Planning Commission agendas and staff reports are available for review on the City's web site at

Written materials distributed to the Planning Commission within 72 hours
of the Planning Commission meeting are available for public inspection immediately
upon distribution in the Community Development Department during normal business hours
from Monday through Thursday, 7:00 AM - 6:00 PM and on the City's website.
Final determinations of the Planning Commission may be appealed to the City Council within 10 days
of the next regular City Council meeting date. If the 10th day falls on a Friday or City holiday, the
appeal deadline is extended to the next City business day. Appeals shall be in written form and filed
with the City Clerk's office, accompanied by an appeal fee. The City Clerk will set the appeal for public
hearing before the City of Hermosa Beach City Council at the earliest date possible.
If you challenge any City of Hermosa Beach decision in court, you may be limited to raising only those
issues you or someone else raised at the public hearing described on this agenda, or in a written
correspondence delivered to the Planning Commission at, or prior to, the public hearing.
To comply with the Americans with Disabilities Act (ADA) of 1990, Assistive Listening Devices will be

21-0044 S-4 #40 Determine whether an existing 220 square foot display on the
west facade of the building at 844 Hermosa Ave (The Stanton HB) is a
mural, and determine that the project is exempt from the California
Environmental Quality Act.
Recommendation:Adopt the attached resolution and determine that the existing display covering 220
square feet of surface area on the west facade of an existing building is consistent with
the Hermosa Beach Municipal Code (HBMC) definition of 'Mural' at 844 Hermosa Ave
(The Stanton HB), and determine that the project is exempt from the California
Environmental Quality Act.
9.REPORT
21-0043 S-21 #37- Determine that the property is a convex sloping lot and may
use alternate spot elevations rather than property corner elevations
along the east and west property lines for the purposes of determining
building height at 301 27th Street and determine that the project is
exempt from the California Environmental Quality Act.
Recommendation:Staff recommends the Planning Commission approve the request to determine the
property is a convex sloping lot and allow the use of alternative spot elevations,
excluding fill soils, for determining building height along the east and west property
lines.

to adopt the resolution, with the modifications noted below, approving the
Parking Plan (PARK 20-4) to allow medical clinic/office uses at an existing
multi-tenant commercial building (Pacific Plaza Offices) located at 2200 Pacific
Coast Highway based on use of up to 40 shared parking spaces with 2420 Pacific
Coast Highway (Hope Chapel); and determination that the project is categorically
exempt from the California Environmental Quality Act (CEQA).
-Section 5, Condition of Approval (COA) #1: Update the date from November 17,
2020 to December 15, 2020.
-COA #6: Add a new sentence regarding the use of 40 spaces, per the
supplemental memorandum.
-COA #8a: Also include the lower level parking (18 spaces), in addition to the

NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Hermosa Beach shall hold a public
hearing on Tuesday, January 19, 2021, to consider the following:
1. S-21 #37- Determine that the property is a convex sloping lot and may use alternate spot elevations, as
allowed by HBMC Section 17.04.040, rather than property corner elevations, along the east and west
property lines for the purposes of determining building height at 301 27th Street, and determine that the
project is exempt from the California Environmental Quality Act.
2. S-4 #40 - Determine that an existing 220 square foot display on the west façade of the building at 844
Hermosa Ave (The Stanton HB) is a mural, and determine that the project is exempt from the California
Environmental Quality Act.
SAID PUBLIC HEARINGS shall be held virtually at 6:00 PM, or as soon thereafter as the matter may be heard.

Background:
The subject property is located at 844 Hermosa Ave and is improved with a 4,220 square foot
restaurant (The Stanton HB).The site is located on the east side of Hermosa Avenue between 10th
Street and 8th Street in the Downtown District,abutting an alley behind the business to the east,and
was formerly occupied by “Hot’s Kitchen”.The applicant proposes to maintain a 220 square foot
display on the west façade of the existing building facing Hermosa Avenue.
The applicant submitted a sign application for the mural review,on November 23,2020,as a result of
a code enforcement action of an unpermitted painted wall sign on the commercial building.The
display was painted sometime in the fall of 2020.The applicant is requesting the Commission

muralist and local artist Ruben Rojas. The display is entitled, “Unconditional Love.”

role in shaping the city’s identity and is appreciated by residents and visitors alike.Public art displays
in Hermosa Beach often help to share the rich cultural history of the town in the form of sculptures,
murals,and placards or informational displays.These more permanent and highly visible displays -
such as the many murals adorning previously blank walls throughout Downtown -contribute to the
beautification and aesthetic value of the community and are the result of cooperation,dedication,and

