P.C. RESOLUTION 91-52
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AMENDMENT
TO EXTEND OPERATING HOURS AT A RESTAURANT TO INCLUDE BREAKFAST
HOURS FROM 6:00 A.M. TO 11:00 A.M. AND TO CONTINUE TO AUTHORIZE
ON-SALE BEER AND WINE IN CONJUNCTION WITH A RESTAURANT, AND A
TAKE-OUT WINDOW ON THE STRAND FOR 4 PIER AVENUE LEGALLY DESCRIBED
AS LOT 5, BLOCK 12, HERMOSA BEACH TRACT
WHEREAS, the Planning Commission held a public hearing on
August 20, 1991, to receive oral and written testimony regarding
a Conditional Use Permit amendment request to extending the hours
of operation at an existing restaurant with on-sale beer and
wine and made the following findings:
A. The proposed extension of hours involves morning hours only,
which does not result in any adverse impacts on parking or on
surrounding commercial properties;
B. A C.U.P. was granted for the take-out window in 1969 and for
the beer and wine sales in 1975 and said uses have been
continuing ever since without causing any significant
problems;
C. The existing sale of beer and wine in conjunction with a
Mexican restaurant is compatible with surrounding commercial
uses;
D. Strict compliance with the conditions of approval will
mitigate any negative impact resulting from the issuance of
the conditional use permit and will protect the public
health, safety, and welfare;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California, does hereby approve a
Conditional Use Permit amendment to extend the hours of an
existing restaurant which serves beer and wine at 4 Pier Avenue,
subject to the following conditions:

SECTION I Conditions incorporated from previous approvals:
1. No beer or wine shall be sold "to go" or be taken off the
premises.
2. All beer shall be sold through table service only and that
there shall be no separate bar area.
3. Al 1 beer shall be served in drinking glasses, and not in
plastic or paper containers.
4. The ice-cream and snack take-out window facing the Strand
shall be open only between the hours of 6:00 A.M. and 12:00
midnight.
5. The responsibility of maintaining the front of the premises
and the Strand in front of the building in a clear and
orderly manner shall be the responsibility of the business.
SECTION II Standard Conditions of Approval:
1. The establishment shall not adversely effect the welfare of
the residents, and/or commercial establishments nearby.
2. The business shall provide adequate staffing, management and
supervisory techniques to prevent loitering, unruliness, and
boisterous activities of the patrons outside the business or
in the immediate area.
3. The Police Chief may determine that a continuing police
problem exists and may require the presence of a pol ice
approved doorman and/or security personnel on-site at the
owners expense.
4. A sign shall be posted conspicuously and prominently at all
exits warning patrons who purchase any and all types of
alcoholic beverages that "possession and/or consumption of
alcoholic beverages in any public sidewalk, parking lot,
beach, and/or any public place is prohibited by law and
subject to citation and fine. The City of Hermosa Beach
vigorously enforces its liquor laws" Said signs shall be at

6. Any changes to the interior which substantially alter the
primary use permitted under the conditional use permit shall
be subject to the review and approval of tbe Planning
Director and/or Planning Commission.

7. The exterior walls of the premises shall be maintained in a
neat and clean manner at all times.
8. Prior to the conditional use permit being in effect, the
applicant shall submit to the planning department, an
"Acceptance of Conditions" f:orm, signed by the PROPERTY
OWNER, and notarized.
9. The conditional use permit shall be recorded, and proof of
recordation shall be submitted with the planning department.
SECTION III Specific Conditions of Approval:
1. The hours of operation shall be limited to between 6:00 A.M.
and 12:00 midnight.
SECTION IV
Each of the above conditions is separately enforced,

Any violation of the conditions of approval and/or violation of
the Hermosa Beach Municipal Code may be grounds for citation
and/or a public hearing for the revocation of the conditional use
permit.
The Planning Commission may review this Conditional Use Permit
and may amend the subject conditions or impose any new conditions
if deemed necessary to mitigate detrimental effects on the
neighborhood resulting from the subject use.
