3 AN ORDINANCE OF THE CITY OF HERMOSA BEACH, CALIFORNIA, AMENDING
4 THE HERMOSA BEACH MUNICIPAL CODE, SECTION 29-38(1)j TO ALLOW
5 ENCROACHMENTS INTO THE PUBLIC RIGHT-OF-WAY TO SATISFY SPECIFIED
6 ZONING ORDINANCE PARKING REQUIREMENTS

8 THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH DOES ORDAIN AS
9 FOLLOWS:

11 SECTION 1. Chapter 29, Article V, Encroachments, Section 29-38(1)j, of the Hermosa
12 Beach Municipal Code is amended to read as follows:
13 tj) An encroachment permit shall not be granted where the intent or product will in any
14 way contribute to or satisfy the required open space on private property as required by the
15 Municipal Code Public right-of-way cannot be used to satisfy any conditions of building or zoning
16 that are normally provided on-site except for providing required residential guest parking, pursuant
17 to Sections 1157(c) and 1159(b) of the zoning ordinance, and for providing required parking
18 approved by a Parking Plan granted pursuant to Section 1169 of the zoning ordinance."

20 SECTION 2. This ordinance shall become effective and be in full force and effect from
21 and after thirty (30) days of its final passage and adoption.

23 SECTION 3. Prior to the expiration of fifteen (15) days after the date of its adoption, the
24 City Clerk shall cause this ordinance to be published in the Easy Reader, a weekly newspaper of
25 general circulation published and circulated, in the City of Hermosa Beach in the manner provided
26 by law.

t SECTION 4. The City Clerk shall certify to the passage and adoption of this ordinance,
2 shall enter the same in the book of original ordinances of said city, and shall make minutes of the
3 passage and adoption thereof in the records of the proceedings of the City Council at which the
4 same is passed and adopted.
