Written materials distributed to the Planning Commission within 72 hours
of the Planning Commission meeting are available for public inspection immediately
upon distribution in the Community Development Department during normal business hours
from Monday through Thursday, 7:00 a.m. - 6:00 p.m. and on the City’s website.
Final determinations of the Planning Commission may be appealed to the City Council within
10 days of the next regular City Council meeting date. If the 10th day falls on a Friday
or City holiday, the appeal deadline is extended to the next City business day.
Appeals shall be in written form and filed with the City Clerk's office, accompanied by
an appeal fee. The City Clerk will set the appeal for public hearing before
the City of Hermosa Beach City Council at the earliest date possible.
If you challenge any City of Hermosa Beach decision in court, you may be limited
to raising only those issues you or someone else raised at the public hearing
described on this agenda, or in a written correspondence delivered to the
Planning Commission at, or prior to, the public hearing.
To comply with the Americans with Disabilities Act (ADA) of 1990, Assistive Listening Devices

6. VAR 11-1 -- Variance to allow a 500 square foot expansion to an existing nonconforming
single-family residence, which exceeds the 50% increase in gross floor area allowed for
nonconforming uses in the C-2 zone, at 69 10th Court (continued from the July 19, 2011
meeting).
Staff Recommended Action: No public hearing or action required as the project was
withdrawn by the applicant.
7. CUP 11-4 -- Conditional Use Permit amendment to expand the allowable area for outdoor
dining in conjunction with a restaurant use (Crème De La Crepe) at 424 Pier Avenue.
Staff Recommended Action: To adopt the resolution approving subject Conditional Use
Permit amendment to allow the expanded outdoor dining area.
8. TEXT 11-3 -- Text amendment to allow outdoor dining on the public right-of-way in
commercial districts, excluding Upper Pier Avenue.
Staff Recommended Action: To 1) adopt the resolution recommending to temporarily allow
outdoor dining on the public right-of-way in commercial districts, excluding Upper Pier
Avenue, and 2) direct staff to return with a permanent Text Amendment to allow outdoor
dining on the public right-of-way in commercial districts as directed.

6. PARK 11-5 -- Parking Plan to allow conversion of 2,200 square feet of designated storage
area within an existing 7,033 square foot commercial building with 20 parking spaces, to

offices, employee lounge and fitness areas and/or similar ancillary uses, with no additional
parking, at 737 – 3rd Street (continued from the June 21, 2011 meeting).
Staff Recommended Action: To adopt P.C. Resolution 11-11 approving subject Parking
Plan.
ACTION: To adopt P.C. Resolution 11-11 approving subject Parking Plan as written
incorporating staff recommended conditions and standard conditions, a parking
management plan, a cap limiting number of employees to 20 full-time employees, a
covenant to not allow sublease of any portion of the property, and a trigger for the valet
parking program.
MOTION by Commissioner Hoffman, seconded by Commissioner Pizer. The motion
carried as follows:

7. HLE 11-1 -- Height Limit Exception to allow construction of a new roof deck exceeding the
30-foot height limit in the R-3 zone, at 623 Monterey Boulevard.
Staff Recommended Action: To adopt the resolution denying the height limit exception.
Commissioner Hoffman recused himself from this item as he might live within 500’ radius.
ACTION: To adopt resolution denying subject Height Limit Exception.
MOTION by Commissioner Perrotti, seconded by Commissioner Pizer. The motion
carried as follows:

9. TEXT 11-2 -- Text Amendment to update the zoning code (Municipal Code, Title 17) with
regard to the provision of communication services
Staff Recommended Action: To direct staff to prepare a zoning text amendment from
among various options.
ACTION: To continue to September 20, 2011 and direct staff to prepare a zoning Text
Amendment to 1) redefine the general office category to permit communication services
with minimal impacts and 2) determine the threshold that would potentially create greater
impacts requiring a conditional use permit.
MOTION by Commissioner Hoffman, seconded by Commissioner Pizer. The motion
carried as follows:

