Written materials distributed to the Planning Commission within 72 hours of the Planning Commission meeting are available for public inspection immediately upon distribution in the Community Development Department during normal business hours from Monday through Thursday, 7:00 a.m. - 6:00 p.m. and on the City’s website. Final determinations of the Planning Commission may be appealed to the City Council within 10 days of the next regular City Council meeting date. If the 10th day falls on a Friday or City holiday, the appeal deadline is extended to the next City business day. Appeals shall be in written form and filed with the City Clerk's office, accompanied by an appeal fee. The City Clerk will set the appeal for public hearing before the City of Hermosa Beach City Council at the earliest date possible. TEXT 12-4 -- Amendment to the Municipal Code to allow and regulate mobile food vendors within the City of Hermosa Beach, create an administrative permit process within the Zoning Code, and various amendments for consistency, and adoption of an Environmental Negative Declaration. Staff Recommended Action: To adopt the attached resolution recommending adoption of an environmental Negative Declaration and amendment to the Municipal Code governing mobile food vendors including establishing an administrative permit process. 3 9. The conditional use permit being modified is Resolution No. 03-37. The modification will include the removal of three (3) panel antennas and installation of (3) new panel antennas inside an RF transparent canister disguised as a light pole, and the addition of six (6) RRHs below the existing ceiling. The existing canister will need to be expanded to accommodate the new technology. The antennas and associated RRH’s will be completely screened from view. In addition, Sprint-Nextel will retrofitted an equipment cabinet, install new fiber optic cables, and install a small fiber junction box all within the existing lease area which is inside the parking structure. The subject site is located at 1301 Hermosa Ave., Hermosa Beach, CA. The proposed modifications are consistent with the general requirements of the Wireless Telecommunications Facility standards set forth in Section 17.40.170. Sprint-Nextel is a telecommunications service provider operating wireless telecommunication sites throughout California and the nation. Sprint-Nextel and its affiliates have acquired licenses from the Federal Communications Commission (“FCC”) throughout the United States. These licenses include the City of Hermosa Beach, Los Angeles County, California. Description of Use Sprint-Nextel proposes to modify, operate and maintain a wireless communications facility on an existing building. The modification will include the removal of three (3) panel antennas and installation of (3) new panel antennas inside an RF transparent canister disguised as a light pole, and the addition of six (6) RRHs below the existing ceiling. The existing canister will need to be expanded to accommodate the new technology. The antennas and associated RRH’s will be completely screened from view. In addition, Sprint-Nextel will retrofitted an equipment cabinet, install new fiber optic cables, and install a small fiber junction box all within the existing lease area which is inside the parking structure. The antennas will not significantly alter the architectural appearance or result in any material change to the nature of the use of the building or affect the character of the community; the new design will not be noticed at all by the casual observer. The equipment cabinets will be placed in the existing equipment area inside the parking structure and not visible to the passing public. Sprint Nextel’s modifications will not in any way be a detrimental impact on the surrounding property. This facility will not impair the use or enjoyment of, or be otherwise injurious to, property in the immediate vicinity because the antennas will be screened and the screening will be painted to match the existing design, and the equipment cabinet will be located in the existing equipment area which is inside the parking structure. Furthermore, the facility will not emit smoke, debris, noise, or any other type of nuisance. For these reasons, the facility is practically undetectable to the casual observer. However, enhanced wireless communications will have a positive influence on personal, business, governmental and other existing uses in this area. Each application shall contain a brief narrative accompanied by written documentation that explains and validates the applicant's efforts to locate the facility in accordance with the Screening and Site Selection Guidelines set forth in this Section. Sprint-Nextel proposes to replace the antennas that are located within an existing cylinder of a light standard on the parking structure, expand the cylinder, install RRH’s that are screened by the existing building and retrofit equipment that is in the existing parking structure. None of the proposed equipment will be visible to the general public. This is an existing site, which is being upgraded; and there will be little to no visual impact. Each application shall contain a narrative that discloses the exact location and nature of any and all existing facilities that are owned (including publicly owned structures), operated or used by the applicant and located within five (5) miles from the geographic borders of the City of Hermosa Beach. See attached list of all sites within the City limit. Each application shall contain a narrative and scaled map(s) that precisely disclose the geographic area(s) within the City of Hermosa Beach that are proposed to be serviced by the proposed facility, the geographic area(s) bordering the City of Hermosa Beach, if any, that will be serviced by the proposed facility, the nature of the service to be provided or purpose of the facility, the reasons, if any, why the applicant cannot locate the facility outside the City of Hermosa Beach, and the efforts, if any, that applicant has made to locate the facility outside the City of Hermosa Beach. This is an existing site, and this upgrade will allow for better service to the surrounding community. See attached phone and data propagation maps. Notwithstanding any permit that may be granted in accordance with this Section, the facility shall be erected, located, operated and maintained at all times in compliance with this Section and all applicable laws, regulations and requirements of the Building Code, and every other code and regulation imposed or enforced by the City of Hermosa Beach, the State of California, and the United States Federal Government. Applicants are separately required to obtain all applicable building and construction permits that may be required prior to erecting or installing the facility. The proposed installation will be designed and constructed to meet applicable governmental and industry safety standards. Specifically, Sprint-Nextel will comply with all FCC and FAA rules governing construction requirements, technical standards, interference protection, power and height limitations and radio frequency standards. The proposed facility will operate at the lowest possible power level, and is designed to be well below established standards used by the FCC for safe human exposure to radio frequency electromagnetic fields. Each wireless communications carrier applicant shall provide a letter to the director of community development stating willingness to allow other carriers to co-locate on their facilities wherever feasible or a written explanation why the subject facility is not a candidate for co-location. Sprint is open to collocation as long as there is no interference with their facility. An RF Environmental Evaluation Report must be prepared by the applicant indicating that the proposed wireless communications facility meets FCC regulations and standards for construction, maintenance and operations. Ten days after installation and every two years thereafter, the telecommunications service provider must submit a certification report, attested to by a licensed engineer expert in the field of RF emissions, that the facility is compliant with the applicable FCC regulations for RF emissions. See attached report. The proposed wireless communications facility meets FCC regulations and standards for construction, maintenance and operations. Ten days after installation and every two years thereafter, the telecommunications service provider must submit a certification report, attested to by a licensed engineer expert in the field of RF emissions, that the facility is compliant with the applicable FCC regulations for RF emissions. Sprint-Nextel will provide a report after construction and every two years. Approval of the project is subject to the Planning Commission making a finding that the proposed site results in fewer or less severe environmental impacts than any feasible alternative site. The City may require independent verification of this analysis at the applicant’s expense. The intention of the alternatives analysis is to present alternative strategies which would minimize the number or size and adverse environmental impacts of facilities necessary to provide the needed services to the City and surrounding areas. N/A, this is a modification to an existing site. Conclusion: Sprint-Nextel understands the City’s desire to have these sites designed in a manner that reduces their visual impact. By placing these antennas inside an existing screen disguised as a light standard, it will reduce any impact this upgrade may have; the modified facility will have little to no visual impact on the surrounding community and environment. The antennas will not change the building’s architectural appearance or impact its use. Furthermore, the proposed facility will have no substantial adverse impact on properties or improvements in the surrounding neighborhood.
