A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A REQUEST FOR AN EXCEPTION FROM
SECTION 13-7(B) OF THE ZONING ORDINANCE TO ALLOW AN ADDITION TO
AN EXISTING NONCONFORMING STRUCTURE TO EXCEED 50% OF REPLACEMENT
VALUE AT 1040 TENTH STREET AND LEGALLY DESCRIBED AS LOT 43, TRACT
NO. 5650
WHEREAS, the Planning Commission held a hearing on December
3, 1991, regarding an application for an exception, pursuant to
section 13-7(B), to allow more than a 50% addition to a
nonconforming structure, and made the following findings:
A. The applicant is proposing an addition/remodel to an existing
s ingle-f ami ly dwel 1 ing that results in an addition/remodel
equivalent to 95.1% of the replacement value of the existing
structure;
B. The proposal is consistent with the intent of Article 13-0,
as a sound structure is proposed to be improved and the
existing nonconforming side yard of 3.8 feet rather than 4.6
feet is not a significant nonconformity, and all other
setbacks and zoning requirements are in compliance;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California, does hereby approve a
request for an exception, pursuant to Section 13-7(B) of the
zoning ordinance, to allow more than a 50% addition/remodel to
an existing nonconforming structure subject to the following
conditions of approval:
1 . The proposed development shall be in substantial conformance
with submitted plans. Any modifications shall be reviewed
and approved by the Planning Director.
2. Floor plans shall be submitted with the actual interior and
exterior dimensions of the garage. The garage walls adjacent
to the south and west property lines shall meet
specifications for a one-hour fire wall.

3. The project shall comply with the provisions of Article 13 of
the zoning ordinance.
4. No additional remodeling or expansion shall be permitted
unless the side yard setback complies with the zoning
ordinance.
5. The project shall comply with the requirements of the Public
Works department as contained in the attached memorandum from
Bill Glickman, Interim Public Works Director, dated November
25, 1991.
6. Roof-top mechanical equipment shall not be visible, and shall
not protrude above the parapet wall.

PUBLIC WORKS DEPARTMENT RE QUIREMENTS
1. All work done with the city right of way shall be done by a
currently licensed contractor with a Class "A" License and a
current City of Hermosa Beach Business License.
2. Public Works construction permits shall be required for any
scaffolding, utility trenching, lumber drops, dumpsters,
etc. on public right of way.
3. Any of the work requiring permits and started without
necessary permits shall result in the job being stopped
until the permits are obtained and a double fee for the
permit will be charged.
4. A refundable cash deposit for construction of all curbs,
gutters, sidewalks, paving, cross-gutters, driveway
approaches, etc. shall be required. The amount of this
deposit will be determined by the City Engineer.
5. The Public Works permit must be on the job site and
available for review by City officials at all times.
6. Applicant shall maintain and keep in force at all times
during construction a policy of liability insura.nce, naming
the city as Additionally Insured in the amount of one
million dollars ($1,000,000) minimum.
7. Any damage to existing public property such as street
pavement, curbs, sidewalks, drainage gutters, etc. shall be
repaired or replaced. Any such repair or replacement must
meet the requirements of the Department of Public Works.
8. Proper barricades shall be place around construction within
the public right of way. All utility trenches shall be
back-filled and a temporary A.C. patch installed by the end
of each work day.
9. Both the Fire Department and the police Department must be
notified if any public street will be blocked or closed
during construction.

10. New 6 11 curb and 18" gutter to be constructed. curb and
gutter to be poured monolithically (single pour).
11. Install sidewalk to match existing sidewalk as per City
standards. Sidewalk to be poured separate from curb and
gutter.
12. No drainage shall be allowed to cross over the surface of
the sidewalk.
13. 2% grade shall be required from top of curb to right of way
line.
14. New driveway approach shall be installed as per City
standards.
15. Install cold joint across driveway at right of way line.
16. Install new asphalt concrete pavement from lip of curb north
to center line of street.
