I. CALL TO ORDER
The Planning Commission regular meeting was held in-person and virtually pursuant to Executive
Order AB 361 issued by Governor Gavin Newsom on September 16, 2021.The meeting was called to
order by Chair David Pedersen at 6:02 PM.
II. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Vice Chair Stephen Izant.

of former Planning Commissioner Ron Pizer.

The following people provided public comment virtually:
1. Brian Cooley
Community Development Director Jeannie Naughton addressed an email
received by Mr. Anthony Higgins. Director Naughton informed the Planning
Commission that Staff followed up with the Los Angeles Fire Department in
regard to Mr. Higgins’ concerns and on the date in question, there was no delay
in service or transportation of the patient to the hospital. The responding
emergency vehicles were not from Fire Station #100 so they were unaware of
limitations in the area. Local Fire Station #100 is aware of potential issues with
alleys per Chief Bennett from L.A. County Fire. There will be an upgrade for
dispatch centers in late 2023 to help centralize and better facilitate off-site
responders that may be dispatched to Hermosa Beach. The wall itself (in the
alley) meets Code requirements. The City cannot require the wall to be removed
to allow private vehicles to have a wider turn ratio. The Code section that was
reference in Mr. Higgin’s email does apply to corner lots that front the
intersections of two streets, but it does not apply to the intersection of two alleys.
The main difference is the vehicular traffic volume between two streets versus
two alleys. During construction, City Inspection Staff and Public Works Staff were
on-site to assess whether they needed to apply that condition in this case, and
Staff all agreed that it was unnecessary due to the alley configuration. It is noted
that there are no sidewalks on either side of the alleys. The wall is permitted and
allowed per our Code. If necessary, this can be reassessed in the future.

Assistant Planner Johnathon Masi provided a Staff Report to the Planning
Commission for this project requesting continuation to the November 15th
Planning Commission meeting.
There were no public comments received for this item.

the request for a mural determination at 8 Pier Avenue to the November 15th
Planning Commission meeting. Motion carried as follows:

MURAL DETERMINATION REQUEST (MD22-04) FOR A 300 SQUARE
FOOT PAINTED DISPLAY ON THE EASTERLY WALL OF AN EXISTING
COMMERCIAL BUILDING LOCATED AT 11 PIER AVENUE (VISTA) AND
DETERMINATION THAT THE PROJECT IS EXEMPT FROM THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT.

Assistant Planner Johnathon Masi provided a presentation to the Planning
Commission for this mural determination.

Vice Chair inquired about the Planning fees for a mural determination. Director
Naughton stated that the total fee is $759.70, which includes a categorical
exemption fee of $204.00, a mural determination review application fee of
$506.00 and a records technology fee of $49.70. Chair Pedersen noted that this
mural is complete, and this is a retroactive mural determination request.
Commissioner Rice requested that in the future, Staff include a finding that the
mural is not a representation of what is sold or offered by the business. She also
noted that this mural determination is for a restaurant.
There were no public comments received for this item.
Motion by Commissioner Hoffman and seconded by Commissioner Rice to
approve the determination request for a mural located at 11 Pier Avenue,
determining that the artistic renderings are consistent with the HBMC 17.50.030
definition of a mural and finding that the project is exempt from the California
Environmental Quality Act. Motion carried as follows:

OF AN EXISTING BUILDING LOCATED AT 52 11TH STREET AND
DETERMINATION THAT THE PROJECT IS EXEMPT FROM THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT.

Senior Planner James Atkins provided a presentation to the Planning
Commission for this mural determination.
The following person attended virtually to provide public comment:
1. Brian Cooley
Chair Pedersen inquired as to how long this location has been a retail shop. The
Owner and applicant, Brian Cooley, stated that it has been open in this location
for a month.
Motion by Commissioner Hoffman and seconded by Vice Chair Izant to approve
the determination request for a mural located at 52 11th Street, determining that
the artistic renderings are consistent with the HBMC 17.50.030 definition of a
mural. Motion carried as follows:

UPCOMING: ROTATION OF PLANNING COMMISSION
CHAIR AND VICE CHAIR ON DECEMBER 1, 2022

approve the upcoming chair rotation for December 1st, which will appoint
Stephen Izant as Chairperson and Peter Hoffman as Vice Chair for the term of
December 1, 2022 through August 31, 2023. Motion carried as follows:

c. VERBAL REPORT ON CITY COUNCIL ACTIONS
Community Development Director Jeannie Naughton shared an update that at
the City Council meeting on October 11th, the Council waived full second reading
and adopted the Timeshare Ordinance with the revision to allow with a
conditional use permit timeshare uses in the C2 district and to eliminate it in the
C1 district.
d. STATUS REPORT ON MAJOR PLANNING PROJECTS
Director Naughton shared that a new consultant was brought on to assist with the
Housing Element Update and the kick-off meeting was last week. There was also
a meeting with the South Bay Cities Council of Governments consultant group
who is using regional early action Planning funds to look at market analysis for
underutilized commercial sites for potential development of housing. This will
aide in the analysis of the Housing Element Update.
The comprehensive Zoning Code Update is coming along with the help of the
Planning Commission and there may be additional discussions related to this in
early 2023 if our new housing consultant anticipates any changes needed in the
new Zoning Code. This will ultimately help us get certified by the Department of
Housing and Community Development, and to implement what is in PLAN
Hermosa.
There is a development application coming up, tentatively scheduled for the
November 15th Planning Commission meeting, for a 12-unit condominium project
which was last seen by the Planning Commission in Spring of 2022.

adjourn the meeting in honor of former Planning Commissioner Ron Pizer until
