RESOLUTION BZA 154-582
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF
HERMOSA BEACH, CALIFORNIA GRANTING A CONDITIONAL USE PERMIT
ON PROPERTY LOCATED AT 1030 AVIATION BOULEVARD.
WHEREAS, the Board of Zoning Adjustments of the City of
Hermosa Beach, California, at a public hearing held on March 4,
1985 in the Council Chambers of the City Hall, considered the
request of Roberto and Mary Adimiri for a conditional use
permit for off-sale of beer and wine in conjunction with
the operation of a market/deli, on property located at
1030 Aviation Boulevard, legally described as Lots 79, 80, and
81, Tract 5650; and
WHEREAS, after due consideration the Board felt that the
request was consistent with the zoning and general plan; and
NOW, THEREFORE, BE IT RESOLVED that the Board of Zoning
Adjustments does hereby ·approve a conditional use permit to allow
off-sale of beer and wine inmnjunction with the operation of
a market/deli at property known as 1030 Aviation Boulevard,
subject to the following conditions:
1. Hours of operation are limited to 9:00 a.m. to 9:00 p.m.
2. No alcoholic beverages may be opened or consumed on the
premises.
3. The parking are is to be posted "No alcoholic beverages may
be consumed on the premises."

Operators of the business must police the area directly
adjacent to the business for litter and maintain in a clean
and orderly manner on a daily basis.

Subject to review in six months.
The parking l<bt shall be posted "Right turn only."

111 7. In the event that any one condition is found to be illegal
or unenforceable by a cout of competent jurisdiction, then
the parties agree that all other conditions shall remain
in full force and effect. The parties understand that the
applicant is repre$ented by counsel at all steps of these
proceedings and it is the opinion of the City Attorney
that the conditions meet constitutional requirements, and
in the event that either attorney is in error both parties
agree that no action for damages shall be brought against

the other party and that the exclusive remedy on behalf of the
applicant is for a Mandate of Declaratory Relief to make the
determination that any one or more conditions is illegal and
unenforceable, and parties waive all rights to damages.
