A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT, TO
AUTHORIZE AUTO BODY REPAIR AND PAINTING, AUTO SALES AND GENERAL
AUTO REPAIR AND ADOPTING AN ENVIRONMENTAL NEGATIVE DECLARATION
FOR 210 PACIFIC COAST HIGHWAY AND LEGALLY DESCRIBED AS LOTS 1, 2,
3, AND 4 OF HOME BUILDERS PLACE TRACT AND THE SOUTHERLY 45. 04
FEET OF LOTS 2 AND 4 OF THE MISSION TRACT
WHEREAS, the Planning Commission held a public hearing on
May 21, and June 4, 1991, to receive oral and written testimony
regarding an application for a Conditional Use Permit., at 210
Pacific Coast Highway and made the following findings:
A. The applicant is requesting a conditional use permit to
authorize the existing uses of auto body repair and painting,
and auto repair, as required by Section 13-5, and to expand
the auto sales showroom;
B. The site is zoned SPA-7 (Commercial) and the building and the
site are adequate in size to provide sufficient parking and
to support the proposed business activity;
C. The development, as conditioned, poses no threat to the
public safety and welfare;
D. The proposed use is compatible with surrounding commercial
activities along Pacific Coast Highway and the. imposition of
conditions as required by this resolution will mitigate any
environmental or negative impacts on nearby commercial and
residential properties;
E. The development is consistent with the Commercial Corridor,
General Plan designation;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California does hereby approve a
Conditional Use Permit to al low auto body repair and painting,
auto sales and general auto repair subject to the fol lowing
conditions:

1. The location of structures and features on the property shall
be in substantial conformance with submitted plans as revised
in accordance with the conditions below; any modification
shall be submitted to the Planning Director for approval.
Improvements to the property and structures, as required in
the following conditions of approval, shall be completed
within six (6) months of the approval of this conditional use
permit.
2. A six (6) foot high decorative block wall shall be provided
along the easterly property line adjacent to the parking area
located to the north of the showroom. The wooden fence
located along the westerly property line north of the
showroom shal 1 be removed, and if replaced, a decorative
block wall or wrought iron fence of a minimum 3-feet high
shall be provided.
3. A landscaping plan indicating size, type and quantity of
plant materials shall be submitted and shall be reviewed and
approved by the Planning Director.
(a) A minimum five (5) foot wide landscaped area shall be
provided along the easterly property line of most
northerly lot as shown on submitted plans.
(b) A minimum of one twenty-four inch (2411 ) box tree, type
to be approved by the Planning Directory, shall be
provided for each ten feet of length. (A total of five
trees).
(c) An automatic irrigation system shall be provided for all
landscaped areas.
4. The "existing covered patio" identified on the plans, which
has been enclosed without building permits, and now serves as
an additional service area, shall be inspected to the
satisfaction of the Building Department.
5. All parking spaces identified on the plans shall be striped
on the property in accordance with the plans, ftnd cracks in
the pavement shall be repaired. Also, access shall be
available in the manner shown on the plans to all the stalls
which shall not be blocked by the poles along the southerly
property line during operating hours.
6. A 5' X 7' trash enclosure shall be provided on the property,
enclosed on three sides with a decorative masonry wall of
five (5) feet in height, and provided with a view obscuring
gate on the fourth side, and maintained on a concrete base.
7. The hours of operation for auto body rE:pair, painting and
auto repair shall be limited to between 7:00 a.m. to 6:00
p.m. Monday through Friday, and 9:00 a.m. to 6:00 p.m. on
Saturdays and Sundays. Work activity of any kind is
prohibited outdoors on Sundays. The building may be used
past these hours for personal use, until 10:00 P.M. if all
the doors are closed. The car sales portion of the business
may stay open until 10:00 P.M. daily.

