HomeMy WebLinkAboutPC_Resolution_91-50 247 27thI • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 91-50 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DENYING A REQUEST FOR AN EXCEPTION FROM SECTION 13-7(B) OF THE ZONING ORDINANCE TO ALLOW AN ADDITION TO AN EXISTING NONCONFORMING STRUCTURE TO EXCEED 50% OF REPLACEMENT VALUE AT 248 27TH STREET AND LEGALLY DESCRIBED AS LOT 16 BLOCK 112, SHAKESPEARE TRACT WHEREAS, the Planning Commission held hearings on August 6 and September 3, 1991, regarding an application for an exception, pursuant to section 13-7(B), to allow more than a 50% addition to a nonconforming structure, and made the following findings: A. The applicant is proposing an addition/remodel to the existing single-family dwelling which results in an addition/remodel equivalent to 61% of the replacement value of the existing structure; B. The existing nonconformity in regards to the side yard setback of the garage, since it is less than one (1) foot is rather than the required three feet is a severe deficiency, and should be corrected before any additions of this scale are permitted; C. An exception has already previously been granted by the City to allow the construction of the room above the nonconforming garage; D. Approval of the addition is not consistent with the intent and goals of Article 13 of the zoning ordinance, particularly Section 13(d) which states that remodeling and expansion of - 1 - ~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 such buildings which by current standards do not meed even the minimual standards of setback should be prohibited. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby deny a request for an exception, pursuant to Section 13-7 (B) of the zoning ordinance, to allow more than a 50% addition/remodel to the existing nonconforming structure.