10. PDP 11-4 -- Request for a one year extension for a Precise Development Plan to
construct two detached dwellings in an R-1A zone at 526 25th Street.
Staff Recommended Action: To adopt a minute order extending the expiration date of the
Precise Development Plan by one year to July 21, 2012.
ACTION: The Planning Commission consensus was to adopt a minute order extending
the expiration date of the Precise Development Plan by one year to July 21, 2012.
11. A-14#60 -- Appeal of Director’s Decision to determine the property to be a convex slope
for the purpose of measuring building height in connection with a proposed new single
family residence at 2416 Hermosa Avenue.
Staff Recommended Action: To direct staff as deemed appropriate.
ACTION: To determine, by minute order, that the subject lot is not a convex sloping lot
and to measure height from top of the wall.
MOTION by Commissioner Hoffman, seconded by Commissioner Allen. The motion
carried as follows:

policy for City Council consideration.

PLAN SUBMITTAL FOR DRIVEWAY SLOPES:
NEW RESIDENTIAL, COMMERCIAL, OR INDUSTRIAL PROJECTS, AND
ALL PROJECTS WITH NEW GARAGES AND DRIVEWAYS
The City of Hermosa Beach requires that driveway slopes not exceed 12.5% from the back-of-
sidewalk to the garage face, and 2% from back of existing or future public improvements (curb, gutter,
and sidewalk). Plans are rejected if the driveway exceeds the slope maximum allowed by Municipal
Code Section 17.44.120(D).
Civil Plans for Improvements of 400 Square Feet or Greater:
All proposed driveway alterations and/or additions and remodels that are (1) equal to or exceed 400 square feet1
or (2) any accessory building greater than 50 percent of existing enclosed floor areas submit civil engineered
plans. Civil engineered plans shall be prepared, signed, and stamped by a Civil Engineer licensed in the State
of California and include:
• Elevation at street flow line • Elevation of top of curb
• Elevation at back of walk • Elevation at center of street
• Elevation of flow line a minimum of fifty feet
(50’) on either side of property
• Elevation at driveway center at centerline
• Specify precise slope for driveway
• Elevation at garage face • Elevation at trench drain
• All on site drainage, including sump pumps • Location of all new and existing underground
utilities (New sewer laterals shall include invert
elevations at the property line and at the
connection to the main)
No driveway approach shall be constructed less than two feet (2’) from edge of driveway apron (please refer to
attachment) to any obstruction including power poles for residential and four feet (4’) for commercial.
Plan Submittal for Driveways with Slope of 5% or Greater:
To ensure continuous vehicular access from the garage or parking space to the Public Right-of-Way, Plan
submittal for driveways that have a straight grade of 5% or greater measured from the parking space or garage
floor to the back of sidewalk (which is a minimum of 7-inches above flow–line at curb) shall include the following:
• Design profiles for the new or modified driveway at each edge and driveway centerline.
• These profiles shall run from centerline of the street to the parking space or garage floor slab, with
elevations shown at not more than 5-foot intervals.
• The profiles shall show any overhead beam or obstruction (e.g., cantilevered second floor, architectural
feature) demonstrating a minimum 7-foot vertical clearance.
• The licensed professional shall certify on the plans that the design vertical curve profiles are “drivable”
using a design template for a standard vehicle.
Hermosa Beach Municipal Code:
17.44.120(D) Driveways. No driveway providing access to any off-street parking space or garage shall have a
slope greater than twenty (20) percent; provided, that any ramp slope in excess of twelve and one-half (12-1/2)
percent includes transitions on each side with a minimum length of eight (8) feet and a maximum slope of one-
half (1/2) the maximum ramp slope, in accordance with the driveway grade standards set forth below [graphic
not shown here]; further, any area used for guest parking shall have a maximum slope of twelve and one-half
(12-1/2) percent.

hearing on Tuesday, August 16, 2011, to consider the following:
1. Conditional Use Permit amendment to expand the allowable area for outdoor dining in conjunction with a
