Staff Recommended Action: To conduct the public hearing and direct staff to return with a resolution to modify the Conditional Use Permit set forth in City Council Resolution 07-6531 as directed by the Commission. ACTION: To direct staff to return with a resolution at the February 19, 2013 meeting to modify the Conditional Use Permit as recommended by staff including modifying the closing time from 2:00 a.m. to 12:00 midnight, with following changes: 1) Condition 1.4 under 1. Permitted Use: Admission shall not be charged for entrance into the business except on Thursday through Saturday, nor shall drink minimums of any kind be imposed at any time. 2) Condition 7.1 under 7. The modification will include the removal of three (3) panel antennas and installation of (3) new panel antennas inside an existing fake chimney, Addition of six (6) RRHs below the parapet. The antennas and associated RRH’s will be completely screened from view. In addition, Sprint-Nextel will replace an equipment cabinet, replace a battery cabinet, remove a power cabinet, install new fiber optic cables, and install a small fiber junction box all within the existing lease area. The subject site is located at 1060 Aviation Blvd., Hermosa Beach, CA. The proposed modifications are consistent with the general requirements of the Wireless Telecommunications Facility standards set forth in Section 17.40.170. Sprint-Nextel is a telecommunications service provider operating wireless telecommunication sites throughout California and the nation. Sprint-Nextel and its affiliates have acquired licenses from the Federal Communications Commission (“FCC”) throughout the United States. These licenses include the City of Hermosa Beach, Los Angeles County, California. Description of Use Sprint-Nextel proposes to modify, operate and maintain a wireless communications facility on an existing building. . The modification will include the removal of three (3) panel antennas and installation of (3) new panel antennas inside an existing fake chimney, Addition of six (6) RRHs below the parapet. The antennas and associated RRH’s will be completely screened from view. In addition, Sprint- Nextel will replace an equipment cabinet, replace a battery cabinet, remove a power cabinet, install new fiber optic cables, and install a small fiber junction box all within the existing lease area. The antennas will not significantly alter the architectural appearance or result in any material change to the nature of the use of the building or affect the character of the community; in fact the new design will not change and will not be noticed at all by the casual observer. The equipment cabinets will be placed in the existing equipment area on the side building and completely screened from view. ATTACHMENT 6 Sprint Nextel’s modifications will not in any way be a detrimental impact on the surrounding property. This facility will not impair the use or enjoyment of, or be otherwise injurious to, property in the immediate vicinity because the antennas will be screened and the screening will be painted to match the building, and the equipment cabinet will be located in the existing equipment area which is disguised to match the building. Furthermore, the facility will not emit smoke, debris, noise, or any other type of nuisance. For these reasons, the facility is practically undetectable to the casual observer. However, enhanced wireless communications will have a positive influence on personal, business, governmental and other existing uses in this area. Each application shall contain a brief narrative accompanied by written documentation that explains and validates the applicant's efforts to locate the facility in accordance with the Screening and Site Selection Guidelines set forth in this Section. Sprint-Nextel proposes to replace the antennas that are located within an existing fake chimney, install RRH’s that are screened by the existing parapet, and replace equipment that is in an existing lease area disguised to match the building. None of the proposed changes will be visible to the general public. This is an existing site, which is being upgraded; but there will be no visual impact Each application shall contain a narrative that discloses the exact location and nature of any and all existing facilities that are owned (including publicly owned structures), operated or used by the applicant and located within five (5) miles from the geographic borders of the City of Hermosa Beach. See attached list of all sites within the City limit. Each application shall contain a narrative and scaled map(s) that precisely disclose the geographic area(s) within the City of Hermosa Beach that are proposed to be serviced by the proposed facility, the geographic area(s) bordering the City of Hermosa Beach, if any, that will be serviced by the proposed facility, the nature of the service to be provided or purpose of the facility, the reasons, if any, why the applicant cannot locate the facility outside the City of Hermosa Beach, and the efforts, if any, that applicant has made to locate the facility outside the City of Hermosa Beach. This is an existing