HomeMy WebLinkAboutPC_Resolution_91-07 1605 PCH2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 91-7 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND PARKING PLAN TO ALLOW A GAME ARCADE AND ADOPTION OF AN ENVIRONMENTAL NEGATIVE DECLARATION AT 1605 PACIFIC COAST HIGHWAY, LEASE SPACE NO. 112, LEGALLY DESCRIBED AS A PORTION OF LOT 13 AND SOUTHERLY 6.24 FEET OF A PORTION OF LOT 14, BLOCK 81, SECOND ADDITION TO HERMOSA BEACH WHEREAS, the Planning Commission held a public hearing on January 15, 1991, to receive oral and written testimony regarding a Conditional Use Permit request to authorize the operation of a game arcade and made the following findings: A. The arcade would be operated inside an existing mall, the Hermosa Beach Pavilion; B. The proposed use is compatible with surrounding commercial uses and with surrounding residential uses; C. Strict compliance with the conditions of approval will mitigate any negative impact resulting from the issuance of the conditional use permit and will protect the public health, safety, and welfare; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California, does hereby approve a Conditional Use Permit to authorize the operation of a game arcade at 1605 Pacific Coast Highway,(#112), subject to the following conditions: 1. A uniformed adult employee shall be present during all operating hours to provide supervision and to enforce all posted rules of the busineiss and all conditions of this conditional use permit. At least one adult employee of at least twenty-one (21) years of age shall be present at all times. 2. The hours of operation shall be limited to between 10:00 A.M. and 10:00 P.M. Sunday through Thursday, and from 10:00 A.M. to 12: 00 A.M. midnight on Fridays and Saturdays. No one under the age of 16 shall be permitted on the premises - 1 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 between the hours of 10:00 A.M. and 2:00 P.M. when public schools are in session. 3. Maximum permissible occupancy must be clearly posted and may not be exceeded at any time. If the Department of Public Safety determine that the maximum occupancy is being violated, they may cite the business and initiate a conditional use permit revocation. 4. The business shall provide adequate management and supervisory techniques to prevent loitering, unruliness, and boisterous activities of the patrons inside and outside the business or in the immediate area. 5. Noise emanating from the property shall be within the limitations prescribed by the city's noise ordinance and shall not create a nuisance to surrounding commercial establishments and surrounding residential areas. a) The front door shall be not be kept open during operating hours except to allow normal entry and exit of the customers. b) The volume levels of the games shall be controlled by management. 6. The proposed development shall be in substantial conformance with submitted plans. Any modification requires review and approval by the Planning Director and/or the Planning Commission. 7. A high intensity level of 1 ighting shal 1 be provided and maintained in the interior of the premises, and shall be provided and maintained in the downstairs retail arcade outside the game arcade; type, size and number of 1 ighting fixtures to be reviewed and approved by the Director of Building and Safety. 8. A sign which clearly restricts bicycle riding within the Pavilion shall be posted at the entrance stating "No Bicycle Riding, Walk Bikes Beyond this Point" 9. The rules and policies of the establishment shall be prominently displayed and posted at the front entrance and shall include, but not be limited to, prohibition of smoking and the bringing in of outside food and drink; prohibition of loitering, loud or abusive language, and game abuse; and, prohibition of allowing children of age 16 and under on the premises during school hours. 15. Management shall not admit customers who are wearing styles of clothing, adornments, and/or accouterments of dress which, when viewed in the context of a group, clearly imply and/or infer gang association or affiliation. 16. Any changes to the exterior or interior building or floor plan shall be subject to review and approval by the Planning Director. 17. Prior to the conditional use permit being in effect, the applicant shall submit to the planning department, a signed and notarized "Acceptance of Conditions 11 form. 18. A conditional use permit shall be recorded with the deed, and proof of recordation shall be submitted with the planning department. 19. The Planning Commission may review the conditional use permit and may amend the subject conditions or impose any new conditions if deemed necessary to mitigate detrimental eff9ects on the neighborhood resulting from the subject use. 20. Each of the above conditions is separately enforced, and if any of the conditions of approval is found to be invalid by a court of law, all the other conditions shall remain valid and enforceable.
