HomeMy WebLinkAboutBZA 154-589 (934 Hermosa Ave)~ .... 1 ,:.._.-~, i' ) 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ' 27 I / 28 RESOLUTION BZA 154-589 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, AMENDING THE CONDITIONS GOVERNING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 934 HERMOSA AVENUE (CALIFORNIA BEACH RESTAURANT) WHEREAS, the Board of Zoning Adjustments of the City of ; Hermosa Beach, California, held a public hearing on March 18, 1985, to determine whether the existing conditional use permit for beer and wine sales and outside dining in conjunction with the operation of a restaurant should be revoked or amended; and WHEREAS, The Board of Zoning Adjustments heard tes- timony from residents regarding previous problems attributed to the business such as overcrowding, loitering, excessive noise, and trash odors; and WHEREAS, the BZA heard testimony from the owners of Cal- ifornia Beach Restaurant regarding proposed measures to alleviate the residents concerns; and WHEREAS, the BZA determined that the conditional use permit should not be revoked but should be amended to address the demonstrated problems. NOW, THEREFORE, THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That all conditions of the original condi- tional use permit granted by the City Council on August 8, 1978 shall remain in full force and effect and are included here as though set forth in full. SECTION 2. That additional conditions applicable to this permit are as follows: 1) The maximum occupancy allowed for the interior dining area is 76 and the outside patio is 32. The areas shall be posted -1 - -... .. !""-..,-.., ' 1 2112) 3 4 5 6 113 ) 7 s ll 4) 9 10 115) 11 14 and violations of the maximum occupancy shall be cited pur- suant to Section 25.224(c) of the Uniform Fire Code 1982 Edition. There shall be no public address system allowed. All record- ed music shall be kept at a level that does not disturb adja- cent residential areas and there shall be no speakers for recorded music in any of the outside areas (lounge/ courtyard). Chapter 19 1/2 of the City Code entitled Noise Regulation shall be strictly complied with. Specifically, this conditional use permit is not a permit to violate Sec- tion 19 1/2 -3 entitled Noise Limits. Clean-up resulting in delivery of refuse to the trash bins shall occur prior to 6:00 p.m. The door leading to the alley shall be maintained in a closed position after 6:00 p.m. The means to open the door shall be restricted to authorized personnel of the establishments." The trash area shall be provided with a substantially tight fitting door, and the roof top vent shall be removed. Addi- tionally, the trash bins shall be cleaned or treated at regu- lar intervals to control odors. There shall be a review of the C.U.P. in six months.
