The meeting was called to order at 7:00 P.M. by Chairman Pizer.

4. Approval of the October 20, 2015 action minutes
ACTION: To approve the October 20, 2015 action minutes as presented.
MOTION by Commissioner Hoffman and seconded by Commissioner Flaherty. The motion
carried by a unanimous vote.
5. Resolution(s) for Consideration — None

Public Hearing
6. CUP 15-9 — Conditional Use Permit to allow use of the outdoor dining area at 37 Pier
Avenue (currently Caf6 Bonaparte) in conjunction with the restaurant and outdoor dining
area with on -sale alcohol at 39 Pier Avenue (currently Palmilla restaurant) until 11:00 p.m.
daily; and determination that the project is Categorically Exempt from the California
Environmental Quality Act (continued from the September 15, 2015 meeting).
Staff Recommended Action,: To adopt the resolution approving a Conditional Use Permit
and determining the project is exempt from the California Environmental Quality Act.

ACTION: To adopt a resolution approving subject request with following changes and
adopting an environmental Mitigated Negative Declaration and Mitigation Monitoring Plan:
1) Condition 2: add to the end of last sentence "and all occupants shall vacate the outdoor
dining area."
2) Condition 11: add "televisions shall be prohibited from facing the patio."
3) New condition 16: "An encroachment permit shall be required pursuant to Municipal
Code Section 12.16.090, Commercial Outdoor Dining."
4) Re -number rest of conditions.
MOTION by Commissioner Hoffman and seconded by Commissioner Flaherty. The motion
carried by the following vote:

7. TEXT15-2 — Text Amendment to the Municipal Code, Title 17 (Zoning) to allow a parking
credit for conversion of non -restaurant use within the Downtown District in Conjunction with
approval of a Parking Plan, and adoption of an Environmental Negative Declaration.
Staff Recommended Action: To adopt the resolution recommending the City Council Adopt
a text amendment to allow a parking credit for conversion of non -restaurant use to
restaurant use within the Downtown District, in conjunction with approval of a Parking Plan,
and adoption of an environmental Negative Declaration.
ACTION: To continue to January 19, 2016 meeting and direct staff to consider appropriate
alternative notice.
• MOTION by Commissioner Hoffman and seconded by Commissioner Saemann. The
motion carried by a unanimous vote.
8. TEXT15-5 — Text Amendment to the Municipal Code, Title 12.16 (Encroachments) to
facilitate addition of small outdoor patios for food service establishments located within Pier
Plaza, and adoption of an Environmental Negative Declaration.
Staff Recommended Action: To adopt the resolution recommending the City Council adopt
a text amendment to facilitate the addition of a small outdoor patio allow a small outdoor
patio for food service establishments located within Pier Plaza that serve no alcohol, and
adoption of an environmental Negative Declaration.
ACTION: To adopt the resolution recommending City Council approval of said Text
Amendment to facilitate the addition of a small outdoor patio allow a small outdoor patio for
food service establishments located within Pier Plaza that serve no alcohol, and adoption of
an environmental Negative Declaration.
MOTION by Commissioner Hoffman and seconded by Commissioner Flaherty. The motion
carried by a unanimous vote.

• a. Memorandum regarding whether "elevator housing" should continue to be included as

one of the roof structure elements that may exceed the height limit in commercial
zones.
ACTION: The Planning Commission consensus was to direct staff to bring back the
item with more information.

e. Community Development Department activity report of September, 2015.
