HomeMy WebLinkAboutPC 91-9 (44 Hermosa Ave)1 2 3 4 5 6 7 8 9 10 11 12 13 14 l 15 16 17 18 19 20 21 22 23 24 25 26 27 28 s RESOLUTION P.C. 91-9 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, AMENDING A CONDITIONAL USE PERMIT TO AUTHORIZE A DAY NURSERY/PRE-SCHOOL WITH A MAXIMUM OF THIRTY-FOUR (34) CHILDREN AND ADOPTION OF AN ENVIRONMENTAL NEGATIVE DECLARATION AT 44 HERMOSA AVENUE, BEACH SHORES PRE-SCHOOL, AND LEGALLY DESCRIBED AS LOTS 2 AND 3, BLOCK 41, FIRST ADDITION TO HERMOSA BEACH. WHEREAS, the Planning Commission held a public hearing on January 15, 1991, to receive oral and written testimony regarding a Conditional Use Permit request to authorize a day nursery and made the following findings: A. A conditional use permit for the day nursery was granted by the Planning Commission on April 10, 1967, for a maximum of twenty (20) children; B. The applicant has been operati~g under a state license which allows up to 34 children, and is requesting an amendment to the C.U.P. to allow the same; C. The property is zoned commercially, and the business has been in operation since 1967 and has not resulted in detrimental impacts on surrounding properties; D. Strict compliance with the conditions of approval will mitigate any negative impact resulting from the issuance of the conditional use permit and will protect the public health, safety, and welfare; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, Ca 1 i fornia, does hereby amend a Conditional Use Permit, to authorize the ope rat ion of a day nursery/pre-school at 44 Hermosa Avenue, subject to the following conditions: -1 - ~-~ 1 2 3 4 5 6 7 8 9 10 11 12 13 I 14 • ,, -15 16 17 18 19 20 21 22 23 24 25 26 27 28 1. The use of outdoor bells, buzzers, public announcement systems or similar shall be prohibited. 2. The number of children enrolled in the pre-school shall not exceed thirty-four (34). 3. The establishment shall not adversely affect the welfare of residents, and/or commercial establishments nearby. 4. A trash enclosure shall be provided of not less than 5 feet in height, and shall be provided with a view obscuring gate; location and type of materials to be reviewed and approved by the Planning Director. · 5. A conditional use permit shall be recorded with the deed, and proof of recordation shall be submitted with the planning department. 13. Each of the above conditions is separately enforced, and if any of the conditions of approval is found to be invalid by a court of law, all the other conditions shall remain valid and enforceable.
