Sam Perrotti, Chairman Ron Pizer, Vice Chairman Peter Hoffman Kent Allen Shawn Darcy Note: No Smoking Is Allowed in the City Hall Council Chambers THE PUBLIC COMMENT IS LIMITED TO THREE MINUTES PER SPEAKER Planning Commission agendas and staff reports are available for review on the City’s web site at www.hermosabch.org. Written materials distributed to the Planning Commission within 72 hours of the Planning Commission meeting are available for public inspection immediately upon distribution in the Community Development Department during normal business hours from Monday through Thursday, 7:00 a.m. - 6:00 p.m. and on the City’s website. Final determinations of the Planning Commission may be appealed to the City Council within 10 days of the next regular City Council meeting date. If the 10th day falls on a Friday or City holiday, the appeal deadline is extended to the next City business day. Appeals shall be in written form and filed with the City Clerk's office, accompanied by an appeal fee. The City Clerk will set the appeal for public hearing before the City of Hermosa Beach City Council at the earliest date possible. If you challenge any City of Hermosa Beach decision in court, you may be limited to raising only those issues you or someone else raised at the public hearing described on this agenda, or in a written correspondence delivered to the Planning Commission at, or prior to, the public hearing. To comply with the Americans with Disabilities Act (ADA) of 1990, Assistive Listening Devices will be available for check out at the meeting. Approval of the May 15, 2012 Action Minutes 5. Resolution(s) for Consideration - None THE RECOMMENDATIONS NOTED BELOW ARE FROM THE PLANNING STAFF AND ARE RECOMMENDATIONS ONLY. THE FINAL DECISION ON EACH ITEM RESTS WITH THE PLANNING COMMISSION. PLEASE DO NOT ASSUME THAT THE STAFF RECOMMENDATION WILL BE THE ACTION OF THE PLANNING COMMISSION. Section II Public Hearings 6. CUP 12-4 -- Conditional Use Permit Amendment to allow on-sale general alcohol and make minor modifications to the floor plan for an existing restaurant with on-sale beer and wine and live entertainment closing at 1:00 a.m. Friday and Saturday and 12:00 midnight Sunday through Thursday and outdoor seating (Suzy’s Bar & Grill) at 1139-1141 Aviation Boulevard. Staff Recommended Action: To continue to July 17, 2012 due to lack of a quorum on this matter. 7. CUP 12-3 / PARK 12-4 -- Conditional Use Permit Amendment and Parking Plan to convert approximately 3,500 square feet of an existing church facility to a day care center for approximately 50 children with outdoor playground, with less than required parking, at 1063 Aviation Boulevard (Church of Christ). Staff Recommended Action: To continue to the July 17, 2012 meeting. 8. PDP 12-6 -- Precise Development Plan to construct a second detached dwelling with garage, containing approximately 2,001 square feet, on a 3,000 square foot lot in the R-3 zone, at 125 Monterey Avenue (continued from the May 15, 2012 meeting). Staff Recommended Action: To approve subject Precise Development Plan. 9. CON 12-5 / PDP 12-7 -- Conditional Use Permit, Precise Development Plan and Vesting Tentative Parcel Map No. 71965 for a 2-unit residential condominium at 122 Manhattan Avenue. Staff Recommended Action: To approve subject Conditional Use Permit, Precise Development Plan, and Vesting Tentative Parcel Map. 3 10. PARK 12-5 -- Parking Plan to classify a new food establishment as a ‘snack shop’ for the purpose of calculating parking requirements (“Street Tacos Gourmet Taco Stand”) at 1120 Hermosa Avenue (currently Greeko’s). Staff Recommended Action: To approve subject Parking Plan with findings that the use is a snack shop and less than required parking is merited due to parking demand characteristics of the proposed use. 11. TEXT 12-3 -- Text amendment to amend Title 17 (Zoning) by incorporating the “No Intensification of Late-Night On-Sale Alcoholic Beverage Establishments” Policy pertaining to Conditional Use Permits, including establishment of a cap on such establishments, into the code. Staff Recommended Action: To continue to the July 17, 2012 meeting. 12. TEXT 11-3 -- Text amendment to amend Titles 12 and 17 (Zoning) by allowing portable signs on the public right-of-way in commercial zones without a conditional use permit. Staff Recommended Action: To reaffirm Resolution P.C. 12-4, by Minute Order, recommending the City Council continue the prohibition on portable signs for the reasons stated therein and First Amendment issues. 