A RESOLUTION OF THE PLANNING CO:t1MISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW A
RESTAURANT (FEEBEE 'S YOGURT CAFE) WITHIN A RETAIL DESIGNATED
SPACE IN THE HERMOSA PAVILION, AND ADOPTION OF AN ENVIRONMENTAL
NEGATIVE DECLARATION, AT 1605 PACIFIC COAST HIGHWAY #114, LEGALLY
DESCRIBED AS PORTIONS OF LOTS 13 AND 14, BLOCK 81, SECOND
ADDITION TO HERMOSA BEACH TRACT
WHEREAS, the Planning Commission held a public hearing on
September 17, 1991, to receive oral and written testimony
regarding an application for a Conditional Use Permit and made
the following findings:
A. The proposed Yogurt Cafe is a low intensity small scale food
service business in 780 square feet of space, emphasizing
frozen yogurt snacks, as we 11 as other food items such as
soups, strudels, and sandwiches;
B. The business is located within a shopping center with over
70,000 square feet of floor area and 540 parking spaces, with
the various uses divided between retail, restaurant and movie
theatres, al lowing the large parking area to be shared by
uses which have demands at different times of the day;
C. Further, the proposed use is more likely to draw "spin-off"
customers as a secondary destination from a primary
destination of the movie theatres and, therefore, would not
signficantly increase new trips to the Hermosa Pavilion;
D. The proposed use is compatible with surrounding commercial
uses within the Hermosa Pavilion;
F. Strict compliance of the conditions of approval will mitigate

any negative impacts resulting from the issuance of the
Conditional Use Permit and Parking Plan.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California does hereby approve a
Conditional Use Permit and Environmental Negative Declaration
subject to the following:
SECTION I Conditions of Approval:
1. The proposed development shall be in substantial conformance
with submitted plans including the seating plans. Any
modifications to the plan shall be reviewed and approved by
the Planning Director.
2. The primary emphasis of the business shall be maintained as a
yogurt shop and the service of other snack foods that are
typically associated for consumption between meals.
Additionally, as a secondary emphasis, the business is
allowed to serve sandwiches, soups, salads, and strudel.
3. This business and the small addition to the leasing office,
and the incremental parking deficiency that has been created,
shall be incorporated into the review of the overall parking
plan for the Pavilion and compensated for, at the time when
the parking plan is amended to redistribute or include a
different mix of uses than what was included in the original
parking plan. If no modifications are made to the Parking
Plan these compensation measures shall be incorporated into
the review and approval of the implementation of parking
plan, including the valet program.
4. The establishment shall not adversely effect the welfare of
residents, and/or commercial establishments nearby.

7. Prior to the Conditional Use Permit being in effect the
applicant shall submit to the planning department, a signed
and notarized "Acc1:?ptance of Conditions" form.
8. The Conditional Use Permit/Parking Plan shall be recorded
with the deed, and proof of recordation shall be submitted to
the Planning Department.

9. Final drawings submitted for building permits shall be
prepared by a licensed architect or one of the other accepted
engineering disciplines.
SECTION II
Each of the above conditions is separately enforced, and if any
of the above conditions of approval is found to be invalid by a
court of law, all the other conditions shall remain in full force
and effect.
SECTION III
The Planning Commission may review the conditional use permit and
may amend the subject conditions or impose any new conditions
based on substantial findings that there are significant
detrimental impacts to the adjacent neighborhood as a result of
the operation of the business.
Any violation of the conditions of approval and/or violation of
the City of Hermosa Beach Municipal Code may be grounds for the
issuance of a citation of public hearing for revocation of the
Conditional Use Permit.
