A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF HERMOSA BEACH, CALIFORNIA, RECOMMENDING
A TEXT AMENDMENT AND ZONE CHANGE FROM R-1A TO
S.P.A. NO. 10 ZONE INCORPORATING ALL THE R-1A
STANDARDS INCLUDING THE DENSITY STANDARD OF 3,350
SQ. FEET OF LOT AREA PER UNIT BUT TO EXCLUDE THE
SPECIFIC RESTRICTION OF 2 UNITS PER LOT AT 719 AND 725
21sT STREET LEGALLY DESCRIBED AS LOTS 23 AND 24,
HERMOSA VIEW TRACT NO. 1 AND ADOPTING A NEGATIVE
DECLARATION
The Planning Commission of the City of Hermosa Beach does hereby resolve and order as follows:
Section 1. An application was filed by Urban Pointe Development owner of real property
located at 719 and 725 21st Street, seeking approval of a Text Amendment and Zone Change in
conjunction with a Conditional Use Permit, Precise Development Plan, and Vesting Tentative Parcel
Map No. 70310 for a four -unit condominium project.
Section 2. The Planning Commission conducted a duly noticed public hearing to consider
the subject application on March 18, 2008, at which testimony and evidence, both written and oral,
was presented to and considered by the Planning Commission.
Section 3. Based on evidence received at the public hearing, the Planning Commission
makes the following factual findings:
1. The subject site is composed of two 6,863 square foot lots (13,726 square feet combined)
that front onto 215t street. The lots are currently vacant, zoned R-lA (Limited One -Family Residential)
and have a General Plan designation of LD (Low Density Residential).
2. The applicant is requesting to merge the two lots and construct four (4) detached
condominium units utilizing a shared driveway easement with an eight -unit condominium project
approved by the Planning Commission in late 2006.
3. The R-lA zone restricts the maximum number of units per lot to two (2). Since the
applicant is requesting to merge the subj ect lots, a Zone Change and Text Amendment must be
approved to allow for the increase in the number of units per lot. The applicant is requesting to rezone
the property to Specific Plan Area and a Text Amendment to create the new designation that
incorporates all of the existing development standards of the R-1A zone, however limits the maximum
number of units to four (4).
4. At their meeting of February 7, 2008, the Staff Environmental Review Committee
recommended an environmental Negative Declaration.
Section 4. Based on the foregoing factual findings, the Planning Commission makes the
following findings pertaining to the Text Amendment and Zone Change:
1. That both lots could be developed with two residential units under the current R- lA
development standards. .

2. Merger of the two lots will allow the for a shared/reciprocal driveway easement with the
adjacent property to the east thus eliminating the need for two additional curb -cuts on 21s' Street that
would be required should the lots be developed independently.
3. Since the R 1A zone allows for two units per lot, and both lots exceed the minimum lot area
to construct two -units per lot (3,350 square feet of lot area per unit), the proposed Zone Change and
Text Amendment will be consistent with the maximum density allowed by the current General Plan
designation.
4. The Planning Commission concurs with the Staff Environmental Review Committee's
recommendation, based on their environmental assessment/initial study that this project will result in
no impact on the environment, and therefore qualifies for a Negative Declaration. The Planning
Commission hereby adopts the Negative Declaration.
Section 5. Based on the foregoing, the Planning Commission hereby recommends amending
the Municipal Code and the City's Official Zoning Map as follows:
1. Amendment to Section 17.38 of the Municipal Code to read as follows:
17.38.460 Plan Area No. 10-Authority.
This specific plan area is an instrument for implementing the general plan pursuant to
Article 8, Chapter 3, of the state Planning and Zoning Law
17.38.470 Plan Area No. 10-Location and description.
The subject area is located on the north side of 215` Street between Ardmore Avenue
and Pacific Coast Highway.
17.38.480 Plan Area No. 10-Purpose.
The purpose of this specific plan area is to set forth the development requirements,
standards and permitted uses for the subject area.
17.38.490 Plan Area No.10-Permitted uses.
A. Any use permitted in the R-1 One -Family Residential zone;
B. Attached and/or detached multiple -family dwelling units;
C. Condominium developments consistent with the Condominium Ordinance
of the City.
17.38.500 Plan Area No. 10-Development standards.
A. Lot Area Per Dwelling Unit. The minimum lot area per dwelling unit shall
be not less than three -thousand three hundred fifty (3,350) square feet and
the maximum number of units per lot shall be four (4).
B. All other development standards shall be as set forth in Chapter 17.10,
R-IA Limited One -Family Residential zone.
C. All other standards shall be as set forth in the zoning ordinance.
2. Re -zone the property at 719 and 725 2l't Street, legally described as lots 23 and 24,
Hermosa View Tract No. 1, from R-1A Limited One -Family Residential to Specific Plan Area No.
10.

Section 6. Pursuant to the Code of Civil Procedure Section 1094.6, any legal challenge to the
decision of the Planning Commission, after a formal appeal to the City Council, must be made within
90 days after the final decision by the City Council.