site, and this upgrade will allow for better service to the surrounding community. See attached phone and data propagation maps. Notwithstanding any permit that may be granted in accordance with this Section, the facility shall be erected, located, operated and maintained at all times in compliance with this Section and all applicable laws, regulations and requirements of the Building Code, and every other code and regulation imposed or enforced by the City of Hermosa Beach, the State of California, and the United States Federal Government. Applicants are separately required to obtain all applicable building and construction permits that may be required prior to erecting or installing the facility. The proposed installation will be designed and constructed to meet applicable governmental and industry safety standards. Specifically, Sprint-Nextel will comply with all FCC and FAA rules governing construction requirements, technical standards, interference protection, power and height limitations and radio frequency standards. The proposed facility will operate at the lowest possible power level, and is designed to be well below established standards used by the FCC for safe human exposure to radio frequency electromagnetic fields. Each wireless communications carrier applicant shall provide a letter to the director of community development stating willingness to allow other carriers to co-locate on their facilities wherever feasible or a written explanation why the subject facility is not a candidate for co-location. Sprint is open to collocation as long as there is no interference with their facility. An RF Environmental Evaluation Report must be prepared by the applicant indicating that the proposed wireless communications facility meets FCC regulations and standards for construction, maintenance and operations. Ten days after installation and every two years thereafter, the telecommunications service provider must submit a certification report, attested to by a licensed engineer expert in the field of RF emissions, that the facility is compliant with the applicable FCC regulations for RF emissions. See attached report. The proposed wireless communications facility meets FCC regulations and standards for construction, maintenance and operations. Ten days after installation and every two years thereafter, the telecommunications service provider must submit a certification report, attested to by a licensed engineer expert in the field of RF emissions, that the facility is compliant with the applicable FCC regulations for RF emissions. Sprint-Nextel will provide a report after construction and every two years. Approval of the project is subject to the Planning Commission making a finding that the proposed site results in fewer or less severe environmental impacts than any feasible alternative site. The City may require independent verification of this analysis at the applicant’s expense. The intention of the alternatives analysis is to present alternative strategies which would minimize the number or size and adverse environmental impacts of facilities necessary to provide the needed services to the City and surrounding areas. N/A, this is a modification to an existing site. Conclusion: Sprint-Nextel understands the City’s desire to have these sites designed in a manner that reduces their visual impact. By placing these antennas inside an existing screen disguised as a chimney, it will reduce any impact this upgrade may have; the modified facility will have no visual impact on the surrounding community and environment. The antennas will not change the building’s architectural appearance or impact its use. Furthermore, the proposed facility will have no substantial adverse impact on properties or improvements in the surrounding neighborhood. (dba EBI Consulting) has been contracted by Sprint Nextel to conduct radio frequency electromagnetic (RF-EME) modeling for Sprint Site LA37XC777 located at 1060 Aviation Boulevard in Hermosa Beach, California to determine RF-EME exposure levels from the proposed Sprint wireless communications equipment at this site. As described in greater detail in Section 11.0 of this report, the Federal Communications Commission (FCC) has developed Maximum Permissible Exposure (MPE) Limits for general public exposures and occupational exposures. This report summarizes the results of RF-EME modeling in relation to relevant FCC RF-EME compliance standards for limiting human exposure to RF-EME fields. This report contains a detailed summary of the RF EME analysis for the site. This document addresses the compliance of Sprint’s proposed transmitting facilities independently. MPE Summary At the nearest walking/working surfaces to the proposed Sprint antennas, the maximum power density is 163.00 percent of the FCC’s general public limit (32.60 percent of the FCC’s occupational limit). At ground level, the maximum power density generated by the Sprint antennas combined with the existing other carriers antennas on site is 4.60 percent of the FCC’s general public limit (0.92 percent of the FCC’s occupational limit). Statement of Compliance: Based on worst-case predictive modeling, the worst-case emitted power density may exceed the FCC’s general public limit within approximately 5 feet of Sprint’s proposed antennas at the main roof level. Modeling also indicates that the worst-case emitted power density does not exceed the FCC’s occupational limit within any distance of Sprint’s proposed antennas at the main roof level. Signage is recommended at the site as presented in Section 9.0. Posting of the signage and installation of barriers brings the site into compliance with FCC rules and regulations. There are three Sectors (A, B, and C) proposed to be modified at the site, with one (1) antenna to be re-installed per sector. There were no collocated carriers on the rooftop. 