8. Any application of paints and finishes shall be conducted
within an approved paint booth, subject to permit approval by
the Fire Department, and shall be in conformance of Article
45 of the Fire Code, and spray painting of vehicles shall be
subject to permit approval by the South Coast Air Quality
Management District.
9. The applicant shall provide verification of permit approval
from the South Coast Air Quality Management District for the
spray paint booth and ventilation and filtration equipment,
and for the ventilation and filtration equipment for the
remaining portion of the building.
10. All roof equipment shall be screened from view, subject to
approval of the Planning Director.
11. Only low volatile organic compound paints, primers, and
finishes, in conformance with A. Q .M. D. Rule 1151 shal 1 be
used for any priming and/or painting conducted on the
premises, or any other such paint specifically approved by
the Air Quality Management District.
12. The public right-of-way shall not be used for the parking or
storing of vehicles that are intended for sale, repair, or
service.
13. Test driving of vehicles on local residential streets shall
be prohibited.
14. All repair, service, maintenance and painting of vehicles
shall be conducted inside the building, and all outdoor
repair work activities shall be prohibited. (Minor
examination for operable vehicles the purpose of estimates
not lasting more than 15 minutes are excluded, also, the area
screened in by the 10-foot high block wall may be used for
incidental activities such as masking, washing, or buffing,
specific locations subject to approval by the Planning
Director, except that outdoor work activity of any kind is
prohibited on Sundays).
Exterior garage doors and doors shall be shut during all work
activities except for one of the southerly facing garage
doors provided that dust, odors, or excessive noise does not
escape. To accomplish this, the inside work activities
involving power equipment shall be focused in the center of
the building away from the open garage door.
15. Ventilation and/or air conditioning shall be provided for the
interior of all buildings used for working on vehicles,
subject to the approval of the Director of Building and
Safety, and the Fire Department, so that all work activities
can safely and comfortably be conducted inside the building
with the garage doors and exterior windows closed.

system for the building, and shall, at a m1n1mum, be
equipped with an A.Q.M.D. approved 20/20, 211 thick filter.

16. Al 1 outdoor parking and driveway areas shal 1 be maintained
free of unregistered and derelict vehicles, wrecked vehicles,
and/or parts and debris.
17. Storage of vehicles, including trucks, tractors, trailers,
recreational vehicles, and automobiles in the outdoor parking
areas or any other location on the premises shall be
prohibited, except vehicles waiting for repair or pick-up may
be stored for a maximum of 72 bours. Vehicles being stored
for "lien sales" may be stored for a maximum of 60 days if
registered and properly covered.
18. Adequate on-site parking spaces shall be provided for the
employees. Usage of residential streets and/or Pacific Coast
Highway for parking employee automobiles is prohibited.
19. The use of parking spaces for displaying autos for sale or
any auto merchandise shall be prohibited. All display of
merchandise for sale shall be inside the showroom, or
designated areas as approved and shown on plans.
20. Noise emanating from the property shall be within the
limitations prescribed by the City's noise ordinance, Article
19.5 of Hermosa Beach Municipal Code, and shall not create a
nuisance to the surrounding residential neighborhood and
commercial establishments.

be prohibited, except in conjunction with auto body repair,

to insure that neighboring residential prope·rty and public
right-of-way shall not be adversely affected.
25. Disposal of hazardous waste material shall be in accordance
with local, state, and federal laws, but in no event shall
such waste material be allowed to drain into the City storm
drain system.
26. Prior to the Conditional Use Permit being in effect, the
applicant shall submit to the Planning Department, a signed
and notarized "Acceptance of Conditions" form.
27. The Conditional Use Permit shall be recorded with the deed,
and proof of recordation shall be submitted to the Planning

28. The applicant shall submit three (3) copies of a revised
plan for review and approval by the Planning Director prior

to the issuance of building permits which clearly indicates
the following:
a. Details of the proposed block wall and landscaping plan in
detail with irrigation system.
b. Details and/or notes of the required ventilation and/or
air conditioning system.
c. The use of standard parking spaces for the most accessible
customer parking areas located south and north of the
showroom.
d. Detailed floor plans identifying work areas, display
areas, and office locations

Each of the above conditions is separately enforced,

The Planning Commission may review this Conditional Use Permit
and may amend the subject conditions or impose any new conditions
if deemed necessary to mitigate detrimental effects on the
neighborhood resulting from the subject use.
Any violation of the conditions of approval and/or violation of
the Hermosa Beach Municipal Code may be grounds for a public
hearing for the revocation of the conditional use permit.
