the decision of the Planning Commission, after a formal appeal to the City Council, must be made within 90 days after the final decision by the City Council. Executive Summary: In accordance with State law, the Planning Commission must determine if the Capital Improvement Program is in conformance with the City’s General Plan. Staff recommend that the Planning Commission find the FY 2025-26 CIP in conformance with the City’s General Plan. Background: The Capital Improvement Program (CIP) is the City’s comprehensive plan to develop and maintain the City’s capital facilities and infrastructure. The CIP is adopted in conjunction with the City budget; projects will be entirely or partially funded in the next fiscal year. California Government Code Section 65401 requires Planning Commission review of the proposed Public Works CIP for conformity with the City’s General Plan. Attached for review is the preliminary CIP (Attachment 1) prepared for the upcoming Fiscal Year (FY) 2025-26. The CIP continues to be very ambitious, integrating the vision from PLAN Hermosa and adopted plans including the Sewer Master Plan, Storm Drain Master Plan, the Americans for Disabilities Act (ADA) Self Evaluation and Transition Plan, and the recently completed Parks Master Plan. Staff has recommended a continued focus on prioritizing deferred maintenance and safety projects during FY 2025-26, such as building maintenance, sidewalks, sewer, storm drains and paving over enhancement projects. For the proposed 2025-26 Budget, there are a total of 36 projects identified, including 28 active projects carried over from FY 2024-25 and eight new projects. The summary for each project in the preliminary FY 2025-2026 CIP is detailed in Attachment 1. Attachment 3 details an estimated schedule, and sequencing, for the delivery of the proposed FY 2025-26 CIP considering projected engineering project management staff capacity in labor hours versus the time commitment required to advance each project through design and construction. Several projects have fixed schedules to meet grant- specific and regulatory timelines and other high-priority safety needs. The scope of the Planning Commission’s review is limited to conformity with the General Plan and the Commission may inquire about project details to clarify consistency with the General Plan. However, it is outside the Planning Commission’s authority to modify the scope of projects or prioritization. The proposed FY 2025-2026 CIP will be considered for adoption by the Council as part of the city budget process. Discussion: PLAN Hermosa most directly addresses capital projects in the Mobility, Infrastructure, and Parks and Open Space Elements. The ongoing CIP projects align with Mobility goals and policies related to expanding multi-modal transportation options, as they involve pedestrian safety improvements and increase ADA accessibility. Several projects align with goals and policies of the Infrastructure Element as they involve coordinated maintenance and repair of streets, sewers and storm drains infrastructure systems, and City facilities. There are also several projects focused on adding amenities to or upgrading existing parks and open space aligning with goals and policies in the Parks and Open Space element. The “placemaking” goals and policies of the Land Use and Design Element are highlighted by the lighting in the downtown, utility box art and concept designs for gateway and wayfinding sign. Safety Element projects include the tsunami siren and the real time crime center. Further, the projects all follow the goals and policies of the Sustainability and Conservation Element, where standard projects have incorporated sustainability principles. This in turn has led to increased opportunities in receiving grant funding, including the Hermosa Avenue Green Streets. The proposed FY 2025-26 CIP has been evaluated for its consistency with the City’s General Plan. The link to PLAN Hermosa General Plan is provided as Attachment 4. The Fiscal Year 2025-2026 CIP Program Summary (Attachment 1) details the project scope of work. Attachment 2 provides the relevant goals of General Plan Hermosa cross- referenced across the CIP for conformance review. Based on the above, staff recommend the Planning Commission find the FY 2025-2026 CIP in conformance with the City’s General Plan (PLAN Hermosa). The CIP supports several PLAN Hermosa goals and policies that are listed in Attachment 2. Finding that the CIP is consistent with the City’s General Plan is appropriate if, considering all its aspects, it will further the objectives and policies of the general plan and not obstruct their attainment. Environmental Determination: Pursuant to the California Environmental Quality Act (CEQA), the finding of the CIP’s conformity with the City’s General Plan is exempt from CEQA under State CEQA Guidelines Section 15061(b)(3) (Common Sense Exemption), because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The