Environmental Analysis:
Staff finds the project to be categorically exempt from the California Environmental Quality Act
defined in CEQA Section 15301 Class 1 Existing Facilities,as the project involves negligible or no
expansion of an existing use.The approval of the display as a mural,would not result in a direct or
reasonably foreseeable indirect physical change in the environment.
Conclusion:
Staff concludes the display is a mural because it does not directly advertise products or goods
offered on the premises, but instead depicts the word “love:”
Staff recommends the Planning Commission adopt the attached resolution to determine that the
proposed display is a mural pursuant to HBMC Sections 17.50.030 and 17.50.130.B.8,and
determine that the proposed display is exempt from the California Environmental Quality Act (CEQA).

The Planning Commission of the City of Hermosa Beach does hereby resolve and order as
follows:
Section 1. An application was filed on November 23, 2020 by the applicant Jason Coates,
seeking Planning Commission determination whether the existing unpermitted display covering
220 square feet of the west façade of an existing building is consistent with the Hermosa Beach
Municipal Code (HBMC) definition of “Mural” for the building located at 844 Hermosa Avenue.
Section 2. HBMC Section 17.50.030 defines a mural as “a pictorial representation
not specifically identifying goods or services offered by the business on the premises.”
Section 3. The Planning Commission, at its public meeting of January 19, 2021, considered all testimony and evidence, both oral and written, that was presented to the
Planning Commission.
Section 4. The proposed display is categorically exempt from the California
Environmental Quality Act defined in CEQA Section 15301 Class 1 Existing Facilities, as the project involves negligible or no expansion of an existing use. The proposed display will be painted directly onto the west facade of the existing building and will not result in a direct or
reasonably foreseeable indirect physical change in the environment.
Section 5. Based on the evidence received at the public meeting, the Planning Commission hereby finds, determines, and declares:
1. The display meets the definition of a mural as set forth in HBMC Section 17.50.030,
because the business on the premises, The Stanton HB, is a restaurant that offers food and
beverages for customers, and the proposed display is an artistic representation of hearts and the word “love”.
2. Pursuant to HBMC Section 17.50.130.B, it is appropriate to waive the specific provisions
of the sign code pertaining to sign area, coverage, height, type and style for the 220 sq. ft.
mural display because the display meets the definition of a mural. Section 6. Based on the evidence received at the public meeting, the Planning
Commission hereby further finds, determines, and declares that the project is consistent the
City’s General Plan (PLAN Hermosa) because the mural is a considered public art that
improves the public realm design of the Downtown District Neighborhood Character Area.

Section 7. Pursuant to the Code of Civil Procedure Section 1094.6, any legal challenge to the decision of the Planning Commission, after exhaustion of any available
administrative remedies, must be made within 90 days after the final decision by the
City. The Hermosa Beach City Council may on its own initiative review all actions of the
Planning Commission. If the City Council does not initiate review of this decision as set
forth in Hermosa Beach Municipal Code Section 2.52.040, this decision will become final.

Background:
The subject lot is an interior lot located at the north end of the City;on the north side of 27th Street
between Manhattan Avenue and Morningside Drive.The lot is zoned R-2 Two-Family Residential
which has a maximum building height limit of 30 feet.Site topography descends gently from north to
south.The parcel is occupied by a single-family residence,concrete walkways,and landscaping.The
existing 930 square foot single-family residence was constructed in 1950.The applicant is proposing
a new single-family residence.Other improvements may include concrete pavement areas and
landscaping.
The applicant requests the use of alternate points along the east and west side property lines for
determining building height rather than a straight-line interpolation between the property corner
points.The applicant believes the survey and topographic profiles shows one convex slope
conditions at the west portion of the property and requests use of alternative spot elevations at the
apex of the convex slope, as indicated along the east and west property lines.
City records indicate no prior convex slope determinations along 27th Street.The lack of previous
convex slope determinations does not mean that a convex slope does not exist on this property,but
rather it indicates the surrounding properties have not been redeveloped or that other property

rather it indicates the surrounding properties have not been redeveloped or that other property
owners have not applied for a convex slope determination.
Analysis:
Due to the City’s varied topography,the Hermosa Beach Municipal Code (HBMC)authorizes
consideration of the convex slope method of calculating building height when supported through
technical evidence.Convex slope determinations are not a variance or an exception to the height
limits established within the underlying zones.If a lot contains natural terrain where the grade level
arches upward along the property line,then measuring height from the alternate points may be
deemed appropriate.
HBMC Sections 17.04.040 and 17.46.015 provide the definitions of ‘building height’and ‘grade’and
establish the “by-right/straight line interpolation”method for calculating building height.The grade
used for height measurements is based on surveyed elevation points at the property corners (see
Figure 1 below).

