A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
HERMOSA BEACH RECOMMENDING CITY COUNCIL APPROVAL OF A
ZONE TEXT AMENDMENT TO THE MUNICIPAL CODE TO ALLOW
EDUCATIONAL INSTITUTIONS IN THE C-3 ZONE AS A CONDITIONAL USE
AND AMEND THE DEFINITION AND PARKING REQUIREMENTS
PERTAINING TO SAID USES.
The Planning Commission hereby resolves and orders as follows:
SECTION 1. The Planning Commission held a duly noticed public hearing on August 19, 2008
based on initial direction from the City Council to add educational facilities and related provisions
to the C-3 zoning district of the Municipal Code (Text Amendment 08-04).
SECTION 2. Based on the evidence presented in the Staff Report and considered at the public
hearing, the Planning Commission makes the following findings:
On July 8, 2008 the City Council considered a request by the Community Development
Department on behalf of the 'The Center for Learning Unlimited', a nonprofit enterprise that
supplements public education at local schools to consider a text amendment to allow
educational facilities in the C-3 and on that basis initiated said text amendment subject to
study of potential impacts, mitigations and conditions associated with such uses.
2. On August 19, 2008 the Planning Commission considered the Staff Report proposing to
amend the definition of 'educational institutions,' applying the new definition to C-3 zoned
area within strict location and parking requirements, and evaluating impacts therewith.
SECTION 3. Based on the foregoing, the Planning Commission of the City of Hermosa Beach
hereby finds the proposed amendment is consistent with the General Plan and zoning code, and the
text amendment contains sufficient safeguards, including location and parking requirements and use
permits for future project applications, to ensure the amendment is compatible with uses adjacent to
C-3 zones and with the City as a whole pursuant to H.B.M.C. Section 17.40.020, and hereby
recommends City Council approval of the following amendments to the Hermosa Beach Municipal
Code:
1. The definition of "Educational Institution" in Section 17.04.040 of the Hermosa Beach
Municipal Code shall be amended to read as follows:
"Educational institution" means elementary, junior high, high schools, colleges or
universities or other schools giving general academic instruction in the several branches of
learning and study required to be taught and equivalent to the standards prescribed by the
Education Code of the State of California or California Board of Education, including
learning skills inte ated with said education. Excludes schools academies or institutes
business/trade schools, incorporated or otherwise, which operate for a profit.
2. Educational institutions, K-12, shall be added to the alphabetical list of commercial land
uses in Hermosa Beach Municipal Code Section 17.26.030, indicated by the appropriate
symbol that it is a conditional use in the C-3 zoning district, as follows:

3. Section 17.40.190 shall be added to the Hermosa Beach Municipal Code to read as follows:
17.40. 190 Educational institutions (C-3 Zone).
In the C-3 Zone the fallowing minimum conditions and standards in addition to an
other deemed necess or a ro riate to ensure compatibility with existing or future
permitted uses in the vicinity, shall be required:
A. Educational institutions, grades K-12, shall not be located on any parcel with
frontage on Pacific Coast Highway, Sepulveda Boulevard, Aviation Boulevard
Artesia Boulevard, or Pier Avenue.
B. A minimum_. of one parking space for every seven (7) children, subject to
modification by the Planning Commission to reflect parking demand of the specific
facility.
C. Adequate space for loading and unloading children shall be available or shall be
provided on the site.
SECTION 4. The project is exempt from the Environmental Quality Act per Section 15061(b)(3) of
Title 14 of the California Code of Regulations, and with regard to potential sites Categorical
Exemption Sections 15303 conversion of small structures and 15304 minor alterations, on the basis
that the amendment is minor in nature, all future projects would require a use permit to evaluate
site -specific impacts, the opportunity for such projects would be severely limited by location and
parking criteria, and the proposal is consistent with General Plan and zoning code as stated in the
August 19, 2008 Staff Report incorporated herein by reference.