13. TEXT 11-3 – Resolution for adoption for a text amendment to amend Titles 12 and 17 (Zoning) by allowing outdoor retail sales/displays on the public right-of-way in commercial zones without a conditional use permit. Staff Recommended Action: To adopt the resolution recommending approval to the City Council a text amendment. Section III Hearing(s) 14. LLA 12-1 – Lot line adjustment to adjust the boundary between 1852 Rhodes Street and 1845 Hillcrest Drive to correctly reflect the ownership and use of the property. Staff Recommended Action: To approve said lot line adjustment. Section IV 15. Staff Items a. Report on City Council actions. b. Tentative future Planning Commission agenda. c. Adjournment From: Robert Yrigoyen <kiddyri@aol.com> Date: Wed, May 30, 2012 at 11:24 AM Subject: Public hearing To: mdivir@gmail.com We the residence of 10th St. respectfully request a public hearing to express our concerns regarding the CUP violations occurring at the Hermosa carwash located at 1000 PCH. Overview In 1992 the HB carwash located at 1000 PCH was issued a CUP to operate a car wash. This CUP contained the following conditions. Section 1 #6- “ A chain shall be provided across the driveway onto 10th Street to limit the use of the driveway for exiting only.” Section 1 #11- “ The area under the canopy structure shall be used for detailing a maximum of one (1) car at a time. Air compressors or vacuum cleaners are permitted only if they comply with the noise ordinance.” Section 1 #16- “ Usage of residential streets and/or PCH for parking employee automobiles is prohibited. Over the last few months the car wash personnel have continually violated the CUP conditions. I have spoken to the Manager of the car wash operations Mr. Dan Yap regarding our concerns, he has been courteous however the cup violations continue to create a neighborhood public nuisance. We have documented evidence to showcase our complaints as well as a petition from the neighborhood. I have brought the substance of my complaints to city staff. We now request an opportunity to present the facts of our cup violations case to your honorable body. TEXT 11-3 -- Text Amendment to Municipal Code Chapters 12 and 17 to allow retail sales/displays on the public right-of-way in commercial districts without a conditional use permit. Staff Recommended Action: To direct staff as deemed appropriate. ACTION: 1) To direct staff to return with a resolution recommending approval of a Text Amendment that incorporates City Council recommendations, with exception of a five foot height for retail displays. 2) To direct staff to bring back discussion for signage at the June 19, 2012 meeting. Discussion of implementation of the “No Intensification of Late-Night On-Sale Alcoholic Beverage Establishments” Policy including incentives/concessions as inducements to reduce late night hours and possible Text Amendment. Staff Recommended Action: To direct staff as deemed appropriate. ACTION: To direct staff to return with a resolution recommending a Text mendment to incorporate the ‘no intensification policy’ into the zoning code and to codify a cap on late-night on-sale establishments when considering Conditional Use Permits for late night alcohol serving establishments; and to also continue to encourage individual establishments to negotiate with the City for operational changes in return for reducing late night hours. Recommendation: That the Planning Commission by Minute Order reaffirms Resolution 12-4 recommending the Council continue the prohibition on portable signs for the reasons stated therein and First Amendment issues. Should the Council desire to pursue allowing portable signs in the public right-of-way, the standards in Attachment 2 may be considered. Background/Analysis: On May 15, 2012, the Commission directed staff to return with a discussion of portable signs. Previously, on February 21 and March 20 the Commission addressed portable signs and adopted Resolution 12-4 recommending the Council continue the prohibition on portable signs and retail sales/display areas on the public right-of-way due to (1) demonstrated significant impacts on aesthetics and creation of visual blight as businesses ‘push the envelope’ as they compete for customers; (2) difficulty in creating an enforceable standard defining an aesthetic that is ‘tasteful’; (3) the City’s lack of resources to enforce regulations particularly on Friday through Sunday; and (4) the prohibition being consistent with the policies of many similarly situated southern California beach cities. The Commission provided the Council a list of standards that might be appropriate, should the Council desire to allow portable signs (Attachment 3). The Council on April 24, 2012 introduced an ordinance to allow outdoor dining on the public right-of-way, requested the Commission to re-evaluate allowance for retail sales/displays on the public right-of-way, and took no action regarding portable signs. On May 15, the Commission focused on retail sales/displays on the public right-of-way in commercial zones, but also heard comment on portable signs. Five businesses requested that displays or signage to attract customers be allowed; the four small businesses located on Pier Avenue cited limited frontages, building configurations, and location somewhat removed from the main pedestrian area as hindering visibility. One owner, not present at the hearing, provided a list of rules/criteria for considering portable signs. The Commission also discussed the desirability of consistent regulations within various commercial areas versus a customized block by block approach to crafting regulations, determining that consistent regulations would be easier for businesses to understand and for the City to enforce. Analysis: The Commission on March 20, 2012 recommended maintaining the prohibition on portable signs, but provided a list of possible standards. Excerpts from previous staff