action before the Planning Commission is limited to the determination of the General Plan Conformance of the preliminary CIP and would not approve the design, approval, or construction of the CIP projects. This project is combined with CIP 193 Pedestrian Crossing Safety Improvements. Phase I of the combined project was constructed in spring 2024, and installed Rectangular Rapid Flashing Beacons (RRFBs) and updated signing and striping at select pedestrian crossings on Hermosa Avenue, Manhattan Avenue, Pier Avenue, and Valley Drive. Phase II of this combined project will holistically evaluate the safety and accessibility in the vicinity of bus stops on Hermosa Avenue and at select other critical locations throughout the City then design and construct improvements. 105 Annual Street Improvements This project provides for pavement rehabilitation of various streets throughout the City. The project will also repair/replace deteriorated portions of sidewalk, curb and gutter, and curb ramps. This work will be performed following the sewer and storm drain repairs identified in the Sewer and Drainage Master Plans. This project is combined with CIP 695 Parking Lot A Improvements. 106 Annual Street Improvements This project provides for pavement rehabilitation of various streets throughout the City. The project will also repair/replace deteriorated portions of sidewalk, curb and gutter, and curb ramps. This work will be performed following the sewer and storm drain repairs identified in the Sewer and Drainage Master Plans. 107 Slurry Seal Improvements This project provides slurry sealing of various streets throughout the City to help maintain City streets. 109 Utility Box Wrappings This project will add decorative paint and/or wraps to City-owned utility boxes throughout the City. The City is engaging a local artist cooperative to create the artwork that will either be painted or applied via vinyl wrap to the boxes. City Yard staff, who have been trained in wrap application, will be involved in this project. 111 Gateway and Wayfinding Signs and Conceptual Design This project will evaluate gateway and wayfinding signage throughout the City. Recommendations will include locations, preliminary design, and order of magnitude cost estimates for final design, sign fabrication, and installation. 113 City Wide Multi-Space Meters Deployment This project will include the installation of additional signage for the Pay-By-App parking system for on-street parking spaces. The implementation will require the installation of signs that provide instructions for users and the zone numbers necessary to use the system. The industry recommendation is that at least two signs be installed per block. City staff will install the necessary signage and any additional poles. It is estimated that the City will need approximately 375 signs installed, and 30 new poles installed in some locations due to a lack of existing poles. The installation will occur in areas of the city where paid parking is currently provided. 114 Greenwich Village North Undergrounding This project consists of the undergrounding of the existing overhead utilities along Hermosa Avenue from 25th Street to 35th Street as approved by the property owners located within the Greenwich Village North Underground Utilities Assessment District. 115 Annual City Sidewalk Improvements This project provides repairs, grinding, replacement, and improvements to sidewalks throughout the city at various locations to maintain and improve safety. Page 98 of 115 Fiscal Year 2025-2026 CIP Program Summary CIP Number Project Name Project Description 143 PCH Mobility Improvement Project The City has identified a number of complete street project elements that can be implemented to improve mobility, accessibility, and safety along the Pacific Coast Highway (PCH) corridor in Hermosa Beach. These elements are described in the Project Study Report prepared by the City and Caltrans in 2015 and include: Traffic Signal Synchronization, Landscape Medians, Americans with Disabilities Act (ADA) Improvements/Removal of Utility Impediments, Transit Access Enhancements, Pedestrian Enhancements, and Aesthetic Enhancements. Collectively, the improvements will address existing, near-term, and long-range future traffic conditions along this corridor by improving intersection operations, reducing instances of unsafe turning movements, creating a safe and more comfortable environment for pedestrians and transit riders, and improving the efficient movement of vehicles along the corridor. 