HomeMy WebLinkAboutPC Resolution 11-15 - (TA communication services)RESOLUTION P.C. 11-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH RECOMMENDING CITY COUNCIL APPROVAL OF A ZONE TEXT AMENDMENT TO THE MUNICIPAL CODE TO UPDATE THE ZONING CODE (MUNICIPAL CODE, TITLE 17) WITH REGARD TO OFFICE AND COMMUNICATION SERVICES, AND RELATED AMENDMENTS AND ADOPTION OF AN ENVIRONMENTAL NEGATIVE DECLARATION The Planning Commission of the City of Hermosa Beach does hereby resolve as follows: SECTION 1. The Planning Commission held duly noticed public hearings on July 19 and September 20, 2011 to consider amending the Zoning Code by updating Title 17 with regard to office and communication services, and related amendments (Text 11-2). SECTION 2. The Planning Commission of the City of Hermosa Beach hereby finds the proposed amendment is essentially administrative in nature, and primarily updates and modernizes existing use definitions by defining and clarifying how existing activities that utilize new technology fit within the zoning code, rather than changing the types of offices or communications activities that may be allowed within the various zoning districts. Therefore, no significant impacts to the environment, or noise, traffic, services, aesthetics, or other issues will occur from this amendment, and because the amendment is minor and does not materially change the type of uses that can be undertaken by right in the various zoning districts it is consistent with the General Plan and Zoning Code. SECTION 3. The Planning Commission recommends the City Council adopt an environmental Negative Declaration prepared in accordance with the California Environmental Quality Act and CEQA Guidelines, finding that no significant effects are identified and the project will result in a less than significant impact on the environment for the reasons stated in the Negative Declaration and Initial Study. The Department of Fish and Game has been requested to make a "No Effect Determination" that the project will not impact fish or wildlife or the habitat on which it depends. SECTION 4. The Planning Commission hereby recommends City Council approval of the following amendments to the Hermosa Beach Municipal Code: 1. Section 17.04.050 (Definitions) of Title 17 of the Hermosa Beach Municipal Code is amended only by amending Office general, deleting Radio and television stations and Sound score production facility, and adding Communication facilities to the definitions to read as follows: Communication facilities. "Communication facilities" means commercial telecommunications transmission facilities and studios that create broadcasting_ or media content outside of an office environment, including but not limited to radio, television or internet broadcasting facilities, audio rehearsal or recording studios, motion picture studios, sound stages, special effects studios, and similar uses. Excludes public utility and wireless communication facilities. Office, General. "General office" means theleealien facilities where primarily the administrative activities of a business are performed, Cuel+���� . -1 such as management, administrative and financial functions, preparing reports, business communications personal contact with clients, and similar activities; or provision of professional executive management, administrative or similar services to consumers within a commercial office environment. General office includes but is not limited to: 1. Administrative and business offices providing consumer services, including but not limited to insurance, real estate, and travel services. It may include business offices of construction and similar contractors, provided that equipment or materials storage ar vehicle fleets are not maintained onsite. 2. Government and public utility administrative offices. Excludes public service use or facility. 3. Professional services offices, including but not limited to accounting, legal, advertising or public relations, management and similar consulting services, computer and internet technology services, design services, land development services, and offices for educational, scientific and research organizations. 4. Personal improvement services offices, including but not limited to counseling, tutoring and similar services. Excludes gymnasium/health and fitness center, educational institutions, medical office, beaut Tops, massage_therapy businesses, and similar uses. 5. Media production offices, including but not limited to offices for businesses specializing in computer aided video or audio media production and similar services, including the occasional use of unamplified live subjects integral to media production. Excludes communication facilities, live entertainment, and businesses utilizing; live audiences. 2. Section 17.26.030 (C-1, C-2 and C-3 land use regulations) of Title 17 of the Hermosa Beach Municipal Code is amended by deleting Radio and television stations and Sound score production facility from the list of permitted uses and adding Communication facilities to the list of land uses to read as follows: 'USE ;C-1 C-2 ,C 3 See Section Communication facilities _ - ELT>17.40.020 .. 1-488 3.
