HomeMy WebLinkAboutBZA 154-596 (711 Pier Ave)c--., I / /' '\ ) ~-. . , RESOLUTION BZA 154-596 A RESOLUTION OF THE BOARD ZONING ADJUSTMENTS OF THE CITY OF HER-111 MOSA BEACH, CALIFORNIA, GRANTING A CONDITIONAL USE PERMIT ON PROPERTY LOCATED AT 711 PIER AVENUE, HERMOSA BEACH, CALIFORNIA. 2 3 4 5 6 7 8 g 10 11 WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, California, at a public hearing held on June 3,1985 in the Council Chambers at City hall, considered the request of Hermosa Beach C.V.S. Inc., dba C.V.S. Pharmacy for a conditional use permit to allow off-sale beer and wine by a retail outlet at property legally described as Lot 1, Block 80,Tract 9203; and WHEREAS, after this review the Board determined that the request is consistent with the zoning and general plan NOW, THEREFORE, BE IT RESOLVED that the Board of Zoning Adjustments 12 .. 13 14 15 does hereby approve a conditional use permit to allow the sale of beer and wine by a retail outlet subject to the following condi- tions: 1. 16 17 18 11 2. 19 20 21 22 II 3. 23 ,, . 4. 24 25 26 11 5. 27 28 The property shall be developed as indicated on Exhibit A- Merchandise Plan dated 12/12/84. All signs shall be submitted to the Building department for approval as part of a comprehensive sign plan for the Plaza Hermosa Development. The parking area shall be posted with a sign to read "No al- coholic beverages may be consumed on the premises." There shall be a review of the conditional Use Permit six months after a Certificate of Occupancy is issued. All conditions of the Alcoholic Beverage Control Board are incorporated in the Conditional Use Permit. -1 - ,/ .... " 1 2 3 4 5 6 7 8 9 10 11 12 13 14 6. Hours of operation to be from 9 a.m. to 10 p.m. 7. In the event that any one condition is found to be illegal and unenforceable by a court of competent jurisdiction, then the parties agree that all other conditions shall remain in full force and effect. The parties undertand that the appli- cant is represented by counsel at all steps of these proceed- ings and it is the opinion of the City Attorney that the con- ditions meet Constitutional requirements, and in the event that either attorney is in error both parties agree that no action for damages shall be brought against the other party and that the exclusive remedy on behalf of the applicant is for a Mandate of Declaratory Relief to make the determination that any one or more conditions is illegal and unenforceable, and parties waive all rights to damages under the Civil Rights Act as promulgated by a recent Supreme Court decision.