2.0 LOCATION OR ALL APPROVED (BUT NOT INSTALLED) ANTENNAS AND FACILITIES AND EXPECTED RF LEVELS FROM THE APPROVED FACILITIES There are no antennas or facilities that are approved and not installed based on information provided to EBI and Sprint at the time of this report. 3.0 NUMBER AND TYPES OF WIRELESS TELECOMMUNICATION SITES (WTS) WITHIN 100 FEET OF THE PROPOSED SITE With the exception of the antennas mentioned in Section 1.0, there are no other Wireless Telecommunication Service (WTS) sites observed within 100 feet of the proposed site. 4.0 LOCATION AND NUMBER OF THE SPRINT ANTENNAS AND BACK-UP FACILITIES PER BUILDING AND NUMBER AND LOCATION OF OTHER TELECOMMUNICATION FACILITIES ON THE PROPERTY Sprint proposes the removal of three (3) existing antennas replaced with three (3) proposed Sprint wireless telecommunication antennas on a rooftop located at 1060 Aviation Boulevard in Hermosa Beach, California. There are three Sectors (A, B, and C) proposed to be modified at the site, with one (1) antenna to be re-installed per sector. In each sector, there is proposed to be one antenna transmitting in the 800 MHz and the 1900 MHz frequency ranges. The Sector A antenna will be oriented 45° from true north. The Sector B antenna will be oriented 175° from true north. The Sector C antenna will be oriented 319° from true north. The bottoms of the Sector A and B antennas will be 5.25 feet above the rooftop. The bottoms of the Sector C antenna will be 32 feet above ground level. There were no collocated carriers on the rooftop. 5.0 POWER RATING FOR ALL EXISTING AND PROPOSED BACKUP EQUIPMENT SUBJECT TO THE APPLICATION The operating power for modeling purposes was assumed to be 20 Watts per transmitter for the 800 MHz antenna and there will be one (1) transmitter operating at this frequency per sector. Additionally, for modeling purposes it was assumed to be 20 Watts per transmitter and three (3) transmitters per sector operating at the 1900 MHz. 6.0 TOTAL NUMBER OF WATTS PER INSTALLATION AND THE TOTAL NUMBER OF WATTS FOR ALL INSTALLATIONS ON THE BUILDING The effective radiated power (ERP) for the 800 MHz transmitter combined on site is 405 Watts. The ERP for the 1900 MHz transmitters combined on site is 3,353 Watts. The site is located on a motel rooftop, and is within 100 feet of two additional inhabited buildings to the northeast and southwest. 8.0 ESTIMATED AMBIENT RADIO FREQUENCY FIELDS FOR THE PROPOSED SITE Based on worst-case predictive modeling, the worst-case emitted power density may exceed the FCC’s general public limit within approximately 5 feet of Sprint’s proposed antennas at the main roof level. Modeling also indicates that the worst-case emitted power density does not exceed the FCC’s occupational limit within any distance of Sprint’s proposed antennas at the main roof level. Based on worst-case predictive modeling, there are no areas at ground level related to the proposed Sprint antennas that exceed the FCC’s occupational or general public exposure limits at this site. At the nearest walking/working surfaces to the proposed Sprint antennas, the maximum power density is 163.00 percent of the FCC’s general public limit (32.60 percent of the FCC’s occupational limit). The inputs used in the modeling are summarized in the RoofView® export file presented in Appendix B. 9.0 SIGNAGE AT THE FACILITY IDENTIFYING ALL WTS EQUIPMENT AND SAFETY PRECAUTIONS FOR PEOPLE NEARING THE EQUIPMENT AS MAY BE REQUIRED BY THE APPLICABLE FCC ADOPTED STANDARDS (DISCUSS SIGNAGE FOR THOSE WHO SPEAK LANGUAGES OTHER THAN ENGLISH) Signs are the primary means for control of access to areas where RF exposure levels may potentially exceed the MPE. It is recommended that signage be installed for the new antennas making people aware of the antennas locations. There are exposures above the FCC limits in front of the proposed antennas and therefore barriers are recommended. Additionally, there are areas where workers elevated above the rooftop and ground may be exposed to power densities greater than the general population and occupational limits. Workers and the general public should be informed about the presence and locations of antennas and their associated fields. Access to this site is unknown. (IEEE) and adopted by the American National Standards Institute (ANSI) to replace the 1982 ANSI guidelines. Limits for localized absorption are based on recommendations of both ANSI/IEEE and