HBMC Section 17.04.040 allows the use of alternate spot elevation points along the property lines for
lots with “convex”contours (where the grade level arches upward along the property line).In these
situations,the grade of a lot would be based upon the detailed topographical survey,which includes
spot elevations,called out at a minimum of two-foot intervals,along the property lines.This finding of
a convex slope is supported by evidence that grades at the top of said convex slope represents the
natural or unaltered grades,as determined by the Planning Commission (see Figure 2 below).

The applicant believes a natural convex slope condition exists, as indicated along the east and west
property lines. A Geotechnical Engineering Investigation (soils report), which was prepared by NorCal
Engineering and dated October 6, 2020, was submitted for the subject property. The soils report
details the types of soil present at various soil samples measured between two and 21 feet in depth,
on the property as shown on Pages 1 and 6 of Appendix A of the soils report.
The soils report reveals that fill soils between one and two feet were encountered at six different bore
sites. Below the fill/disturbed top soils undisturbed native soil was present. Bore sites B-1 and B-4 are
located at the apex of the convex slope and would be used to determine how much fill soils to
exclude along the east and west property lines. On the west property line, the point of convexity is
located at the 97.18 elevation. With 2 feet of fill soil present, the adjustment from the straight-line
interpolation would be around one foot. On the east property line where the point of convexity is at
the 100.91 elevation and one foot six inches of fill soil present, the adjustment from the straight-line
interpolation would be around two feet. Details of the subsurface conditions are provided in Appendix
B of the soils report.

The soil samples have the same soil type (silty sand)for both fill and natural soils with the only
variation between fill and natural soils being the moisture content and level of compactness along
with minimum gravel,roots and loose brick pieces which can typically be found at the surface of the

-made structures does staff recommend use of alternate points at top of fill.
Environmental Analysis:
The proposed project is Categorically Exempt from the California Environmental Quality Act as
defined in Section 15303(a),Class 3 Exemption,New Construction or Conversion of Small
Structures,because the proposal is to determine the required height that will be used to build a new
single-family residence.
Conclusion:
Due to the point of convexity on the subject lot being near man-made structures such as the building
pad and low-lying retaining walls,staff recommends the exclusion of fill soils.Staff believes that the
topographic survey and soils report provide evidence that the rolling hill slope is a natural occurrence
and a convex condition exists on the subject property.The natural grades along the east and west
property lines are best represented by the surveyed alternate points excluding any fill soil.This will
result in a slight adjustment of about two feet on the west property line and one foot at the east
property line at these points of convexity.Staff recommends that alternate points along the east and
west property lines, excluding fill soil, be used for purposes of measuring building height.

These comments are in connection with Report 21-0043.
S-21 #37. Determine that the property is a convex sloping lot and may use alternative spot elevations rather than
property corner elevations along the east and west property lines for the purposes of determining building height at 301 27
Street and determine that the project is exempt from the California Environmental Quality Act.
My home is to the immediate east of 301 27th Street. I had an architect look at the paperwork and he had the following
comments:
Based on the Soil Report - specifically borings #3 and #4 along [my] property and borings #1 and #2
along the west side of 301 27th Street, the grades shown on the survey ARE NOT representative of
natural grade.
Borings #3 and #4 each show 2’-0” of fill soils, which would account for the convex shape from the
Southeast property corner to the northeast property corner.
Boring #1 shows 2-0” of fill soil and boring #2 shows 2’-6” of fill soil over the natural grade.
If these differences are taken out of the convex shape shown on the survey, the resulting grade would
be within 1’-0” of the straight line interpolation used by the City to determine allowed Building Height.
There is not enough of a difference between the Natural Grade (without the added fill soil) and the
interpolated grade to justify the use of a convex slope for the allowed height.
From a personal standpoint, my comments are that no other lot on 27th Street has been determined to be a convex slope,
and the house is on a hill so its view cannot be blocked. In Hermosa Beach, we treasure our views. I bought my house
for the view even though it is on a main street, and I plan to remain and raise my daughter in my home. The hill does
level off after this house. As a result, it seems that many views will be blocked by allowing this lot to be designated
convex. Given that it is not a convex slope, I would ask that the request be denied thereby allowing many long-term home
owners/neighbors to keep as much of their views as possible. I appreciate your consideration.