reports indicate the purpose of portable signs is to draw attention to the business and to let people know it is open for business. While these signs may benefit all businesses, businesses set back from the street, lacking street frontage, and second story businesses would likely benefit most from these signs because window displays are less visible from the street or sidewalk. Too many signs clustered in one area may be overwhelming and the benefit may be reduced. Enforcement issues have also been extensively addressed by the Commission. Staff has reviewed the proposal provided by a local business owner on May 15, and previous reports, Chamber of Commerce comments, comments by the Commission, and recent Council comments regarding retail displays, and has prepared a revised list of possible standards, below, and summarized in Attachment 2. 2 However, there is a significant legal issue that the City must consider before deciding to lift the existing ban on portable signs in the public right-of-way. There are first amendment rights associated with granting permission to display signs in the public right-of-way. Generally, once the public right-of-way is opened as a forum for businesses to communicate, the first amendment requires the City to allow all types of signs in the public right-of- way. In other words, the City cannot allow businesses to communicate their messages in the public right-of-way without allowing all other messages in the same place. The City may impose reasonable time, place and manner restrictions on signs in the public right-of-way, but, it cannot regulate the content of those signs and limit the ordinance to only allow business signs. Stated differently, to allow only commercial messages on the public sidewalks would be an impermissible content regulation. These considerations may have a significant bearing on whether and how the city might choose to allow portable signs on the public right-of-way. These legal issues may also affect the standards below. The Commission has already recommended maintaining the existing prohibition on these signs and the use of the public right-of-way as a public forum is a very complicated area of the law. If the Commission is interested in pursuing changes to the sign regulations, the City Attorney will research this issue further and provide a thorough legal analysis of the implications associated with opening the public right-of-way for signs prior to Commission action. Revised list of standards (underlined provisions are summarized in Attachment 2). PC Standards, March 20, 2012 Additional Provisions/Alternatives 1. Location: Pier Plaza, Pier Avenue (including SPA-11), Hermosa Avenue, Artesia Blvd. and Aviation Blvd. commercial frontages. All commercially zoned frontages. 2, Location: Sign must be placed adjacent to the building as specified in the permit. Placement of signs for 2nd story businesses to be designated by Public Works per the encroachment permit when location adjacent to the building is not possible. Freestanding sidewalk signs shall be permitted only on the four feet of public right-of-way nearest, and parallel to, the curb in front of the business to which it is pertinent, or on private property in front of the business. 3. Number: Maximum one portable sign per business. The total number of signs on one parcel or for one shopping center shall not exceed one sign per 25 lineal feet of street frontage where buildings are within 2 feet of the sidewalk, one per 50 lineal feet of street frontage where buildings are not within two feet from the sidewalk, or one per 4 businesses, whichever is less. Where multiple businesses have the same frontage, the businesses owner must coordinate signage. 4. Size: Maximum size is 2’ width not to exceed 3’-6” in height. Maximum area is 7 square feet Signs shall be no more 2'-6" width, 3'-6” high, and 2'- 0" base width. Each face should contain no more than 7.5 square feet of sign area. 5. Hours: Remove by 10 p.m., not exceeding hours of establishment. 6. Access: 5’ pedestrian path must be maintained. 7. Movement: Signs shall not be illuminated, digital, contain any moving components (no feather/sail types), or contain moving images; no projections may be cast on the sign. 8. Durability: Sign frame and sign must consist of sturdy materials appropriate to the outdoor environment, and must have a professionally designed appearance. Freestanding sidewalk signs shall be constructed of durable materials, sufficient to withstand inclement weather, as well as color fading due to sunlight. Metal, wood, and plastic are typical materials used. Glass and other breakable materials are not allowed. 9. Coordination: An encroachment permit cannot additionally be obtained for outdoor dining and/or retail sales/display areas. 10. Other standard health and safety provisions (same as for retail displays as applicable) Freestanding sidewalk signs shall be designed to be self-supporting (A-frame or podium types are typical). Weighted - Signs shall be designed to withstand wind or being overturned by contact. There shall be no projections, other than raised carved letters, which shall not project greater than 1/2" from sign face. Signs shall contain no sharp edges or corners 10.