NCRP. The FCC guidelines incorporate two separate tiers of exposure limits that are based upon occupational/controlled exposure limits (for workers) and general public/uncontrolled exposure limits for members of the general public. Occupational/controlled exposure limits apply to situations in which persons are exposed as a consequence of their employment and in which those persons who are exposed have been made fully aware of the potential for exposure and can exercise control over their exposure. Occupational/ controlled exposure limits also apply where exposure is of a transient nature as a result of incidental passage through a location where exposure levels may be above general public/uncontrolled limits (see below), as long as the exposed person has been made fully aware of the potential for exposure and can exercise control over his or her exposure by leaving the area or by some other appropriate means. General public/uncontrolled exposure limits apply to situations in which the general public may be exposed or in which persons who are exposed as a consequence of their employment may not be made fully aware of the potential for exposure or cannot exercise control over their exposure. Therefore, members of the general public would always be considered under this category when exposure is not employment-related, for example, in the case of a telecommunications tower that exposes persons in a nearby residential area. Table 1 and Figure 1 (below), which are included within the FCC’s OET Bulletin 65, summarize the MPE limits for RF emissions. These limits are designed to provide a substantial margin of safety. They vary by frequency to take into account the different types of equipment that may be in operation at a particular facility and are “time-averaged” limits to reflect different durations resulting from controlled and uncontrolled exposures. The FCC’s MPEs are measured in terms of power (mW) over a unit surface area (cm 2). Known as the power density, the FCC has established an occupational MPE of 5 milliwatts per square centimeter (mW/cm2) and an uncontrolled MPE of 1 mW/cm2 for equipment operating in the 1900 MHz frequency range. For the Sprint equipment operating at 800 MHz, the FCC’s occupational MPE is 2.66 mW/cm2 and an uncontrolled MPE of 0.53 mW/cm2. These limits are considered protective of these populations. Facilities typically consist of: 1) electronic transceivers (the radios or cabinets) connected to wired telephone lines; and 2) antennas that send the wireless signals created by the transceivers to be received by individual subscriber units (PCS telephones). Transceivers are typically connected to antennas by coaxial cables. Because of the short wavelength of PCS services, the antennas require line-of-site paths for good propagation, and are typically installed above ground level. Antennas are constructed to concentrate energy towards the horizon, with as little energy as possible scattered towards the ground or the sky. This design, combined with the low power of PCS facilities, generally results in no possibility for exposure to approach Maximum Permissible Exposure (MPE) levels, with the exception of areas directly in front of the antennas. FCC Compliance Requirement A site is considered out of compliance with FCC regulations if there are areas that exceed the FCC exposure limits and there are no RF hazard mitigation measures in place. Any carrier which has an installation that contributes more than 5% of the applicable MPE must participate in mitigating these RF hazards. 12.0 LIMITATIONS This report was prepared for the use of Sprint Nextel. It was performed in accordance with generally accepted practices of other consultants undertaking similar studies at the same time and in the same locale under like circumstances. The conclusions provided by EBI are based solely on the information provided by the client. The observations in this report are valid on the date of the investigation. No other warranty, expressed or implied, is made. 13.0 SUMMARY AND CONCLUSIONS EBI has prepared this Radiofrequency Emissions Compliance Report for the proposed Sprint telecommunications equipment at the site located at 1060 Aviation Boulevard in Hermosa Beach, California. EBI has conducted theoretical modeling to estimate the worst-case power density from Sprint antennas and the other carriers’ existing antennas to document potential MPE levels at this location and ensure that site control measures are adequate to meet FCC and OSHA requirements. As presented in the preceding sections, based on worst-case predictive modeling, the worst-case emitted power density may exceed the FCC’s general public limit within approximately 5 feet of Sprint’s proposed antennas at the main roof level. Modeling also indicates that the worst-case emitted power density does not exceed the FCC’s occupational limit within any distance feet of Sprint’s proposed antennas at the main roof level. Signage is recommended at the site as presented in Section 9.0. Posting of the signage and installation of the recommended barriers brings the site into compliance with FCC rules and regulations.