164 Hermosa Avenue Green Street This project will install permeable gutter to increase stormwater infiltration on Hermosa Avenue, Beach Drive, Herondo Street, 6th Street, 2nd Street, 1st Street, and adjacent streets. This project is part of a multicity green street project led by the City of Torrance and funded by Measure W. 193 Pedestrian Crossing Safety Improvements This project will implement rectangular rapid flashing beacons and other measures at several uncontrolled pedestrian crossings on Hermosa Avenue at 4th, 6th, 19th, 24th, and 25th Streets. This project is combined with CIP 193 Pedestrian Crossing Safety Improvements. Phase I of the combined project was constructed in spring 2024, and installed Rectangular Rapid Flashing Beacons (RRFBs) and updated signing and striping at select pedestrian crossings on Hermosa Avenue, Manhattan Avenue, Pier Avenue, and Valley Drive. Phase II of this combined project will holistically evaluate options to reconfigure parking to enhance pedestrian safety, feasibility of curb extensions and median closures, and accessibility on Hermosa Avenue and at select other critical locations throughout the City then design and construct improvements. 417 Storm Drain Improvements - Various Locations This project will design and construct storm drain improvements throughout the City per the Storm Drain Master Plan and other high priority locations. 421 Annual Sewer Improvements - Phase 2 Phase 1 of this project, which included lining, was completed. Phase 2 of this project includes design and construction of sewer improvements and repairs based on the Sewer Master Plan. Improvements will include sewer pipe point repairs; sewer pipe removal and replacement; and maintenance access hole rehabilitations. Sewer repairs will take place at various locations throughout the City as part of this project. 423 Annual Sewer Improvements This project includes design and construction of sewer improvements and repairs based on the Sewer Master Plan. Improvements will include lining, point repairs, removal and replacement. 438 Stormwater Dry Wells Assessment As required by the region’s Enhanced Watershed Management Plan (EWMP), this project will assess the implementation of a series of drywells at various locations throughout the City to capture storm water and dry weather flows within 118 acres of the Herondo Drain (SMB-6-1) watershed. The project currently includes funding for design of the improvements; construction costs will be further defined through the design process. 611 Parking Structure (Lot C) Improvements – Phase 2 This project includes remaining structure work from the 2021 assessment which includes replacement and modifications to handrails and cable guard rails and painting. 615 New Corporate Yard Facilities This project is for the design and construction of a new City Yard. The current City Yard is in need of reconstruction. A new City Yard will provide a safe and functional area for City maintenance crews and staging. 617 Civic Center Charging Stations This project will explore the electrical power needs and installation of expanded electric vehicle charging infrastructure to serve the Police Department fleet on Bard Street, adjacent to the Police Department and City Hall. The expanded charging infrastructure will install 20 Level 2 chargers. 618 Tsunami Siren This partial grant-funded project will include assessment and possible implementation of LA County BEELS (Beach Emergency Evacuation Lights System) in the City or an alternative tsunami siren system. 619 Kelly Courts Improvements This project will resurface and reconfigure the Kelly Courts at Clark Field. The courts will be restriped and reconfigured and the lights and fencing relocated to meet court standards. 621 Comprehensive Downtown Lighting Design This project will assess light levels, electric system requirements, and desired lighting improvements (i.e., ornamental, roadway, pedestrian scale) for the City's Downtown district. The project will identify scope of required improvements and cost estimates for final design and construction. 623 Pier Structural Repairs An emergency partial inspection and evaluation was performed in coordination with CIP 629 and CIP 660, the results of which identified high priority repairs which were completed through CIP 629. Following completion of construction of CIP 629 and CIP 660, a full above and below water structural inspection of the pier is required to meet requirements for marine structures. Based on this inspection, it is anticipated that additional pier structural repairs will be required primarily on the pier deck. This project will also include design, permitting, and repairs. 625 City-Wide ADA Improvements This project will provide improvements to access to the Civic Center to comply with the Americans with Disabilities Act (ADA) and meet the latest Federal Standards along with the City’s Transition Plan. The project will provide improvements to curb ramps, sidewalk, and parking in front of City Hall and install a wheelchair lift for access from the Valley Drive parking lot to the front of City Hall. 626 CDBG Improvements This project provides improvements to sidewalks and curb ramps on Monterey Boulevard in order to comply with the Americans with Disabilities Act (ADA) and meet the latest Federal Standards.
