RESOLUTION 91-44 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH ,CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW OFF-SALE BEER AND WINE IN CONJUNCTION WITH A CONVENIENCE MARKET, AND ADOPTION OF AN ENVIRONMENTAL NEGATIVE DECLARATION FOR 635 MONTEREY BOULEVARD, h R 1S GROCERY, AND LEGALLY DESCRIBED AS LOT 2, TRACT NO. 864 ~~ ~10 c; · WHEREAS, the Planning Commission held a public hearing on July 2, 1991, to receive oral and written testimony regarding a Conditional Use Permit request to authorize the sale of beer and wine and made the following findings: A. The sale of beer and wine· is being conducted in an existing establishment already licensed by the Department of Alcoholic Beverage Control; B. Strict compliance with the conditions of approval will mitigate any negative impact resulting from the issuance of the conditional use permit and will protect the public health, safety, and welfare; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California, does hereby approve a Conditional Use Permit, to authorize the off-sale of beer and wine in conjunction with a convenience market at 635 Monterey Boulevard, subject to the following conditions: SECTION I 1. The establishment shall not adversely affect the welfare of residents, and/or commercial establishments nearby. 2. 3. The hours of operation shall be limited to between 7:30 AM and 9:00 PM. ., The business shall provide adequate management and supervisory techniques to prevent loitering, unruliness, and boisterous activities of the patrons outside the business or in the immediate area. 4. A sign shall be posted conspicuously and prominently at all exits prohibiting loitering, littering and consumption of alcohol on the premises and warning patrons who purchase any and all types of alcoholic beverages that "possession and/or consumption of alcoholic beverages in any public sidewalk, parking lot, beach, and/or any public place is prohibited by law and subject to citation and fine. The floor plans shall be as shown on submitted plans and any changes to the interior which substantially alters the primary use permitted under the conditional use permit shall be subject to the review and approval of the Planning Director. Minor modification to the floor plans, including re-arrangement of shelving, dis plays, counters, or similar items within the market do not need review from the Planning Director. 7. Measures shall be taken to control loitering on the public sidewalk at all times. 8. The exterior of the premises shall be maintained in a neat and clean manner. 9; A landscaping plan indicating size, type, and quantity of plant materials shall be submitted and shall be reviewed and approved by the Planning Director. (a) A landscaped area shall be provided along the south property line for the entire width of the side yard. (b) An automatic irrigation system shall be provided for all landscaped areas. 10. All windows and doors on both the north and south exterior elevations shall be replaced and/or repaired to the satisfaction of the Planning Director. 11. The chain link fence to the south shall be removed and any replacement fence will require an encroachment permit. (a) A replacement fence must be of a decorative material to meet with the approval of the Planning Department. (b) The concrete curbing at the base of the fence shall be removed, replaced, or repaired. 12. The two pay phones currently located in the public right of way shall be removed or relocated to the interior of the store. 13. All signs shall comply with the City Sign Ordinance. Window and door signage shall not exceed 20% coverage of their combined total area. 15. Individual containers of beer and wine, 16 ounces or less in size shall be packaged in clear bags or containers to make the contents of the container visible. 16. Prior to the conditional use permit being in ef feet, the applicant shall submit to the p.lanning department, an "Acceptance of Conditions" form, signed by the PROPERTY owner, and notarized. ~ 17. Al 1 exterior improvements required by this conditional use permit shall be completed within six (6) months from the date of approval, except for condition #10, which shall be completed within one (1) year. Extensions may be granted by the Planning Director if reasonable progress is being made.
