A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW
ON-SALE BEER AND WINE IN CONJUNCTION WITH A RESTAURANT AND
ADOPTION OF A ENVIRONMENTAL NEGATIVE DECLARATION FOR 1559 PACIFIC
COAST HIGHWAY, SUITE 1/D, AND LEGALLY DESCRIBED AS A PORTION OF
LOT 1, TRACT 9203, AND LOTS 11-18 INCLUSIVE, BLOCK 80, SECOND
ADDITION TO HERMOSA BEACH TRACT
WHEREAS, the Planning Commission held a public bearing on
January 2, 1991, to receive oral and written testimony regarding
a Conditional Use Permit request to authorize the sale of beer
and wine in conjunction with a restaurant and made the following
findings:
A. The sale of alcohol would be conducted in an existing
restaurant located in an existing shopping center complex,
Plaza Hermosa;
B. The proposed use is compatible with surrounding commercial
uses and with surrounding residential uses;
C. Strict compliance with the conditions of approval will
mitigate any negative impact resulting from the issuance of
the conditional use permit and will protect the public
health, safety, and welfare;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California, does hereby approve a
Conditional Use Permit, to authorize the sale of beer and wine in
conjunction with a restaurant at 1559 Pacific Coast Highway,
Suite #D, subject to the following conditions:
1. The establishment shall not adversely affect the welfare of
residents, and/or commercial establishments nearby.
2 . The hours of operation shall be limited to between 11:00 A.M.
and 10:00 P.M. Sunday through Thursday, and from 11:00 A.M.
to 11:00 P.M. on Fridays and Saturdays.

3. Outdoor seating and/ or service of beer and wine is
prohibited.
4. The business shall provide adequate management and
supervisory techniques to prevent loitering, unruliness, and
boisterous activities of the patrons outside the business or
in the immediate area.
5. Noise emanating from the property shall be within the
limitations prescribed by the city's noise ordinance and
shall not create a nuisance to surrounding residential
neighborhoods, and/or commercial establishments.
6. Screens shall be installed on all openable exterior windows
to prevent pass-through of alcoholic beverages and ~o control
flies.

15. Any changes to the exterior or interior design shal 1 be
subject to review and approval by the Planning Director.
16. A maximum of 35% of the gross receipts of the restaurant
shal 1 be from the sale of alcoholic beverages. The City
shal 1 have the right during business hours, upon 15 days
notice, to inspect the books and records of the establishment
to determine the gross sales of alcoholic beverages. Upon
request at the inspection, the establishment shall submit to
the City, copies of all records submitted to the State Board
of Equalization for the purpose of verifying the
establishment's books and records, with the understanding
that these reviews are confidential.
17. Prior to the conditional use permit being in effect, the
applicant shall submit to the planning department, a signed
and notarized "Acceptance of Conditions" form.
18. A conditional use permit shall be recorded with the deed, and
proof of recordation shall be submitted with the planning
department.
19. The Planning Commission may review the conditional use permit
and may amend the subject conditions or impose any new
conditions if deemed necessary to mitigate detrimental
effects on the neighborhood resulting from the subject use.
20. Each of the above conditions is separately enforced, and if
any of the conditions of approval is found to be invalid by a
court of law , all the other conditions shall remain valid and
enforceable.
